This paper analyzes the importance of Indonesia's comprehensive legal framework on automated decision-making empowered by Artificial Intelligence, comparing it to the European Union, the United States, and China. Specifically, this paper inquires about the status quo of the legal protection of automated decision-making In Indonesia. The analysis highlights profiling in an automated decision-making system with the following discussion about personal data protection. In this context, the European Union's member states set out the General Data Protection Regulation (GDPR) that prohibits automated decision-making to a certain extent. In the United States, the practice of automated decision-making is rather usual. Simultaneously, China takes an exceptional measure instead and develops this automation through a social credit system. The analysis concludes that Indonesia has weak legal protection towards personal data and profiling, which later becomes the basis in facilitating automated decision-making. The provision of automated decision-making and profiling is the absolute bare minimum to Indonesia's Personal Data Protection Bill due to insufficient legal certainty. In the end, it is paramount for lawmakers to consider a comprehensive regulation on automated decision-making by adopting the European Union's GDPR framework. Purpose of research: define the general characteristics of the protection of personal data; analysis of legislation and case law.Methods of research: analysis and study of regulatory documents containing provisions on protection of personal data.Results: normative and practical importance of personal data protection provisions in various legal acts has been underscored.The right to privacy strengthened its position in the United States in the late 19th century and is now recognized by most States.Although the right to privacy in the United States was originally a British political legacy, judicial decisions in England were more conservativeand cautious than those of U.S. courts. One of the important features of this law in the Anglo-Saxon legal system is that itwas previously formed by judicial precedents and legal doctrine. Also, the right to privacy was not among the rights provided for in theBill of Rights. In general, there is an industry-wide approach to data privacy in the United States. There is no specific federal law thatwould guarantee the confidentiality and protection of personal data. Instead, legislation at the federal level is dispersed and aims to protectdata in certain sectors. Judicial practice and court decisions taken at different times play an important role in regulating personaldata protection in the United States. It is also worth mentioning that until the 1970s, decisions of the U.S. courts did not provide thenecessary privacy protection safeguards.Discussion: offering a comprehensive and detailed study and use of this practice in other states.

En el presente estudio se realiza un análisis del concepto legal de protección datos tanto a nivel normativo en la Unión Europa como en Estados Unidos, al igual que una breve visión de su evolución legislativa. El largo desarrollo teórico y normativo que ha habido en la Unión Europea deja entrever la importancia de la identidad digital de sus ciudadanos, mientras que la legislación norteamericana, más esparcida y sectorial, revela la fuerza que otorga al libre flujo de datos entre las entidades mercantiles. La importancia del presente estudio reside en que la comprensión de la concepción sobre la protección de datos en ambos sistemas, permitirá tener una mejor perspectiva sobre las debilidades y fortalezas que puedan existir en los acuerdos entre la Unión Europea y EE. UU. In the present study, an analysis of data protection as a legal concept is carried out in the European Union and in the United States, as well as a brief overview of its legislative evolution. The theoretical and normative development that has taken place in the European Union reveals the importance of the digital identity of its citizens. Nevertheless, due to the characteristics of the American legislation, the free flow of data between entities has more strength. The importance of this study lies in the fact that the understanding of the data protection concept in both systems will allow us to have a better perspective on the weaknesses and strengths that may exist in the agreements for the transfer of personal data between the European Union and the USA.

The consensus view is that European-style data protection (including the General Data Protection Regulation (2016/679) (GDPR)) is becoming the global standard. But this view is not shared by all, with scholars pointing to divergence between European and American approaches to privacy. Determining the relative influence of each model is important. Regulation of the private sector use of personal data can shape economic and social conditions, from the cost of running a business to the relationships between consumers, companies, and their governments. This essay argues that it is too soon to conclude that the European Union has won the competition to influence global data protection and privacy laws, especially as the United States finds itself in the midst of shaping and defining its own privacy regime. I will explore the GDPR's viability as a global regulatory model, raising reasons to doubt that it will ultimately dominate the privacy regulation market. First, the mere fact that the United States is likely to develop a federal privacy regime that will depart from the European model will be influential in its own right. Second, there are compelling economic reasons for private and public entities to lobby against European-style regulation.

Artikel ini ingin menjawab pentingnya penetapan aturan hukum yang tegas dan kompre-hensif yang dapat memberikan perlindungan terhadap data pribadi yang berlangsung melalui media elektronik di Indonesia. Permasalahan ini muncul dengan perkembangan teknologi informasi saat ini telah menimbulkan persoalan hukum baru, yaitu mengenai perlindungan keamanan atas data pribadi yang berlangsung melalui media elektronik. Banyaknya pihak yang menggunakan media elektronik tersebut sebagai alat komunikasi dan transaksi mengakibatkan terjadinya penyalahgunaan data pribadi. Sejumlah negara seperti Uni Eropa, Amerika, Inggris, Hongkong, Singapura, dan Malaysia, telah memi-liki aturan yang tegas dan komprehensif berkenaan dengan data pribadi. Akan tetapi sampai sejauh ini Indonesia belum punya undang-undang khusus yang mengatur perlin-dungan data pribadi. Di Indonesia aturan mengenai hal tersebut terdapat dalam Pasal 26 UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dan juga tercantum dalam beberapa aturan hukum lainnya yang terpisah. Meskipun demikian, Pasal tersebut dianggap umum. hal ini dipandang perlu segera disahkan dalam bentuk undang-undang tersendiri untuk memberikan jaminan keamanan dan perlindungan data pribadi serta dapat memberikan sanksi baik dalam bentuk pidana ataupun perdata bagi yang menyalahgunakan data pribadi tersebut.  Urgency of Personal Data Protection Law in Indonesia: Comparative Study of English and Malaysia Law  This article aims to answer the importance of enactments assertive and comprehensive legal rules in Indonesia that can provide personal data protection on electronic media. This problem emerges with the recent development of information technology which has led to new legal issues. The issues are about security and protection towards personal data that occured through electronic media. There are people who use electronic media as a tool of communication and transaction which may lead to the abuse of personal data. Some countries such as the European Union, the United States, the United Kingdom, Hongkong, Singapore and Malaysia already have assertive and comprehensive law regarding the protection of personal data; however, so far there is no specific law in Indonesia that regulates personal data protection. In Indonesia, the regulation about personal data protection is stated in Article 26 of Law Number 11 Year 2008 on Information and Electronic Transactions and also this personal data protection regulation listed in several separate legal rules. Nevertheless, it’s Article is considered general. Therefore, it is deemed necessary to be immediately ratified in the form of law to provide security and protection and may impose sanctions in both criminal and civil forms for those who misuse the personal data.

O artigo discorre sobre a questão da proteção de dados e privacidade dos usuários nas bibliotecas a partir do empréstimo de livros eletrônicos realizado pela parceria OverDrive-Amazon e o uso de redes sociais. É realizado um breve panorama dos normativos relativos à confidencialidade de dados por parte das bibliotecas nos Estados Unidos, países da Europa e a situação brasileira. Finaliza discorrendo sobre a importância da utilização de livros eletrônicos e redes sociais pelas bibliotecas, ressaltando apenas que esse uso seja realizado garantindo a preservação e confidencialidade dos dados pessoais dos usuários, utilizando-se das informações coletadas, mas revertendo-as em ofertas de serviços e divulgação dos acervos.AbstractThe article discusses the issue of data protection and privacy of patrons in libraries from lending e-books performed by OverDrive-Amazon partnership and the use of social networks. A brief overview of the normative regarding confidentiality of data by libraries in the United States, European countries and the Brazilian situation is realized. Concludes by addressing the importance of using e-books and social networks by libraries, noting only that its application is carried out ensuring the preservation and confidentiality of patrons personal data, using the information collected, but reversing them into service offerings and dissemination of collections.KeywordsE-books; Patron data protection; Social networks; Privacy; big data
