Legal education in the contemporary world is changing. The main influences are linked to developments in transportation and communication and the enmeshing of diverse economies embraced by globalization. Law schools confront more mobile and more ambitious students who wish to experience different jurisdictional practices, to serve the increasingly global business community and to be more competitive. This research examines the modifications required in legal education as a result of globalization with specific reference to law schools in the BRICS countries of Brazil, Russia, India and China.Research on higher education, and legal education in particular, has been growing in recent years, yet there is still a gap in the study and comparison of the specifics of legal education within the BRICS countries. This research makes an attempt to analyze and contrast the current goals, objectives, structure and quality of higher legal education in Brazil, Russia, India and China. The specifics of law schools have been studied over the past twenty years in correlation with economic, cultural and education trends in BRICS and globally.Based on research literature, practitioner literature and legislative sources, this paper outlines common and special features of lawyer training in BRICS. The prime similarity of the legal education systems in BRICS are global education trends and the influence of the U.S. and UK education systems. Each BRICS country experienced an “explosion” in the popularity of legal education and, consequently, the urgent need to reform the education process in order to attain better quality and affordability. The result of these reforms, taking place in each country from 1950 to today, has become the growing differentiator of the educational institutions, turning them into “elite” and “mass” law schools.The facets of legal education in Brazil, Russia, India and China are attributed to their national policies as well as the historical development of the educational institutions and their perception of what specific lawyer skills and competencies are demanded by the legal market and national population. We conclude that the structure and quality of legal education as well as the requirements and monitoring tools vary in each country. These are dependent on several factors: the specific country’s ideology, its economic development, its proximity to an “Eastern” or “Western” model, its ability to learn from foreign education systems and its attempts at self-identification in the global educational space.

The celebration of 180 years of legal education in Brazil, held in August 2007, was marked by strong criticism of the Ordem dos Advogados do Brasil (Brazilian Bar Association) and the higher education expansion policy which was undertaken in the late 1990s, establishing more than a thousand law schools in the country. The escolas de enganação (schools of illusion), created mainly during the last decade, would have increased the numbers in the professional college, which currently has around 600,000 lawyers, to approximately two and a half million, if it were not for the professional filter of the Bar Exam. In other words, the proliferation of mass legal courses in Brazil would have enabled the emergence of educational merchants, specializing in the sale of an illusion of social elevation and professional success, which, thanks to the control of entry into the professional corporation, did not happen.

O presente texto visa investigar a prática do ensino jurídico do Brasil, fazendo um levantamento crítico desde o seu início em 1827. Ao depois, aponta deficiências que precisam ser reparadas, tais como uma visão interdisciplinar e da realidade e o estudo do direito comparado. Aborda o método de aprendizagem a ser observado na atualidade. Igualmente, lança desafios, quais sejam a necessidade do estudo dos precedentes e das técnicas de solução consensual dos conflitos.

O artigo enfoca a questão do ensino jurídico no Brasil, tendo como marco inicial a colonização deste país e a partir daí o incremento que o Direito de fato teve com o passar do tempo. O estudo adequa dessa forma, uma historicidade a respeito desse ensino, sua expansão até a atualidade, e como está atualmente o ensino jurídico no Brasil. O presente artigo será desenvolvido com um conciso histórico do ensino jurídico no Brasil. Após, será apresentado o modelo de ensino dogmático ainda dominante nos dias de hoje e as novas legislações que tentam reverter este quadro. E, por fim, serão apresentados alguns caminhos que podem ser trilhados para se alcançar um ensino que forme profissionais habilitados para garantir a efetividade do Direito na conjuntura social. Palavras chave: Graduação em Direito. Ensino Jurídico. The article focuses on the issue of legal teaching in Brazil, having as an inicial mark the colonization of this country and, from there, the increament that the Law really had over the time. The study thus adapt a historicity about this teaching, its expansion to the present and how the legal teaching is currently in Brazil. This article will be developed with a concise historical history of legal education in Brazil. Afterwards, it will be presented the model of dogmatic teaching still dominant today and the new legislation that tries to reverse this situation. And, finally, some paths will be presented that can be traced to reach an education that will train professionals qualified to guarantee the effectiveness of Law in the social conjuncture. Keywords: Graduation in Law.
