A Municipal Council has an important role to play in representing the interests of the population at the local level. At the same time in Russia the evolution of the legal status of this institution since the beginning of the 1990s is ambiguous: the capability and activities of representative bodies are limited. The paper, through the prism of the views and ideas of the famous Soviet and Russian constitutionalist Ekaterina I. Kozlova, examines the nature and legal status of representative bodies at the local level based on the principle of their supremacy. The implementation of this principle is also analyzed on the example of foreign models of local government. According to the author, the current weakness of representative bodies in the Russian model of organization of municipal authorities does not meet the requirements of efficiency and does not provide actual representation of interests of local territorial communities. Thus, the author urges to take into account both foreign and historical (Soviet) experience of development of institutions of administration and self-government in the field under consideration.

<p>The study has been devoted to showing the relationship between legal security and financial security at the local government level. To this end, firstly some consideration has been given to determining the meaning of the terms “security” and “financial security” from the point of view of the state and local government. In addition, it has been shown that financial security is inextricably linked to the financial power enjoyed by the state, specifically by the bodies acting in its name and on its behalf. The power resulting from this is the financial power of local government units, which is enjoyed by such units although to a limited extent. However, it has been found that even this scope of legal regulations limiting the possibilities of authoritative financial activities of local government bodies is of key importance from the security viewpoint of local communities.</p>

Introduction. The process of fiscal decentralization contributes to the transformation of territorial communities and local authorities into full-fledged members of the system of financial inter-connections. Territorial communities have individual financial interests. The need to protect them is at the heart of creating a safe environment for the functioning of territorial communities. However, financial security of territorial communities as separate economic units is not given enough attention to Ukraine. Instead, a more general notion is explored which isfinancial security of the regions. Purpose– theoretical substantiation of author's view on the content and structural components of the financial security of territorial communities, its place in the system of financial security of territories and the state as well as systematization of main threats to the financial security of communities in the context of implementing the budget decentralization policy. Results. The definition of financial security of territorial communities is substantiated. It is based on the protection of the financial interests of territorial communities. The features of financial interests of territorial communities are derived. Components of financial security of territorial communities are characterized. These include budget, tax, debt and investment security. The main threats to the financial security of territorial communities are analyzed and systematized. They are a result of imperfect institutional environment for local self-governments and the integration of territorial communities as subjects of a single (national) economic system. Furthermore, the threats are connected to the peculiarities of the territorial economy, communal infrastructure, the level of public consciousness and financial responsibility of heads of local self-overnment bodies. Conclusions.The financial security of territorial communities should be investigated as a part of the financial security of regions. Achieving a desirable state in practice requires synergy with the financial security of households and business entities located on the territory concerned. It is also necessary to seek coordination of financial interests of various territorial ommunities and the state as a whole.Local governments and central authorities are responsible for creating a safe financial environment for the functioning of territorial communities during budget decentralization. It is necessary to improve the mechanism of inter-territorial redistribution of financial resources.The list of potential threats to the financial security of territorial communities should be identified in the process of strategic development of territories and the use the SWOT-analysis for this purpose.

The article deals with the problem of independence / dependence of local self-government of the Slovak Republic in the context of financial reform and budget decentralization. Financial reform and budget decentralization, as reform ideologues in Slovakia, have been defined as an opportunity to ensure the independence of local self-government. In general, administrative reform in the Slovak Republic can be divided into three stages. At the first stage (1990-1993) the basic level of self-government - communities (municipalities) was determined and the division into state administration and local self-government was carried out. There was a separation from the Soviet model of public administration, local self-government was given the powers defined by law. However, in financial terms, most communities remain dependent on central budget resources. At the second stage of reforms (1993-1998) a dual system began to emerge - when local self-government and public administration coexisted. In general, such a system allowed the state to have a major influence on local government decision-making and to redistribute community resources manually. The third stage of reforms (1998-2005) is characterized by extreme reforms. The powers of public administration and local self-government were clearly shared. In the process of deconcentration of power, most of the powers were gradually transferred from state government to local government. Local self-government remained at two levels: community (municipality) - base level and territories – higher, land level. At the same time, public administration was maintained at the sub-level – the district (okres), average between communities and territories. An important problem of financial reform and budgetary decentralization was ensuring the independence of local budgets. As a result of the reform, a tax was defined - a personal income tax, which was distributed in some proportion between the community budget, the territory budget and the central budget. An exclusive list of taxes that could be charged on the benefit of communities and provinces was determined. Therefore, they received guaranteed sources of budget revenue. We have analyzed the effectiveness of budgetary decentralization on two criteria: the guaranteed budget revenues and the level of financial independence / dependence of local government budgets. In Slovakia, local government has guaranteed sources of revenue. It is both the right to charge one's own taxes and the distribution of the personal income tax. This system has been stable since 2005 and has not changed. However, the analysis of revenue receipts showed that the budgets of the region are very dependent on resources from the central budget. That is, they do not have enough revenue receipts from the sources defined by law. Community budgets show greater independence by having more tools to pump up their budgets.
