In the context of increased expectations of healthcare services and fiscal pressures, rights claims constitute a force pushing for privatization and thus threaten Canada’s single-tier public system. This article introduces the concept of a ‘post-social right’ to understand the current legal effort to enforce a right to healthcare derivative of section 7 of the Canadian Charter of Rights and Freedoms. Commonly considered as a ‘negative’ right, I suggest that the right also has positive capacity. Rather than simply protecting against unjust state intervention, section 7 claims valorize a particular mode of sustaining life, liberty and security of the person according to neo-liberal principles. A right to markets in healthcare aligns health law with the logic of prudentialism as a technology of governance. As the enforceability of the right expands and strengthens, health law as governance operates to normalize market solutions to health matters. It follows that a form of two-tier citizenship arises, dividing ‘activated’ citizens from the ‘inactive’.

Incentives contribute to the proper functioning of the broader contracts that regulate the relationships between health systems and professionals. Likewise, incentives are an important element of clinical governance understood as health services’ management at the micro-level, aimed at achieving better health outcomes for patients. In Spain, monetary and non-monetary incentives are sometimes used in the health services, but not as frequently as in other countries. There are already several examples in European countries of initiatives searching the promotion of biosimilars through different sorts of incentives, but not in Spain. Hence, this paper is aimed at identifying the barriers that incentives to prescribe biosimilars might encounter in Spain, with particular interest in incentives in the framework of clinical governance. Both questions are intertwined. Barriers are presented from two perspectives. Firstly, based on the nature of the barrier: (i) the payment system for health professionals, (ii) budget rigidity and excessive bureaucracy, (iii) little autonomy in the management of human resources (iv) lack of clinical integration, (v) absence of a legal framework for clinical governance, and (vi) other governance-related barriers. The second perspective is based on the stakeholders involved: (i) gaps in knowledge among physicians, (ii) misinformation and distrust among patients, (iii) trade unions opposition to productivity-related payments, (iv) lack of a clear position by professional associations, and (v) misalignment of the goals pursued by some healthcare professionals and the goals of the public system. Finally, the authors advance several recommendations to overcome these barriers at the national level.

Barack Obama's election was an extraordinary event in American and world history, but already in his second year as president, the luster and the popularity of the Obama administration has faded, even among many who mobilized to elect him. In addition to righting two wars, Obama is attempting to fix a broken health care system in the context of a nationally contentious electorate and Congress. He also is coping with a mounting debt burden from seeking to recover from an economic collapse and public anger at an environmental disaster of mega proportions, requiring him to rein in the banks and corporations that were unleashed from public regulation during the Reagan, Bush, and Clinton years. In addition, he is commander-in-chief of the U.S. military and its rapidly expanding U.S. Africa Command (AFRICOM).This was an administration elected on “hope for change.” Indeed, Obama's election raised expectations across the U.S. and throughout Africa that a man of African heritage, indeed a global person, could be and had been elected. This quintessentially optimistic, intelligent, and gifted American is the product of a Kenyan father and an internationally engaged mother, a multicultural childhood, and a global education as graduate of a private secondary school and elite American universities, and he has been pinned simultaneously with American, biracial, African American, African, and even global identities (see Zeleza 2009).

Postwar Poland has experienced relatively great economic instability and recurring political upheavals, at least by East European standards. Recent dramatic developments include a severe economic crisis following an extended period of spectacular growth. The collapse of the once popular leadership of Edward Gierek, the creation of the first independent trade unions under a communist regime, and the replacement of party with military rule bear witness to the severity of Poland's political disruptions. Have economic or political factors caused the economic crisis? Which are the critical factors? Escalating internal political tensions and enormous external political pressures have caused Poland's current economic collapse, preventing the successful implementation of adjustment policies. The underlying sources of these political forces–namely, worker disillusionment with communist practices and confrontational relations between the superpowers–have not eased to date; the current malaise is likely to continue for some time.
