Abstract In the debate on the European Union’s problems, the concept of “democracy deficit” has been present from its very beginning. This term is applied in a quite vast manner and, apart from the asymmetry of the relation between the European Parliament and the Council, it also concerns the overly limited role of national parliaments in the European Union. In this regard, inadequacy in the national position of individual parliaments is observed. On the other hand, it is necessary to emphasise their uneven activity on their European aspirations. At the time when the European dispute on the rule of law in Poland has polarized attitudes and language in statements on both sides – despite irresponsible trends – it is worth to examine the participation of national parliaments (including the Polish parliament) in the European inter-parliamentary dialogue and, consequently, to determine whether and how its constructive impact on the European Union and its law functions.

THE SINGLE EUROPEAN ACT AND THE MAASTRICHT TREATY attempted to balance two principles of representation in their redesign of the institutional structures of the European Union: the one, based on the indirect representation of publics through nationally elected governments in the European Council and Council of Ministers; the other, based on the direct representation of publics through a more powerful European Parliament. There is much to be said for this balance, for neither of the two principles can, on its own, be an adequate solution at this stage in the development of the EU. The Council suffers from a non-transparent style of decision-making and is, in the view of many, closer to oligarchic than to democratic politics. On the other hand, the claims of the European Parliament to represent public sentiments on European integration are limited by low voter participation, the second-order nature of European elections and the still Protean nature of what we might call a transnational European demos. The EU lacks a single public arena of political debate, communications and shared meanings; of partisan aggregation and political entrepreneurship; and of high and even acceptance, across issues and member states, that it is European and not national majority views which should count in collective rule-making.

This article examines the influence of the European Parliament (EP) within the legislative process of the European Union. Although debate over the impact of the cooperation and co-decision I procedures continues, this article argues that, in part, the current theoretical debate is a false one that has caused many of the other important variables that affect EP legislative influence to be ignored. This article briefly revisits the current debate, then proceeds to an analysis of the success of more than 1,000 EP amendments under the cooperation and co-decision procedures. This evidence suggests that numerous other variables, such as internal EP unity and type of amendment made, have a significant impact on EP success, even controlling for procedure. In addition, this comparison points out some empirical differences between the two procedures that have been largely ignored in the theoretical debate but that nonetheless have a significant impact of EP success and merit further study.

TWO QUESTIONS ARISE WHEN CONSIDERING THE CHANGES that might be brought about by direct elections and by developments in the new European Parliament. One concerns institutionalized cooperation between political parties. To what extent can the three existing European party federations – Socialist, Christian Democrat, Liberal – be considered as a step towards the formation of genuine European political parties? Are they anything more than alignments of traditional parties coordinating their action at European level? The other question is related to parties or groups which have not until now created close-knit ad hoc structures. A special case is that of the Communist parties, which have not organized specific links at Communit level. Another problem is raised by non-traditional parties and groups that have in most cases little or no parlia mentary representation at either national or European level. Will some of them take advantage of the European sphere of action to make more impression than they have been able to do at domestic level, in cooperation with similarly oriented partners in other member countries?

Article 229a EC Without prejudice to the other provisions of the Treaties, the Council, acting unanimously in accordance with a special legislative procedure and after consulting the European Parliament, may adopt provisions to confer jurisdiction, to the extent that it shall determine, on the Court of Justice of the European Union in disputes relating to the application of acts adopted on the basis of the Treaties which create European intellectual property rights. These provisions shall enter into force after their approval by the Member States in accordance with their respective constitutional requirements.

This chapter focuses upon the European Parliament (EP), an institution that has seen its power dramatically increase in recent times. The EP has been transformed from being a relatively powerless institution into one that is able to have a genuine say in the legislative process and hold the European Union’s executive bodies (the Commission and Council, introduced in Chapters 9 and 10) to account in a range of policy areas. However, increases in the Parliament’s formal powers have not been matched by an increase in popular legitimacy: turnout in European elections is falling. Thus, while the EP’s legislative power is comparable to that enjoyed by many national parliaments, it has struggled to connect with the wider European public. The chapter explores these issues in detail. In the first section, the EP’s evolution from talking shop to co-legislator is reviewed; its powers and influence are explained in the next section; the EP’s internal structure and organization are then discussed with a focus upon the role and behaviour of the political groups, and finally, the European Parliament’s representative function as the EU’s only directly elected institution is discussed.

This chapter examines the role of the European Parliament (EP) within the European Union's system of governance. It also considers the function and operation of the EP by focusing on three key areas of importance: the legislative work of the Parliament, its internal politics, and its representative role as a link between the electorate and EU decision-making processes. The chapter first charts the evolution of the EP before discussing its budgetary and legislative powers, along with its advocacy for constitutional change to bring Europe closer to its citizens. It then discusses the influence and internal politics of the EP as well as elections to the EP, noting that national parliaments are now able to block proposed EU legislation. It also describes the principal challenges facing the EP.

Purpose The purpose of this paper is to consider the challenges, advantages and limits of ethnographical approaches to the study of parliament. Challenges in the study of political institutions emerge because they can be fast-changing, difficult to gain access to, have starkly contrasting public and private faces and, in the case of national parliaments, are intimately connected to rest of the nation. Design/methodology/approach Ethnography usually tends to be difficult to plan in advance, but especially so when parliament is the focus. Findings Research in parliament requires clear questions but an emergent approach for answering them – working out your assumptions, deciding on the most appropriate methods depending on what wish to find out, and continually reviewing progress. Its great strengths are flexibility, ability to encompass wider historical and cultural practices into the study, getting under the surface and achieving philosophical rigour. Rigour is partly achieved through reflexivity. Research limitations/implications One implication of this is that not only will each study of parliament be different, because each is embedded in different histories, cultures, and politics, but the study of the same parliament will contain variations if a team is involved. Originality/value Ethnographical research is a social and political process of relating; interpreting texts, events and conversations; and representing the “other” as seen by observers.
