Ryerson University Library in Toronto, Canada, embarked on an E-Reserve pilot project in 2004, providing electronic links to journal articles and scanned documents for course readings. Insufficient time allowed by faculty for copyright clearance, excessive copyright cost and the difficulty of achieving a single sign-on by users to access e-Reserve in Blackboard, the University’s courseware, were the major issues. Despite setbacks, E-Reserve continued to undertake innovative projects, using the new E-Reserve module in Blackboard to integrate course readings with faculty course pages, utilizing SFX open linking to connect citations to full-text articles, and experimenting with Web streaming of videos in Blackboard.

Orphan works are works that are still protected by copyright and whose owners cannot be identified or located by prospective users for copyright clearance. Many countries have addressed this issue since the emergence of the problem, and it remains a legitimate subject of inquiry in this present day. However, Malaysia is yet to initiate public consultations and formulate legislative and non-legislative solutions to the orphan work problem. Hence, this paper aspires to underline the challenges and obstacles in exploiting the orphan works in Malaysia. It starts with a brief introduction to the orphan works problem and its causes. It further highlights the legal and policy uncertainties about the orphan work phenomenon in Malaysia and its implication to higher learning education. Besides, this paper also examines the current practices in the United Kingdom and Canada. Finally, this paper proposes some suggestions into what Parliament and policymakers have to do and avoid when solving Malaysia's orphan work phenomenon. It is hoped that the access to the orphan works in Malaysia would not be problematised, thereby liberating them from the copyright orphanage.    Keywords: Copyright law, Orphan works, Orphan works licensing scheme

The starting point of this article is a short documentary film that I and five colleagues produced in the course of the Business of Film module at Queen Mary University of London's Intellectual Property Law LLM Programme. During the process of production, we faced some borderline issues regarding our unauthorized uses of others’ copyright works. When we put ourselves into the copyright's author's shoes, three problems arose regarding our use of possible limitations and exceptions: the lack of guidance; the fear of liability; and the unharmonized status of limitations and exceptions at an international level. This article examines these problems from a copyright policy perspective and invites documentary festivals to undertake a mission of guiding new documentary directors through the complex, unharmonized world of copyright limitations and exceptions.
