Palliative treatment has been the subject of constant discussions, mainly about the fact that opioid drugs are narcotics controlled by international agreements and organizations, which regulate their access and distribution. Latin America has different levels of narcotics distribution, which are determined by economic, social, and cultural factors. Illicit trade and excessive consumption have generated barriers that limit their availability for palliative treatment. In this sense, this article analyzes domestic and international regulations governing access to narcotics within palliative treatment and proposes that the guarantee of pain relief be expressly enshrined as part of the human right to health.

Covid-19 has challenged various actors in our society, including companies. The role of businesses during the pandemic, within the framework of due diligence, is essential not only to ensure the human rights of its workers and those close to them, but also for the common welfare of society. Faced with this situation, this article advances the need to come up with a Corporate Prevention Plan for health emergencies under seven key fronts, so that companies can anticipate the effects that a pandemic or other emergency may have on their activities.

Noncommunicable diseases (NCDs) are the leading cause of morbidity, mortality, and disability in the Americas. NCDs are largely preventable because of the modifiable nature of their risk factors, including the elevated consumption of processed and ultra-processed products that can be traced to the recurrent practices of the food and beverage industry. This article explores diet-related risk factors to NCDs as a human rights issue that can and should be addressed within the Inter-American Human Rights System (IAHRS). In particular, we argue that States can potentially be held responsible for their failure to comply with the obligation to guarantee human rights; specifically, by not acting with due diligence through the regulation of the food and beverage industry. Moreover, we argue that States can also potentially be held responsible for failing to comply with the obligation to respect human rights, considering its complicity with the food and beverage industry.

This paper analyzes the current regulation of friendly settlements before the European Court of Human Rights. The most conflictive point in its regulation is the nebulous clause of respect for human rights which, in practice, has not been clarified by the Court’sjurisprudence.

The COVID-19 sanitary emergency has presented unprecedented challenges to the entire world and exacerbated pre-existing inequalities in societies. In order to respond, the States have designed various economic and social policies that try to alleviate the negative consequences on families. This article shows how, in Argentina, the development of new policies, instead of correcting deficiencies of the past, deepens inequalities in access to rights among the population, excluding children on the basis of their migratory status. These policies contradict international and regional regulatory frameworks, as well as national ones, and their severity is accentuated by the poverty rates and rights violations that this population group endures. Migrant children are in a situation of double vulnerability, due to their status as children and their status as migrants, which results in even higher levels of poverty.
