Abstract Author in the article tries to analyse different elements of document called European Constitution. Analysis is supported with theoretical framework of federalism, presented by Brezovšek. Authors is playing with idea of (con)federal and international organization elements of European Constitution and their mix. They are also trying to set some connections between so called common European identity as necessary condition to give legitimacy to the European Constitution. This became important question after „votes of non-confidence“ to the European Constitution in France, despite it should be addressed already before. However, European Constitution is important document on the path of European integration and lack of support to it will slow down this process of widening and deepening European ties.

The problem of a European Constitution is discussed at a fundamental level. In which way, can we speak about such a Constitution? Thearticle argues against the “postnational souveranism”, legitimating state against citizens. A new kind of citizenship is favoured based on extended social rights. The constitution now proposed contrarily makes the European Central Bank and its neoliberal policy to central and nearly unchangeable institution.

The aim of this article is to show what impact the crisis in the European Union, along with the crisis in the euro zone at the forefront, had on European identity, interwoven with the identity of the European Union to such an extent that these terms are often handled as equivalent. Developments and crises situations which exert an influence on European identity were presented with respect to areas of particular importance that affect the way the European Union is identified within the community and abroad. Following issues were discussed: implications of the crisis for the European Union’s international identity, for the European social model (welfare state), for transnational identity (in internal relations) and for unity and solidarity in the European Union. In the conclusion, it is stated that the economic, political and social crises had undermined the gradual development of European / European Union identity among citizens and had an impact on its image in international relations.

Every nation is quite diverse in terms of his historical destiny, spiritual priorities, and cultural heritage. However, voluntary European integration, which is the final aim of political integration that began in the second half of the twentieth century from Western Europe, provided for an availability of large number of characteristics in common in political cultures of their societies. Therefore, Ukraine needs to find some common determinants that can create inextricable relationship between the European Community and Ukraine. Although Ukrainian culture is an intercultural weave of two East macrocivilizations, according to the author, Ukraine tends to Western-style society with its openness, democracy, tolerance, which constitute the basic values of Europeans.
