AbstractIntellectual property rights protection is at the forefront of some of the major controversies regarding the impact of globalization. African countries have in recent years participated to an unprecedented degree in both international and bilateral initiatives dealing with intellectual property. The negotiating positions have been varied and, from a regional perspective, have not been coherent at some levels, with different countries advancing different positions. African countries have adopted regional integration as a strategy to deal with the challenges of globalization. Regional integration is believed to increase negotiating capacities and competitiveness in global trade. It is also believed to improve access to foreign technology. The African Union is facilitating the establishment of a continental intellectual property body. Accordingly, the main aim of this article is to discuss the establishment of the Pan-African Intellectual Property Organization in line with the African Union's vision for regional integration.

Abstract: Abuse Trademark License Agreement In Business Practices Intellectual Property Rights. The background of this study is related to the problems that exist because of the impact of the misuse of the trademark license agreement on business practices intellectual property rights. The results showed that the Misuse of brand licensing agreements in business practice of intellectual property rights protection is essential, the misuse of the trademark license agreement is due to several factors that can cause defects in the eyes of the brand license agreement and the law can also be detrimental to all parties concerned. The study also describes the efforts to resolve disputes in a brand licensing agreement as provided for in Article 84 of Law No. 15 of 2001 on Marks.   Abstrak: Penyalahgunaan  Perjanjian Lisensi Merek Dalam Praktek Bisnis Hak Atas Kekayaan Intelektual. Latar belakang penelitian ini adalah terkait masalah-masalah yang ada karena dampak dari adanya penyalahgunaan perjanjian lisensi merek terhadap praktek bisnis hakatas kekayaan intelektual. Hasil penelitian ini menunjukkan bahwa Penyalahgunaan perjanjian lisensi merek dalam praktek bisnis hak atas kekayaan intelektual sangatlah penting perlindungannya, adanya penyalahgunaan perjanjian lisensi merek ini karena adanya beberapa faktor yang dapat menyebabkan perjanjian lisensi merek cacat dimata hukum dan juga dapat merugikan semua pihak yang bersangkutan. Penelitian ini juga menjelaskan mengenai upaya penyelesaian sengketa yang ada dalam sebuah perjanjian lisensi merek sebagaimana yang telah diatur dalam pasal 84 Undang-Undang Nomor 15 Tahun 2001 tentang Merek.    DOI: 10.15408/jch.v2i1.1847

This chapter argues for a reinvigorated role of the market access doctrine and references a number of important antitrust and intellectual property law decisions in which courts have given priority to market access. It finds a novel function for market access to play within antitrust and intellectual property law liability: courts that grant plaintiffs access to a defendant’s production output should refer to a three-step test under which they inquire (1) whether the inventor, through first-mover advantages, has reaped a sufficient reward such that contractual or intellectual property rights protection would no longer be required to facilitate innovation, (2) whether competitors were able to challenge the proprietary platform’s position in the market without the possibility of granting access, and (3) whether competitors seeking to benefit from market access will make use of it to facilitate the introduction of new goods rather than merely to copy the initial invention.

Based on the oligopoly game theory and the intellectual property rights protection policy, we investigate the complex dynamical behaviors of a mixed duopoly game with quadratic cost. In the new system, a few parameters are improved by considering intellectual property rights protection and the stability conditions of the Nash equilibrium point are discussed in detail. A set of the two-dimensional bifurcation diagrams is demonstrated by using numerical modeling, and these diagrams show abundant complex dynamical behaviors, such as coexistence of attractors, different bifurcation, and fractal structures. These dynamical properties can present the long-run effects of strengthening intellectual property protection.
