In South Africa, persons or companies convicted of fraud or corruption or companies whose directors have been convicted are debarred from participating in bidding for government tenders. Although it is easy to establish whether or not a natural person has been convicted of an offence, because a certificate can be obtained from the South African Police Service to that effect, it is the opposite with juristic persons. This issue came up in the case of Namasthethu Electrical (Pty) Ltd v City of Cape Town and Another in which the appellant company was awarded a government tender although the company and its former director had been convicted of fraud and corruption. The purpose of this article is to analyse this judgment and show the challenges that the government is faced with when dealing with companies that have been convicted of offences that bid for government tenders. Because South Africa is in the process of enacting public procurement legislation, the Public Procurement Bill was published for comment in early 2020. One of the issues addressed in the Bill relates to debarring bidders who have been convicted of some offences from bidding for government tenders. Based on the facts of this case and legislation from other African countries, the author suggests ways in which the provisions of the Bill could be strengthened to address this issue.

South Africa remains one of the most unequal societies in the world and any discussion around poverty and the church’s response cannot exclude this reality. This article attempts to analyse the response of wealthy, ‘majority white’ suburban congregations in the southern suburbs of Cape Town to issues of poverty and inequality. This is attempted through the lense of restorative justice, which is broadly explored and defined through a threefold perspective of reconciliation, reparations and restitution. The first part explores a description of the basic features of poverty and inequality in South Africa today, followed by a discussion on restorative justice. This is followed by the case study, which gives the views of clergy and lay leaders with regard to their congregations’ perspectives and responses to poverty and inequality within the context of restorative justice. Findings from the case study begin to plot a tentative ‘way forward’ as to how our reality can more constructively be engaged from the perspective of congregational involvement in reconstruction of our society.

Abstract Background Rattus spp. are frequently implicated as key reservoir hosts for leptospirosis, one of the most common, but neglected, bacterial zoonoses in the world. Although leptospirosis is predicted to be a significant public health threat in Africa, studies from the continent are limited. Methods Rattus spp. (n=171) were sampled (January-May 2016) across the City of Johannesburg, South Africa’s largest inland metropole. Rattus spp. genetic diversity was evaluated by full length (1140 bp) cyt b sequencing of 42 samples. For comparison, a further 12 R. norvegicus samples collected in Cape Town, South Africa’s largest coastal metropole, were also genotyped. Leptospira infections were identified and genotyped using real-time PCR and multi-locus (lfb1, secY, lipL41) DNA sequencing. Results Five R. norvegicus haplotypes were identified across Johannesburg, four of which have not previously been detected in South Africa, and one in Cape Town. Across Johannesburg we identified a Leptospira spp. infection prevalence of 44% (75/171) and noted significant differences in the prevalence between administrative regions within the metropole. Multi-locus sequence analyses identified a clonal genotype consistent with L. borgpetersenii serogroup Javanica (serovar Ceylonica).Discussion The prevalence of infection identified in this study is amongst the highest detected in Rattus spp. in similar contexts across Africa. Despite the complex invasion history suggested by the heterogeneity in R. norvegicus haplotypes identified in Johannesburg, a single L. borgpetersenii genotype was identified in all infected rodents. The lack of L. interrogans in a rodent community dominated by R. norvegicus is notable given the widely recognised host-pathogen association between these species and evidence for L. interrogans infection in R. norvegicus in Cape Town. It is likely that environmental conditions (cold, dry winters) in Johannesburg may limit the transmission of L. interrogans. Spatial heterogeneity in prevalence suggest that local factors, such as land use, influence disease risk in the metropole. Conclusion In South Africa, as in other African countries, leptospirosis is likely underdiagnosed. The high prevalence of infection in urban rodents in Johannesburg suggest that further work is urgently needed to understand the potential public health risk posed by this neglected zoonotic pathogen.

Representatives of 13 African countries attended the first such conference in Cape Town, South Africa on 1–3 October, 1996. These were Botswana, Kenya, Lesotho, Malawi, Mauritius, Namibia, South Africa, Swaziland, Tanzania, Uganda, Zambia and Zimbabwe. Representatives of several members of the Financial Action Task Force (FATF) were also present, namely Canada, France, Italy, Portugal, United Kingdom and United States.

Sexual violence is conceptualised as a hate or bias-motivated crime, and is recognised as a social problem of global proportion. However, the platform for this paper focuses on incidents of rape in South Africa, a country where the most progressive legislation concerning sexual minorities is enforced, including gender non-conforming people namely Lesbian, Gay, Bisexual, Trans and Intersex (LGBTI). South Africa still must address rape inflicted on black lesbians residing in Cape Town townships, despite gender equality being granted in on the basis of sexual orientation (Silvio, 2011). The same applies to same sex marriages, making South Africa the role model of other African countries yet to be included in the signatory to the 2008 United Nations Human Rights Council Resolution on Sexual Orientation and Gender Identity. An alternative concept to categorising rape as a hate crime might be a more effective tool in the legislation to combat rape based on sexual orientation; justice will be served as a female homosexual enjoys equal citizenship as that of a heterosexual citizen. Preliminary findings show that some rape victims became mothers as a result of the rape. Rape victims discuss conception due to corrective rape and how this affects the mother-child relationship. Feedback from victims include coping mechanisms from religious beliefs to alcohol abuse. None of the rape-survivors interviewed in this study contracted HIV/AIDS as a consequence of the rape.
