This article argues that Israel substituted the Palestinian refugees' internationally recognized right of return with a family reunification program during its maneuvering over admission at the United Nations following the creation of the state in May 1948. Israel was granted UN membership in 1949 on the understanding that it would have to comply with legal international requirements to ensure the return of a substantial number of the 750,000 Palestinians dispossessed in the process of establishing the Zionist state, as well as citizenship there as a successor state. However, once the coveted UN membership had been obtained, and armistice agreements signed with neighboring countries, Israel parlayed this commitment into the much vaguer family reunification program, which it proceeded to apply with Kafkaesque absurdity over the next fifty years. As a result, Palestinians made refugees first in 1948, and later in 1967, continue to be deprived of their legally recognized right to return to their homes and their homeland, and the family reunification program remains the unfulfilled promise of the early years of Israeli statehood.

Good faith has been defined as justice, fairness, reasonableness, decency, taking no chances, and so on. The concept of good faith has long been rooted in contract law under the jurisdiction of Civil law, although the definition of it is still debated until today. However, the view of the Common Law tradition does not recognize the concept of good faith as long as the contract is entered into with the freedom of contract and both parties abide by the terms of the contract. Given that a franchise contract involves a long-term contract and always been developed, it is impossible to define both rights and responsibilities base on express terms only. As such, the franchise contract gives the franchisor the right to exercise its discretion in executing the contract. It is in this context that the element of good faith is very important to ensure that the franchisor does not take advantage of the franchisee and that the business continues to prosper. Therefore, the objective of this article is to discuss the concept of good faith in a franchise contract. The findings show that the common law system that initially rejected the application of the concept of good faith also changed its approach and began to recognize the concept of good faith as it is very important for relational contracts such as franchise contracts.

The English legal system is based on the common law. The common law system in England and Wales developed from the decisions of judges whose rulings over the centuries have created precedents for other courts to follow and these decisions were based on the ‘custom and practice of the Realm’. The system of binding precedent means that any decision of the Supreme Court—the new name for the former House of Lords (the highest court in the UK)—will bind all the lower courts, unless the lower courts are able to distinguish the facts of the current case and argue that the previous binding decision cannot apply, because of differences in the facts of the two cases. However, since the UK joined the European Union (EU), the decisions of the European Court of Justice (ECJ) now supersede any decisions of the domestic courts and require the English national courts to follow its decisions. (Scotland has a system based on Dutch Roman law, and some procedural differences although no fundamental differences in relation to employment law.) The Human Rights Act 1998 became law in England and Wales in 2000 (and in Scotland in 1998) in order to incorporate the provisions of the European Convention on Human Rights into UK law. The two most important Articles applicable to employment law are Article 8(1), the right to respect for privacy, family life, and correspondence, and Article 6, the right to a fair trial.

Muslims believe that shari’a is God’s law or a divinely revealed law. In Islamic tradition shari’a covers the physical, intellectual, and spiritual needs of human life and comprises a composite of rules of conduct and forms a source of complete guidance towards the right path – siraat al mustaqeem – for the entire humanity. Islam as a complete way of life demands its adherents to follow and carry out the injunctions of the shari’a in all aspects of life. However, Muslims in Australia are a part of a modern secular nation-state which operates under common law system and its constitution demands a separation of church and state. It is in this context this paper sociologically examines the understanding and application of shari’a in Muslim everyday living. It posits that despite the secular nature of Australian state, Muslims are able to implement shari’a in their everyday-living as it is an essential source of guidance for them and forms the basis of being a “good” Muslim. Muslims don’t demand the constitutionalization of shari’a but a wider recognition of it in Australia as it continues to be important and the foundation of their religion, their mode of existence, and ethico-moral structure.

Este artículo propone un análisis sistemático de la posición de las sentencias del Tribunal de Justicia en el sistema constitucional de fuentes. El análisis parte de dos premisas: la primera es la de que los órdenes normativos supranacional y estatal tienen autonomía formal, pero no material; la segunda es que la integración del Derecho de la Unión en el ordenamiento estatal no puede explicarse sin la jurisprudencia del Tribunal de Justicia. Se describen los efectos de las sentencias del juez europeo en el orden supranacional, para luego ver cómo se transfieren al sistema de fuentes estatal, teniendo en cuenta la función integradora de la Constitución tanto en el plano interior como en el exterior.This article is a review of the different kind of rulings made by the European Court of Justice, in order to find their function and position in the Spanish Law system. The analysis is made under two assumptions: the first one about the formal autonomy but material dependency between EU and Spanish law systems; the second one is that the European Court of Justice case law rules over the interaction between both systems. Formal and substantive effects of ECJ rulings over both systems are described and analysed, considering the integrating role of the Spanish Constitution.
