Harm and Helmets: How Harmful Social Costs Fail to Justify Paternalistic Health and Safety Regulations

Mill’s harm principle and the financial externalities of risky behavior are routinely invoked to justify health and safety regulation. However, this approach fares poorly when subjected to theoretical scrutiny. First, it is false: individuals engaging in risky behavior do not harm others. Second, even if risky behavior were harmful to others, the argument from harmful externalities does not imply safety-enhancing policy interventions, at least not without additional appeals to paternalism. Third, focusing on the economic impacts of accidents invites perverse victim-blaming attitudes toward accident victims that undermine democratic values and justice. To improve our moral understanding of health and safety regulation, I sketch a theory of public policy justification grounded in the controversies which attract our attention to paternalistic polices in the first place. On this account, justificatory arguments are plausible if they identify goods that individuals genuinely affirm on their own terms, are sensitive to causal responsibility and imbalances between restraint and protection, and comparatively engage with possible policy alternatives. Illustrating the shortcomings of one dominant approach to public policy justification and reorienting us toward the controversies that policy justifications need to confront reflect two ways that political theory can help enhance justice in public policy design and articulation.

Policy design is a type of policy formulation activity centred on knowledge application in the creation of policy alternatives. Expected to attain public sector goals and government ambitions in an effective fashion, it can be undertaken many different ways. The current literature on policy design features an ongoing debate between adherents of traditional approaches to the subject in the policy sciences and those importing into policymaking the insights of design practices in other fields such as industrial engineering and product development: ‘design-thinking’. Issues examined in more traditional approaches to policy design are very wide-ranging and address a wide variety of formulation modalities and their strengths and weaknesses. Efforts to promote ‘design-thinking’ in the public policy realm, on the other hand, focus on policy innovation and rarely deal with issues such as the barriers to implementation, political feasibility or the constraints under which decision-making takes place. This article discusses these differences and argues adherents of design-thinking need to expand their reach and consider not only the circumstances facilitating the generation of novel ideas but also the lessons of more traditional approaches concerning the political and other challenges faced in policy formulation and implementation.

The persistence of racial inequality in the United States raises deep and complex questions of racial justice. Some observers argue that public policy must be “color-blind,” while others argue that policies that take race into account should be defended on grounds of diversity or integration. This chapter begins to sketch an alternative to both of these, one that supports strong efforts to address racial inequality but that focuses on the conditions necessary for the liberty and equality of all. It argues that while race is a social construction, it remains deeply embedded in American society. A conception of racial justice is needed, one that is grounded on the premises provided by liberal political theory.

The British Pressure Gauge Manufacturers Association has always emphasised the need for strict observance of recognised safety requirements when using pressure gauges. Unfortunately, gauges are both available and used that do not meet the rigid safety regulations laid down in British Standard 1780 and this could lead to serious accidents. The provisions of the Health and Safety at Work Act coupled with the strengthened proposals for Product Liability will place a greater statutory responsibility upon the manufacturer and user alike. This chapter introduces the field of animal studies as an interdisciplinary scholarly endeavor to understand the relationship humans have with other animals. That relationship is mapped into five major categories, reflected in the titles of each of the handbook’s five parts: “Animals in the Landscape of Law, Politics and Public Policy”; “Animal Intentionality, Agency, and Reflexive Thinking”; “Animals as Objects in Science, Food, Spectacle and Sport”; “Animals in Cultural Representations”; and “Animals in Ecosystems.” The chapters in each part are summarized and key issues in the “animal question” are explicated. Chapter topics include animals in research, entertainment, law, political theory, public policy, agency, tourism and ecology. Concluding remarks include an appeal for altruistic coexistence for all beings in the earth’s ecosystem.
