The National Heritage Act 2005 is the only Act enacted in Malaysia to date to protect the national heritage including intangible cultural heritage. In the field of heritage study, intangible cultural heritage becomes a priority in the context of a 'non-existent' heritage enjoyed through the human senses. However, the Act provides a rather limited definition of intangible cultural heritage due to ambiguity in certain terminologies of its definition and scope. Hence, by using the provisions of the UNESCO Convention 2003 as the basis of discussion, this article analyses the legal provisions which protect intangible cultural heritage in Malaysia for the country in fulfilling its responsibilities as a Member Country of the Convention. This article finds that improvements to the definition of intangible cultural heritage need to be made by expanding the scope of the provision to include relevant intangible cultural heritage elements such as food and fine arts heritage.

Abstract:The 2003 Convention for the Safeguarding of Intangible Cultural Heritage (CSICH) was not intended to have legal repercussions in international trade. Nevertheless, intangible cultural heritage (ICH) may interact with trade regulation under various scenarios. The CSICH “Representative List” inscribes numerous ICH elements with real and potential international commercial aspects and consequent trade law implications. These emergent trade law–ICH regime dynamics require not only some critical reflection (for example, is safeguarding of ICH ultimately dependent on commodification or, at least in some cases, significantly prone to commercial capture?) but also doctrinal legal analysis. This article undertakes a survey of many plausible ICH–trade interactions (generally excluding intellectual property issues), providing an analytical framework with reference to a series of case sketches of selected CSICH inscriptions such as kimjang, beer culture in Belgium, and yoga. These and other cases may indeed raise issues under world trade law, including the General Agreement on Tariffs and Trade, the General Agreement on Trade in Services, the Agreement on Technical Barriers to Trade, the Agreement on Sanitary and Phytosanitary Measures, and subsidies regulation. Trade law may have underestimated the significance of ICH as a growing field. At the same time, ICH law may be developing without thinking through how it is impacted by commercial interests and international trade law.

Makyung is one of the many traditional performances from the Malaysian region that has shaped the Malay national cultural identity. It has been recognized as one of the Masterpieces of the Oral and Intangibles of Humanity in 2001 as well as part of intangible cultural heritage having significant cultural values propounded by the UNESCO International Convention for the Safeguarding of Intangible Cultural Heritage of 2003 (ICH Convention). However, the State of Kelantan had enacted the Entertainment Control and Places of Entertainment Enactment (1998) (KECE 1998) that clearly prohibits any entertainment containing prohibited elements according to Islamic principles. Currently, the performance of makyung was allowed with certain modifications but recently, there is an intention by the state government of Kelantan to prohibit Makyung totally. It is to be noted that there are overlapping powers between the Federal and the State jurisdictions with regard to the safeguarding of makyung. At federal level, the National Heritage Act 2005 (the NHA) is the existing law in Malaysia for the safeguarding of intangible cultural heritage inspired by the establishment of the ICH Convention. However, the NHA is a general law that is inadequate at giving comprehensive protection to makyung since heritage matter falls under the Concurrent List of the Ninth Schedule of the Federal Constitution where the State also has the legislative power to make law with regard to the same. In order to address this conflict, there is a need to examine the provisions in the Federal Constitutions, the NHA, KECE 1998 and evaluate to what extent these laws safeguard the performance of makyung. This study examines the conflicts in powers between both Federal and the State Legislations which powers are guaranteed by the Constitution. This study uses the qualitative research method, where a doctrinal research is conducted. This paper contends that, both powers must come to a compromise and meet halfway for the preservation of the heritage.

Author through deeply analysing the context and situation of developing a model linking sustainable tourism with preserving and promoting the specific tangible and intangible cultural heritage values of Quang Ninh province in the previous period thereby proposing a system of appropriate solutions to develop models of cultural tourism, heritage tourism, rural tourism, community tourism...in close association with specific values conservation and promotion of tangible and intangible cultural heritage, livelihood development and sustainable multidimensional poverty reduction for ethnic minorities groups in the current Industry Revolution 4.0 trend.

Scholarship negotiating African folktales and the entire folkloric tradition in Africa has always been constituted as harbouring fundamental lacks. One of these lacks is the supposed incapacity of oral cultures to produce high literature. However, it is true that folktales and other oral forms in Africa can participate actively in the social, political and cultural process. In this paper, we engage folktales told by the Tiv of central Nigeria and situate them within the dynamic of history, culture, modernity and national construction in Nigeria. The paper adopts a historicist and culturalist perspective in its interpretation of the folktales which were collected in particular Tiv communities. This methodological approach helps to crystallize the historical and cultural lineaments embedded in the people’s experiences, values and worldviews. It also constitutes a contextual background for the understanding of the folktales as they offer informed commentaries on social currents and political contingencies in Nigeria. It argues that though folktales belong to a pre-scientific and pre-industrial dispensation, they are part of the people’s intangible cultural heritage and are capable of distilling powerful statements which negotiate Nigerian modernity and postcolonial condition. The paper underscores the dynamism and functionality of folktales even in an increasingly globalised ethos.

У рамках імплементації Конвенції про охорону нематеріальної культурної спадщини вивчено заходи культурної політики, що заклали основи для втілення новітніх політичних підходів, механізмів і програм. У контексті виконання міжнародно-правових стандартів UNESCO та положень Конвенції визначено курс на аналіз, збереження й розвиток культурного розмаїття та надбання. Умотивована необхідність формування стратегії культурної політики у галузі збереження нематеріальної культурної спадщини, що полягає у проектуванні й затвердженні культурних проектів національного й регіонального спрямування. Враховано наявну ускладнену ситуацію щодо ролі місцевої влади та обмеженість бюджетного фінансування в країні загалом. Встановлено, що дії, що сприятимуть виявленню елементів нематеріальної культурної спадщини, організації та реалізації заходів щодо її збереження в Україні повинні стати цільовими пріоритетами. Cultural policy measures within the framework of the implementation of the Convention for the Safeguarding of the Intangible Cultural Heritage are examined. A course on the analysis, conservation and development of cultural diversity and heritage in the context of the implementation of UNESCO international legal standards and the provisions of the Convention has been determined. The necessity of developing a strategy of cultural policy formation in the field of preservation of the intangible cultural heritage, which consists in the design and approval of cultural projects of national and regional orientation, is substantiated. The complicated situation regarding the role of local authorities and the limited budget financing in the country are taken into account. It is established that the priority should be given to actions that will help identify elements of the intangible cultural heritage, develop and implement measures for its preservation in Ukraine.
