The study addresses the issues of exclusion from the supplementary part of the Polish pension system. The main goals of the research are: 1) characterising retirement exclusion as a specific type of financial exclusion, and 2) identifying and assessing key determinants of retirement exclusion in the supplementary part of the Polish pension system. The article is epistemological and classifying in nature. In the review part, the research methods used are based on a critical analysis of the literature and a synthesis of its conclusions. The main part is based on a meta-analysis of the results of surveys regarding pension awareness and propensity to save, elements of the economic analysis of law, and analysis of existing data. The presented considerations lead to the formulation of arguments, that justify the thesis that the scale and extent of retirement exclusion in the supplementary part of the Polish pension system are a derivative of factors included in four meta-categories: 1. low pension awareness, 2. low saving potential, 3. low propensity to save, and 4. limited availability of pension products.

<p>Responsible borrowing means a thorough reflection on the need to become indebted, full transfer of true information affecting creditworthiness, comprehensive analysis of the credit agreement, and refraining from avoiding the repayment of loan obligations. The main purpose of the article is to verify the hypothesis that Polish legislators make only the lenders fully responsible for excessive borrowing on the consumer loan market. The following research methods were used: critical analysis of the subject literature and economic analysis of the respective legal provisions. On the basis of the analyses conducted, areas were identified in which the legislator should use the appropriate legal instruments stimulating responsible borrowing. Among them the following were listed: the consumer's obligation to prove the absence of overdue payments and the consumer’s notification of becoming acquainted with the terms of the loan agreement.</p>

Temporary Total Prohibition of Open-end Pension Fund Advertising The paper discusses the effects of temporary total prohibition of Open-end Pension Fund advertising. This prohibitive regulation was in force in the years 2014–2015 and has raised many controversies, and ultimately became the subject of the Constitutional Court summons. The main thesis of the article is that temporary total prohibition of Open-end Pension Fund advertising has contributed to a decrease in the amount of contributions paid to Open-end Pension Funds and started the process of gradual and informal phasing-out of funded part of pension system in Poland. The scientific method used in this paper is economic analysis of law.

In the past few decades, economic analysis of law has been challenged by a growing body of experimental and empirical studies that attest to prevalent and systematic deviations from the assumptions of economic rationality. While the findings on bounded rationality and heuristics and biases were initially perceived as antithetical to standard economic and legal-economic analysis, over time they have been largely integrated into mainstream economic analysis, including economic analysis of law. Moreover, the impact of behavioral insights has long since transcended purely economic analysis of law: in recent years, the behavioral movement has become one of the most influential developments in legal scholarship in general. Behavioral Law and Economics offers a state-of-the-art overview of the field. The book surveys the entire body of psychological research underpinning behavioral analysis of law, and critically evaluates the core methodological questions of this area of research. The book then discusses the fundamental normative questions stemming from the psychological findings on bounded rationality, and explores their implications for establishing the aims of legislation, and the means of attaining them. This is followed by a systematic and critical examination of the contributions of behavioral studies to all major fields of law—property, contracts, consumer protection, torts, corporate, securities regulation, antitrust, administrative, constitutional, international, criminal, and evidence law—as well as to the behavior of key players in the legal arena: litigants and judicial decision-makers.
