RESUMO O trabalho faz um retrocesso no histórico da atuação do Supremo Tribunal Federal com a finalidade de acompanhar julgados influenciados por normas celebradas em Tratados e Convenções Internacionais durante o processo de codificação do Direito Internacional. A proposta sonda a hipótese de relação do processo de Humanização do Direito Internacional com as alterações da hierarquia das normas previstas em Tratados e Convenções Internacionais dentro do ordenamento jurídico brasileiro. Fica, bastante, claro que as oscilações verificáveis na atuação do Supremo Tribunal Federal quanto à hierarquia das normas internacionais deixaram de ter valor comum de legislações ordinárias para status especiais de supralegalidade e, até, de emendas constitucionais. Tratando-se, ao final, justamente, das influências do fenômeno da Humanização do Direito Internacional no processo de hierarquização das normas internacionais no ordenamento jurídico brasileiro quando, especificamente, versassem por direitos humanos. Palavras-chave: Hierarquia das Normas Internacionais. Direitos Humanos ABSTRACTThe work makes a step back in the history of the action of the Federal Supreme Court in order to accompany those judged to be influenced by norms established in International Treaties and Conventions during the codification process of International Law. The proposal examines the hypothesis of a relationship between the process of Humanization of International Law and the changes in the hierarchy of norms foreseen in International Treaties and Conventions within the Brazilian legal system. It is quite clear that the verifiable oscillations in the Federal Supreme Court's performance regarding the hierarchy of international norms have no longer common value of ordinary legislation for special statuses of supralegality and even constitutional amendments. In the end, it is precisely because of the influence of the phenomenon of the Humanization of International Law in the process of hierarchizing international norms in the Brazilian legal system when they specifically deal with human rights.Keywords: Hierarchy of International Legal Norms. AbstractIn this article, the author discusses the problem of ensuring equality and non-discrimination in a legal system. Equality and non-discrimination constitute universally recognized standards in the protection of human rights. At the same time, one can hardly assert that the universal community has put an end to discrimination. The author considers the problem as applied to the Russian legal system. The standard is incorporated in the Russian Constitution still remains topical in Russia. Based on his analysis of legislation and judicial practice, the author concludes that the problem reveals itself on the levels of both law-making and law application, the latter including administration of justice. As one of the conclusion, the author raises a question: is legal discrimination inherent in a legal system like other negative phenomena, such as delinquency, incoherencies, lacunas, defects, conflicts of legal norms and breaches of law-making procedural rules?

AbstractAs part of the disintegration of the Soviet Union in 1991, the Azerbaijan Republic ended its protracted existence as one of the fifteen members of the Soviet Union and became an independent state. As a result, on 30 August 1991, she became a full subject of international law. Currently, Azerbaijan is a party to a number of international treaties, virtually all major human rights treaties registered with the UN Secretary-General, the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as a number of related Council of Europe human rights agreements.A tendency towards internationalization and a general 'opening' to international law can also be seen in the Azeri Constitution, which was adopted by public referendum on 12 November 1995. Like many other former Soviet Republics, Azerbaijan, in its 1995 Constitution, has rejected the traditional Soviet dualist approach of the implementation of international law in the domestic legal system and has established a monist system within the context of a relationship between national and international law. This article discusses these changes in the Azeri attitude towards international law, in particular the status of international treaties, with special reference to those problems stemming from the implementation of international treaties in the domestic legal system of Azerbaijan.

This addition to the Elements of International Law series explores the role of international law as an integral part of the Russian legal system, with particular reference to the role of international treaties and of generally-recognized principles and norms of international law. Following a discussion of the historical place of treaties in Russian legal history and the sources of the Russian law of treaties, the book strikes new ground in exploring contemporary treaty-making in the Russian Federation by drawing upon sources not believed to have been previously used in Russian or western doctrinal writings. Special attention is devoted to investment protection treaties. The importance of publishing treaties as a condition of their application by Russian courts is explored. For the first time a detailed account is given of the constitutional history of treaty ratification in Russia, the outcome being that present constitutional practice is inconsistent with the drafting history of the relevant constitutional provisions. The volume gives attention to the role of the Russian Supreme Court in developing treaty practice through the issuance of "guiding documents" binding on lower courts, the reaction of the Russian Constitutional Court to judgments of the European Court of Human Rights, and the place of treaties as an integral part of the Russian legal system. Butler further explores the hierarchy of sources of law, together with other facets of Russian arbitral and judicial practice with respect to treaties and other sources of international law. He concludes with a consideration of the 'generally-recognized principles and norms of international law' and their role as part of the Russian system.

Unrecognized states are formations separated themselves from another state and had declared itself a new self-standing state. The inner structure of the formation does not differ from the structure of other states in that it possesses a constitution, legal system and state bodies. But such a formation is not recognized by the international community in the capacity of a subject of international law or is recognized by a minor number of states.Unrecognized states do not have interstate treaties with UN members, yet this does not mean that no international obligations are obligatory for them. General principles of international law and peremptory norms are obligatory notwithstanding recognition. Moreover, unrecognized state sometimes accept voluntarily international obligations of some treaties, still they are not recognized as parties thereof. The status of unrecognized states differ from the status of other actors not states in international relations: sometimes intrastate or even non-governmental organizations, e.g. European union, are accepted as parties to international treaties. Unrecognized states can never become parties to international treaties. Thus a situation of irresponsibility is created, when an unrecognized state has no partners who could question a responsibility in case of a breach of international law; neither the jurisdiction of treaty bodies created to monitor implementation of the treaty obligations.Transdnistrian Moldavian Republic is a good illustration here. Its Constitution contains a rule that the generally recognized principles and norms of international law and international treaties are a part of its legal system. The Republic does not have interstate treaties, but accepted some normative acts on the recognition of the most important human rights treaties. This is in fact a joining of the Republic to the treaties. Yet the Republic is not a party to them because the Vienna Convention on the law of international treaties 1969 allows only the subjects of international law to conclude international treaties which unrecognized Transdnistria is not. Thus the situation is created where the international community cannot submit a claim of failure to fulfill a treaty to Transdnistria.We submit that this is not so with generally recognized norms and principles because an obligation is emerging in the contemporary international law that all actors of international intercourse must fulfill those principles and norms. The events around the indictment of the former President of the Republic are a good example of breach of international law. The Republic broke the European Convention on human rights which diminished the acceptance of international law by the Republic.

The paper investigates the implementation of the norms of international humanitarian and human rights law in the Russian courts. It may be viewed as a specific feature that these two categories are considered close in part of the Russian doctrine and, as we will see below, in some judicial cases. Since the adoption of the Constitution of the Russian Federation in 1993 international law has been granted a specific status and significance in the Russian legal system. According to the Constitution and legislation, Russian courts have had the opportunity to play a special role in the implementation of international humanitarian and human rights law. That being said, judicial practice relating to the implementation and the application of these norms is different from that of other international law norms. It is, however, explained, in particular, by the fact, that there are not many cases which either mention directly or use humanitarian law. Often, courts make abstract or general references to international treaties or make decisions only on the basis of the national law, though the considered cases fall directly under the regulation of international humanitarian or human rights law. In conclusion, at present the practice of Russian courts is rather diverse and needs further unification.

The article examines the content of the amendments adopted to the Constitution of the Russian Federation in terms of the relationship between the provisions of international treaties and constitutional norms. Based on the use of a retrospective research method, it is noted that the position reflected in the constitutional amendments is largely the result of the activities of national authorities on the consistent implementation of the provisions of the European Convention on Human Rights into the national legal system, built on the basis of a dialogue with the bodies of the Council of Europe. Such interaction has been established and has been actively developing since the entry of the Russian Federation into this international organization. Over the past few years, this cooperation has developed in the context of the exercise by the Constitutional Court of the authority to resolve the issue of the possibility of executing the decisions of the ECHR. The key aspects of a theoretical nature that contributed to the formation of a position regarding the conditions for the implementation of decisions of interstate bodies on the protection of human rights and freedoms in the Russian legal system are studied step by step. The key importance of the aspect of conventionally constitutional conflicts of interpretation, which is reflected in the amendments to the Constitution, is noted.

AbstractThe approach of Indian courts towards international law has been consistently evolving. Initially, the Indian constitutional framework provided a flexible basis for the application and use of international law, the reasons for which could be seen in the socio-political context of India as a developing country. India, for its part, continued to argue that it remained essentially at the periphery of the mainstream international law, as it had no role in formulating some of the basic principles of international law. For the Indian courts the first substantive encounter with international law emerges in the context of several territorial-related issues. The socio-political context forms the next phase, for the Indian courts to have recourse to diverse international legal norms relating to the environment and human rights and applying them as a persuasive tool. Later, the development context brings a complex array of commercial, environmental, and other related international legal norms into the Indian legal system. For Indian courts, in the present context, the correct sourcing and identification of international legal norms and their application remain a huge challenge. The majority of the legal systems of developing countries for varied historical reasons continue to treat international law as an exotic legal tool to be used sparingly, perhaps only to broaden the interpretation of or sustain a comparable domestic legal norm.

In the last six decades, one of the most striking developments in international law is the emergence of a massive body of legal norms and procedures aimed at protecting human rights. In many countries, though, there is little relationship between international law and the actual protection of human rights on the ground. This book takes a fresh look at why it's been so hard for international law to have much impact in parts of the world where human rights are most at risk. The book argues that more progress is possible if human rights promoters work strategically with the group of states that have dedicated resources to human rights protection. These human rights “stewards” can focus their resources on places where the tangible benefits to human rights are greatest. Success will require setting priorities as well as engaging local stakeholders such as nongovernmental organizations and national human rights institutions. To date, promoters of international human rights law have relied too heavily on setting universal goals and procedures and not enough on assessing what actually works and setting priorities. This book illustrates how, with a different strategy, human rights stewards can make international law more effective and also safeguard human rights for more of the world population.

This chapter examines the complicated history of Zainichi, Korean residents in Japan, who came to Japan during the colonial era. After 1945, Zainichi lost all citizenship rights and had to fight for many rights, but the division in the Korean peninsula cast a shadow over Zainichi communities, hampering effective activism for more rights in Japan. Focusing on the issue of fingerprinting—the most salient example of rights violations against Zainichi—the chapter demonstrates how, since the late 1970s, global human rights principles have enabled Zainichi to recast their movement as claims for universal rights regardless of citizenship and to use international forums to pressure the Japanese government, leading to the abolition of the fingerprinting practice. Zainichi achieved similar successes in other areas of rights except for political rights, where international norms do not clearly support suffrage for noncitizens. Zainichi also contributed to global human rights by advancing rights for noncitizen minorities.
