Emerging Legal Challenges in Offshore Outsourcing of IT-Enabled Services

The practice of information systems/information technology (IS/IT) outsourcing is a major issue which has received much attention, as shown by the extensive literature on the topic. However, most works on outsourcing have focused on theoretical topics, and there are but a few empirical, quantitative studies. This chapter presents an empirical study of IS/IT outsourcing in Spain, which has been conducted along the lines of prior research carried out in different countries, and which focuses on the types, functions and targets of outsourcing contracts. We also attempt to examine the influence that this practice may have on the organizations’ management structure. A survey carried out on 530 Spanish firms has shown that 50% of Spanish large firms have outsourced part of their IS/IT, whereas outsourcing is practiced by 20% of medium-sized enterprises. Finally, it has been observed that the most frequently outsourced activities in Spain are hosting and Internet-related services.

Offshore information technology (IT) outsourcing has been becoming mainstream alternative to inhouse operations. While offshore development is a relatively new trend in IT, the concept of outsourcing manufacturing and service operations has been going on for more than 50 years. Many Asian countries are driving their economic success through taking offshore projects from developed countries. These countries have advantages of low-cost and available labor force. Various studies conducted over the last 10 years have shown that outsourcing allows firms to reduce high overhead costs, improve productivity, contribute flexibility, and thus improve overall performance of the firm. However, offshore IT outsourcing brings new challenges and risks. The skeptics believe that outsourcing may weaken the local business competitiveness of the region, investors’ confidence in investing in local businesses, and may create a spiral effect on economic indicators such as: unemployment, enrollment in schools, living styles, housing, and construction, and so forth`. This study investigates the socio-economic impacts of offshore IT outsourcing in the United States using a system dynamics model.

According to Gartner (2004b), IT infrastructure consolidation and standardization characterized the largest multibillion IT outsourcing contracts during 2003 and 2004 and are expected to continue for the next several years. These contracts are not just exercises in cost reduction necessitated by economic doldrums, but they are also intended to advance clients toward becoming enterprises that are more efficient. The foundation of an IT portfolio is the firm’s information technology infrastructure. This internal IT infrastructure is composed of four elements as was illustrated in Figure 2.3. The presentation of Weill and Vitale’s (2002) work on infrastructure services indicated the number and complexity of services that constitute the IT infrastructure in an organization to enable electronic business. Successfully implementing e-business initiatives depends on having the necessary IT infrastructure in place. E-business initiatives can be decomposed into their underlying atomic e-business models, which can have quite different IT infrastructure requirements.

In this study, the authors makes an attempt to understand the aspirations of the new generation employees in tour operation business and allied areas. It is being attempted with the presumption that the takeover of information technology seeded the concept of micro enterprises in tourism which functions with the business model of low investment and good turnover. The focus was in identifying employee specific factors of encouraging and discouraging in nature in the fast growing tourism sector, especially job attrition and the dynamics of human resource management practices. Factor Analysis, independent sample t-test, multiple regression have been used to establish various relationships. The findings of the study are considered to be relevant since it quantitatively establish the dynamics of employment in tourism in India.
