Reflections on euro area banking supervision: context, transparency and culture from an institutional law perspective

This technical note1 includes a targeted review of banking regulation and supervision, with a particular focus on topics related to the supervision of less significant institutions (LSIs). The review was based on the international standards for banking supervision—the Basel Committee on Banking Supervision’s (BCBS) Core Principles for Effective Banking Supervision (BCP)—but did not conduct a compliance assessment. The mission considered the findings and recommendations of the 2018 euro area (EA) FSAP2 and the authorities’ BCP self-assessment, followed-up on recommendations of the 2013 Austria FSAP, and reviewed implementation of BCBS standards and guidance issued in the interim. Although the review was based on implemented legislation and regulation, the mission reviewed proposed draft legislation consolidating financial system supervision in the Financial Market Authority (FMA).

The region as a whole is lagging behind the recovery of others in the world. The future shows a shift in global economic power, away from the established advanced economies, especially from those in Europe, towards emerging ones in Asia and elsewhere. Compared to earlier years, risks related to euro area economic conditions have increased. This influences the function and effectiveness of the banking sector as well. The global outlook has deteriorated. The top three prominent risks expected to affect the euro area banking system over the next years are: (1) economic, political, and debt sustainability challenges in the euro area, (2) business model sustainability, and (3) cybercrime and IT deficiencies. The study discusses these factors with special emphasis on banking supervision. It analyses EU bank regulation after the financial crisis and its prospects.

Subject. The article addresses problems and prospects for the banking supervision development in the Russian Federation under modern conditions. Objectives. We review the essence and methods of organization of the banking supervision, and identify the main problems and prospects for its development. Methods. To provide valid, reliable and reasoned recommendations, we apply normative and integrated approaches to the study of the banking supervision effectiveness in the current circumstances. Results. The paper investigates main problems and development prospects for the Russian banking supervision. The essential importance of supervision comes from the main role of the banking system in maintaining accounts of economic entities and making settlements. Even minor failures or delays in operations can lead to negative outcomes and disastrous consequences for the entire monetary system and the national economy. Therefore, we highlight issues that require attention, and make proposals for further development of the banking supervision. Conclusions. In the context of dynamically developing economy, the banking practice is becoming more complex. As a result, there is a need for new financial instruments that can reduce risks, increase the speed and efficiency of operations and document flow, and help achieve the world levels of introduced standards.
