Designs are considered as one of the imperative aspects of a business. Design rights as a branch of Intellectual property rights plays a crucial role in protecting unique designs from infringement. In this regard, design rights have become increasingly important for designers and businesses all over the globe. Primarily, this article provides an overview of design law and registration process in Australia with an emphasis on Start-ups and SMEs. Secondly, this article provides insights on design registration trends of Start-ups and SMEs in Australia. Thirdly, the study provides the importance of designs as an intellectual property for Start-ups and SMEs. Further, the study sheds some light on how registered designs can be used as collaterals.

AbstractThe creative industry as one of the pillars of the future economy has a very strategic role in overcoming the problems faced by the community along with the government, especially in the field of employment, business fields, and as a source of state revenue (GDP). Therefore, creative industry entrepreneurs must be protected by their intellectual rights so that all copyrighted works are legally protected by their existence and not arbitrarily anyone can steal, trade, multiply without the permission of the owner. However apparently only 17% of the 16.7 million creative industry players registered the results of their creativity. This shows that the protection of Intellectual Property Rights towards the creative industry is still very weak due to several factors, namely; Lack of public awareness / creative industry players to register their creativity businesses; Lack / lack of understanding of the community / industry players regarding the protection of Intellectual Property Rights (IPR); The presumption of some people / creative industry players for the management of registration of Intellectual Property Rights requires quite a large fee; The registration process takes a long time and is complicated. AbstrakIndustri kreatif sebagai salah satu pilar ekonomi masa depan memiliki peran yang sangat strategis dalam mengatasi masalah-masalah yang dihadapi oleh masyarakat bersama pemerintah, terutama di bidang ketenagakerjaan, bidang usaha, dan sebagai sumber penerimaan negara (PDB) . Oleh karena itu, pengusaha industri kreatif harus dilindungi oleh hak intelektual mereka sehingga semua karya cipta dilindungi secara hukum oleh keberadaan mereka dan tidak sewenang-wenang siapa pun dapat mencuri, berdagang, berkembang biak tanpa izin dari pemiliknya. Namun ternyata hanya 17% dari 16,7 juta pelaku industri kreatif yang mendaftarkan hasil kreativitas mereka. Ini menunjukkan bahwa perlindungan Hak Kekayaan Intelektual terhadap industri kreatif masih sangat lemah karena beberapa faktor, yaitu; Kurangnya kesadaran publik / pelaku industri kreatif untuk mendaftarkan bisnis kreativitas mereka; Kurangnya / kurangnya pemahaman tentang komunitas / pemain industri mengenai perlindungan Hak Kekayaan Intelektual (HKI); Anggapan sebagian orang / pelaku industri kreatif untuk pengelolaan pendaftaran Hak Kekayaan Intelektual membutuhkan biaya yang cukup besar; Proses pendaftaran memakan waktu lama dan rumit.

Agenda Intellectual Property Rights in particular the actual industrial designs among other things how the autonomous regional government can develop the potential of intellectual property rights owned by the community. Various potential intellectual property rights in the form of knowledge, skills and wisdom of local characteristics such as shellfish Craft Pearls can be protected and utilized for the greater good of society and regions. One potential intellectual property rights in the city of Ambon is the pearl handicraft products, therefore diligence pearl mussels need IPR protection and utilization of industrial design, especially for the greater public interest, especially Maluku Ambon City. Protection of industrial designs pearl handicraft products of the designers have not registered industrial design rights because many of those who do not know the first to file registration system adopted Industrial Design Law No. 31 of 2000, so that n Trademark Copyright protection of intellectual property as an alternative to Craft Shells Of Pearls .

A designer has a copyright on the results of his creativity in the form of a blueprint and has the exclusive right to make the artwork into three or two dimensions. The industrial design law is directed at protecting mass-produced goods. People prefer protection with the right to industrial design, which is only protected for 10 years. This is because a design is very easy and can be imitated quickly by the general public. When it is protected by copyright, it becomes ineffective and wasteful. This chapter focuses on one of the most important hedges protecting strong intellectual property rights: the three-step test. This test forms part of the TRIPS Agreement and other international treaties, as well as EU law. It regulates the room for the adoption of limitations and exceptions to exclusive rights across different fields of IP. As a flexible compromise formula, the provision plays a crucial role at the intersection between IP protection and areas of freedom that serve competing economic, social, and cultural interests. The chapter then outlines the potential enabling and constraining functions of the three-step test in international and supranational copyright law and explores the way in which a potentially flexible international balancing tool has been converted into a powerful IP hedge. In particular, it looks at the embedding of the constraining function in EU law and the Marrakesh Treaty.

Batik artwork is one of the treasures of the nation's cultural heritage. Batik artwork is currently experiencing rapid growth. The amount of interest and market demand for this art resulted batik artwork became one of the commodities in the country and abroad. Act No. 28 of 2014 on Copyright has accommodated artwork batik as one of the creations that are protected by law. So that this work of art than as a cultural heritage also have economic value for its creator. Then how the legal protection of the batik artwork yaang not registered? Does this also can be protected? While in the registration of intellectual property rights is a necessity so that it has the force of law to the work produced
