Der Beitrag untersucht und systematisiert die kirchenrechtlichen Perspektiven des Schreibens Samaritanus bonus über die Sorge an Personen in kritischen Phasen und in der Endphase des Lebens. Dabei wird vornehmlich das Ziel verfolgt, die rechtlichen Dimensionen der Seelsorge an Kranken und Sterbenden in der Verkündigung des Wortes Gottes, in der Feier der Sakramente (vornehmlich Beichte, Krankensalbung und Eucharistie) und der Caritas zum Schutz des menschlichen Lebens zu erfassen. Zugleich wird die damit verbundene Frage erörtert, wie kirchliches Recht als solches auf staatliche Gesetze reagieren kann, die darauf abzielen, durch Suizid und Euthanasie ein Recht am oder gegen das Geschenk des Lebens zu legitimieren. The article examines and systematises the canonical perspectives of the letter Samaritanus bonus on the care of persons in the critical and terminal phases of life. The main aim is to grasp the legal dimensions of pastoral care for the sick and dying in the proclamation of the Word of God, in the celebration of the sacraments (primarily confession, extreme unction and Eucharist) and in caritas for the protection of human life. At the same time, the related question of how ecclesiastical law as such can respond to state laws aimed at legitimising a right to or against the gift of life through suicide and euthanasia is discussed.

Conscience is a sharp weapon against totalitarianism and injustice. A decision of conscience is to be respected, but the importance of a decision of conscience must not be devalued by abusing conscience for every personal conviction. At the end of life, in particular, the wish to “help” someone die (assisted suicide) is often referred to as a decision of conscience – both by doctors and relatives. According to the unambiguous teaching of the Roman Catholic Church, such a decision of conscience remains objectively wrong, even if the suicide assistant in individual cases acts with minor (or even no) moral guilt. A decision does not become correct by basing this decision on conscience. Moreover, every person is required to examine and purify conscience – also on the basis of the teaching of Church, which the Congregation for the Doctrine of the Faith has impressively expanded in its letter Samaritanus bonus. Numerous practical consequences for Catholic institutions and doctors follow from this letter.

Liberty means to live. That is what Christian Jasper is convinced about regarding the understanding of liberty in German law and Christian faith. The author introduces the reader in the letter Samaritanus bonus on the care of persons in the critical and terminal phases of life which the roman catholic Congregation for the doctrine of the faith published on 14th July 2020. Therefore, the author compares theological and legal understandings of the idea of liberty. Whereas the German Constitutional Court puts much emphasis on the defence of autonomy the author highlights that human dignity implies more than the individual right to act arbitrarily. Modern societies require individuals who behave moral. The challenge is to avoid misunderstandings between the different faculties and to find wise compromises between moral expectations and legal rules in a liberal society. The lecture of Samaritanus bonus may help to improve the public discussion.

Die konkrete Kausalität eines Schadensereignisses wie die diesbzgl. täterindividuelle Voraussicht bzw. Voraussehbarkeit werfen bei medizinisch relevanten Schadensfolgen regelmäßig erhebliche Nachweisschwierigkeiten auf. Hier gilt es für die Strafjustiz, die Unschuldsvermutung ernst zu nehmen, d. h. insbesondere den Erkenntnisstand der medizinischen Wissenschaft sorgfältig auszuwerten und den Tatvorsatz nicht mit der bequemen „ist-allgemein-bekannt“-Floskel zu fingieren – ohne dabei aber vor lebensfernen Schutzbehauptungen zu kapitulieren. Im hier besprochenen Fall messen das freisprechende LG Mühlhausen und der vorsatzaffine 2. Strafsenat des BGH nahezu die gesamte Skala der Deutungsmöglichkeiten aus.
