At the start of the 2013 academic year, Japan’s Ministry of Education, Culture, Sports, Science and Technology (MEXT) implemented the guideline set forth in their latest Courses of Study, dictating that English classes “should be conducted principally in English in high school” (MEXT, 2009, p. 8). The new Courses of Study, although not imposing a strict target-language-only rule, are still reflective of the past dogma that takes what Macaro (2001) calls a maximal position wherein the L1 is a necessary evil rather than a pedagogical resource. Teachers and institutions espousing such a view undermine language learning progress by engendering undue guilt for responsive and responsible teaching decisions, inhibiting creative pedagogy, and discouraging teachers from acting as positive and realistic bi/multilingual role models. 日本の文部科学省は、現行版学習要領に記載された「高等学校の英語教育授業を原則として英語で教えること」(文部科学省, 2009, p. 8)という方針を2013学年度に施行した。対象言語のみの使用を徹底するという厳格な規則にはなっていないものの、新学習要領は、Macaro(2001)がmaximal positionと呼ぶ「母語(L1)の使用は教育上の必要悪である」とする考えを反映している。このような見解を広める教師及び教育機関は、柔軟かつ責任ある教育的決断に対して過剰な罪悪感を生み、独創的な教授法を抑制し、教師が積極的で現実的に対応できるバイリンガル・多言語が使いこなせる模範者として活躍することを阻害し、それによって外国語教育の進歩を妨害する。

This book describes how commercial ventures in creative industries have cultural impact. Since royal patronage of arts ended, firms in the creative industries, working within the market mechanism, have been responsible for the production and distribution of the cultural goods—art, books, films, fashion, and music—that enrich our lives. This book counters the popular perception that this marriage of art and business is a necessary evil, proposing instead that entrepreneurs who introduce radically new cultural works to the market must bring about a change in society’s beliefs about what is appropriate and valuable to encourage consumption of these goods. In so doing, these pioneer entrepreneurs change minds, not just lives; the seeds of cultural change are embedded in the world of commerce. Building on theories of value construction and cultural production, integrated with field research on pioneer firms (like Chanel and the Sundance Institute) and new market categories (like modern art and high fashion in India), the author develops conceptual frameworks that explain the structure and functioning of creative industries. Through a systematic exposition of the roles and functions of the players in this space—creators, producers, and intermediaries—the book proposes a new way to understand the relationship among markets, entrepreneurship, and culture. Khaire also discusses challenges inherent in being entrepreneurial in the creative industries, paying special attention to the implications of digitalization and globalization, and suggests prescriptive directions for individuals and firms wishing to balance pecuniary motivations with cultural convictions in this rapidly changing world.

The COVID-19 pandemic has seen the rapid but sometimes controversial take-up of ‘online examination proctoring’ systems by universities keen to maintain their assessment schedules during times of campus closure. Following the theoretical tradition of media ‘domestication’, this article examines the mainstream adoption of different online proctoring systems in Australian higher education during the first year of the pandemic. Through analysis of interviews, documents, news, social media and marketing materials, the article examines the ‘appropriation’, ‘objectification’, incorporation’ and ‘conversion’ of proctoring technology from the perspective of commercial providers, university authorities, university staff and student groups. This raises a number of critical issues underpinning the adoption of this exam surveillance technology – not least the surrender of control to commercial providers, the hidden labour required to sustain ‘automated’ systems and the increased vulnerabilities of ‘remote’ studying.

Patents and other statutory types of market protections are used in the United States to promote scientific research and innovation. This incentive is especially important in research intensive fields such as the pharmaceutical industry. Unfortunately, these same protections often result in higher monopoly pricing once a successful product is brought to market. Usually this consequence is viewed as the necessary evil of an incentive system that encourages costly research and development by promising large rewards to the successful inventor. However, in the case of the AIDS drug Zidovudine (AZT), the high prices charged by the pharmaceutical company owning the drug have led to public outcry and a re-examination of government incentive systems.This Note traces the evolution of these incentive programs — the patent system, and, to a lesser extent, the orphan drug program — and details the conflicting interests involved in their development. It then demonstrates how the AZT problem brings the interest of providing inventors with incentives for risky innovative efforts into a sharp collision with the ultimate goal of such systems: ensuring that the public has access to the resulting products at a reasonable price. Finally, the Note describes how Congress and the courts have attempted to resolve these problems in the past, and how they might best try to solve the AZT problem in the near future.
