Prof. Leszek Józef Egidiusz Winowski was born on 23 January 1910 in Skałat, Tarnopol Voivodeship, in the Eastern Lands of the Second Polish Republic. He studied in the Faculty of Law of Jan Kazimierz University in Lvov, where he earned the Master’s degree (1932), Doctor’s degree (1935), and in 1936 began his scientific work in the Chair of Church Law; from 1942 he was working in conspiracy in Lvov and cooperated with theBaltic Institute in Sopot; in Olsztyn he organized a branch of the Baltic Institute, which was operating in the Masurian District. In 1945, Leszek Winowski was employed in the Department of Law and Administration of Wrocław University and in 1974 he was granted the title of Full Professor. At the same time he worked in the Catholic University of Lublin, where he held the post of Dean of the Faculty of Law and Social Sciences in the years 1945-1946 and – following its liquidation – he worked in the Faculty of the Canon Law where he lectured in Roman law and ecclesiastical law. In 1957, L. Winowski resigned from his work in the Catholic University of Lublin. Between 1957 and 1968, he was employed in the Teacher’s Training College in Opole, still working for Wrocław University. As regards the fields of scientific studies developed by Prof. Leszek Winowski, one candistinguish three main directions dealing with the legal situation of dissenters from the earliest Middle Ages, the state and law of Islam, and lastly – history of the Church in Silesia. Prof. Leszek Winowski was awarded the Knight’s Cross of the Order of Polonia Restituta. He was a member of many scientific societies. He died in Wrocław on 16 November 1979.

The oath of innocence, or purgation, constituted a part of canon law for almost a millennium. It has nevertheless been largely neglected by studies on medieval canonical procedure. This book seeks to reconstruct the history of the oath of purgation specifically from the perspective of canon law. Over the centuries, the function of the so-called "purgatio canonica" never changed: priests of the Church were required to swear their innocence when charged with any criminal offence for which evidence of guilt was lacking. It is while dealing with the canonical purgation that the canonists also developed the notion of infamia facti, a concept of social disrepute with real legal significance. Within a short space of time this inspired the most significant innovations in medieval legal procedure: the introduction of the inquisitorial process alongside the accusatorial model, the elaboration of a canonical theory of legal presumptions, and the justification of judicial torture. The history of the oath of purgation thus provides a unique perspective from which to observe the transformations which occurred in canon law procedure and wider legal culture throughout the course of the Middle Ages.

It is surprising to realize that no historian of Judaism wrote a history of the Middle Ages in Jewish history. Between 1923 and 1926 a Jewish historian, Shlomo Bernfeld, wrote a three-volume historical work, consisting mainly of an anthology of sources, entitled Sefer ha-Demaot, ‘The Book of Tears’. These volumes present a history of the Middle Ages up to the ‘Age of Reason’, which the author hoped would be the beginning of a new age in which the fate of the Jews would be different, yet this hope, he states in the end of his work, seems to have been unfounded. This article examines such narratives: the way narratives shape the chronological boundaries of the Middle Ages; their consequences concerning the examination of the relationships between Jews and non-Jews in the medieval world; and the place of history of ideas in the descriptions of the Middle Ages.

ABSTRACT Like many writers after the Renaissance, Hooker was influenced by a number of classical and Neo-Platonic texts, especially by Cicero, Seneca, Hermes Trimegistus, and Pseudo-Dionysius. Hooker’s regular allusions to these thinkers help illuminate his own work but also his place within the broader European context and the history of ideas. This paper addresses in turn the reception of Cicero and Seneca in the early Church through the Middle Ages and Renaissance, Hooker’s use of Ciceronian and Senecan ideas, and finally Hooker’s use of Neo-Platonic texts attributed to Hermes Trismegistus and Dionysius the Areopagite. Hooker will be shown to distinguish himself as a sophisticated and learned interpreter who balances distinctive motifs such as Scripture and tradition, faith, reason, experience, and ecclesiology with a complex appeal to pagan and Christian sources and ideas.

In the Middle Ages the learned, who expected to control public behaviour and belief, tried to give their theories the force of law. Theology was the peak of the system, and canon law, though autonomous, naturally developed in parallel, and without conflict. True and false data about Islam were set in the framework of Catholic theology, and Islam, and the history of the Prophet as well, were defined in European terms unrecognizable by Arabs. The theology of Crusade was the theology of European relations with Islam; theology and history alike were little more than supporting propaganda for aggression, while canon law defined the limits within which the war was supposed to take place.

In the second half of the first millennium CE, the Christian Middle East fractured irreparably into competing churches and Arabs conquered the region, setting in motion a process that would lead to its eventual conversion to Islam. This book argues that key to understanding these dramatic religious transformations are ordinary religious believers, often called “the simple” in late antique and medieval sources. Largely agrarian and illiterate, these Christians outnumbered Muslims well into the era of the Crusades, and yet they have typically been invisible in our understanding of the Middle East's history. What did it mean for Christian communities to break apart over theological disagreements that most people could not understand? How does our view of the rise of Islam change if we take seriously the fact that Muslims remained a demographic minority for much of the Middle Ages? In addressing these and other questions, the book provides a sweeping reinterpretation of the religious history of the medieval Middle East. The book draws on a wealth of Greek, Syriac, and Arabic sources to recast these conquered lands as largely Christian ones whose growing Muslim populations are properly understood as converting away from and in competition with the non-Muslim communities around them.

Abstract This paper offers an overview of the history of the axiom forma dat esse, which was commonly quoted during the Middle Ages to describe formal causality. The first part of the paper studies the origin of this principle, and recalls how the ambiguity of Boethius’s first formulation of it in the De Trinitate was variously interpreted by the members of the School of Chartres. Then, the paper examines the various declensions of the axiom that existed in the late Middle Ages, and shows how its evolution significantly follows the progressive decline of the Aristotelian model of formal causality.
