Chapter 18 Key Issues in the Relationship between the World Heritage Convention and Climate Change Regulation

The inscription of East Rennell in Solomon Islands on the World Heritage List was a landmark in the implementation of the World Heritage Convention. However, the site is now on the List of World Heritage in Danger, threatened by resource development, invasive species, climate change and the over-harvesting of certain animals. This article examines the scope for the Protected Areas Act of 2010 to be used to safeguard the site, and the challenges that may be encountered if the Act is implemented there. It explains how the Act provides direct protection against some (but not all) of the threats to East Rennell. Furthermore, the approach to conservation facilitated by the Act is appropriate for Solomon Islands, where most land is under customary tenure, many people rely on natural resources to support their subsistence lifestyles and the government's capacity to enforce legislation is limited. The article argues that the relationship between the legislation and custom must be considered in the design of the landowner consent process, the preparation of the site's management plan, and the selection of its management committee. Additionally, the protected area should aim to improve the livelihoods of the East Rennellese, as well as safeguarding the site's heritage values.

The international protection of tangible cultural heritage overlaps with that of the environment, ranging from the conservation of biodiversity to the prevention of desertification. Against this background, the phenomenon of climate change raises questions that challenge the fundamentals of the World Heritage Convention, which protects cultural heritage and interlinked natural heritage. Global warming critically affects cultural sites of outstanding universal value, such as the city of Venice, and depletes mixed cultural and natural sites inscribed on the World Heritage List, such as Tassili n’Ajjer. Arguably, the World Heritage Convention is lex specialis with respect to international environmental regulation as concerns localized adaptation and mitigation measures protecting sites of outstanding universal value. By contrast, environmental regulation, notably the UNFCCC regime as reviewed in Paris in December 2015, is lex specialis as concerns general mitigation and adaptation, systemically integrating the protection of tangible cultural heritage. This argument also applies to intangible cultural heritage, including a human rights perspective. In fact, the fundamental right to culture has been invoked in international jurisdictions to protect intangible heritage, but still remains lex generalis with respect to the UNFCCC regime. As in a set of nested boxes, such an interactive pattern outlines a basic paradigm to shape the broader intersection between the regulatory regimes protecting tangible cultural heritage and the environment in international law.

Abstract The predicted increases in climate change vulnerability of heritage sites are alarming. Yet, heritage management focuses on enabling a steady state of heritage sites to ensure the continuity of values embedded within those properties. In this paper, we use the concept of resilience to demonstrate how expanding the heritage paradigm from solely a preservation perspective to one that also embraces a transformation perspective can accommodate for loss as well as promote learning. We argue that adaptation as currently conceptualized in the heritage field is limited, as it is not economically or ecologically feasible for all heritage sites or properties. When heritage properties are severely impacted by climatic events, we suggest that some remain damaged to serve as a memory of that event and the inherent vulnerabilities embedded in places. Moreover, when confronted with projected climatic impacts that exceed a financially viable threshold or ecological reality, or when rights holders or associated communities deem persistent adaptation unacceptable, we argue for transformation. We claim that transformation enables a reorganization of values focused on the discovery of future values embedded within changing associations and benefits. Therefore, we recommend that the heritage field adopts an alternative heritage policy that enables transformative continuity through applications of persistent and autonomous or anticipatory adaptation. We conclude by suggesting a pathway for such change at the international level; specifically, we call for the World Heritage Convention to develop a new grouping of sites, World Heritage Sites in Climatic Transformation.

Chapter 5 analyses the evolving conception and protection of landscape in the World Heritage Convention. First, it traces the development of landscape protection from its early conceptual dependency on nature, to the incorporation of ‘cultural landscapes’ within the Convention’s scope in 1992. It then discusses the typology of cultural landscapes, issues of representativeness and the implications of the Word Heritage system for landscape protection globally, as well as locally. In this regard, a number of cases are analysed which, on the one hand, support the World Heritage Convention’s instrumental role in landscape governance, but which on the other, highlight the problems involved in ascribing World Heritage status to living landscapes from a spatial justice perspective.

This chapter discusses the emergence of environmental history, which developed in the context of the environmental concerns that began in the 1960s with worries about local industrial pollution, but which has since evolved into a full-scale global crisis of climate change. Environmental history is ‘the history of the relationship between human societies and the rest of nature’. It includes three chief areas of inquiry: the study of material environmental history, political and policy-related environmental history, and a form of environmental history which concerns what humans have thought, believed, written, and more rarely, painted, sculpted, sung, or danced that deals with the relationship between society and nature. Since 1980, environmental history has come to flourish in many corners of the world, and scholars everywhere have found models, approaches, and perspectives rather different from those developed for the US context.
