Marine Spatial Planning: Exploring the Role of Planning Practice and Research

Marine spatial planning (MSP) is a tool for managing and improving marine environments. The field is dominated by natural scientists and has not been commonly associated with planning. This research analyzes the MSP literature to explore how planners can contribute to MSP research and practice. We organize the literature into eight themes, focusing on how planners may be able to contribute to MSP research and practice: ocean zoning, defining boundaries, planning in dynamic environments, stakeholder involvement, information needs, integrating ocean and land-use management, managing multiple and conflicting uses, and transboundary institutional structures. We conclude that planners have a lot to contribute in these eight areas.

The Constitution determines that the legislative and executive powers regarding 'regional planning and development', 'urban and rural development', 'provincial planning' and 'municipal planning' are divided among the three spheres of government. Yet the boundaries between these items listed in Schedules 4 and 5 of the Constitution are opaque and their precise content is not always apparent. Overlaps, conflicts and uncertainty may occur. In a number of landmark decisions the courts have provided content to these different functional areas. Clarity on what 'municipal planning' comprises leads to more certainty on the content of the other planning areas. Draft legislation such as the Spatial Planning and Land Use Management Bill (B14-2012) can also assist in adding substance to a demarcation of these different functional areas.  Yet uncertainties still remain, occasioned by constitutional provisions such as sections 100, 139(1) and 155(6)-(7), that permit intervention by national and provincial government in provinces and municipalities respectively, as well as the support and monitoring by provincial government in respect of municipalities. Few clear solutions are immediately apparent. The role of the constitutional principles of co-operative government where uncertainty and conflict exist is examined, especially where no veto of one sphere over another is possible. Principles of interpretation can also assist in delineating the boundaries of the different functional areas. It seems, however, that the courts will find themselves having to address the remaining inconsistencies.

Our spatial environment is one of the most important determinants of our well-being and life chances. It relates to schools, opportunities, businesses, recreation and access to public services. Spatial injustice results where discrimination determines that spatial environment. Since Apartheid in South Africa epitomised the notion of spatial injustice, tools and instruments are required to transform spatial injustice into spatial justice. One of these is the employment of principles of spatial justice. While the National Development Plan (NDP) recognised that all spatial development should conform to certain normative principles and should explicitly indicate how the requirements of these should be met, the Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) contains a more concrete principle of spatial justice. It echoes aspects of both the South African land reform programme and global principles of spatial justice. Essentially section 7(a) of SPLUMA entails three components: (1) redressing past spatial imbalances and exclusions; (2) including people and areas previously excluded and (3) upgrading informal areas and settlements. SPLUMA directs municipalities to apply the principle in its spatial development frameworks, land use schemes and, most importantly, in decision-making on development applications. The aim of this article is to determine whether the application of this principle in practice can move beyond the confines of spatial planning and land use management to address the housing issue in South Africa. Central to housing is section 26 of the Constitution, that has received the extensive attention of the Constitutional Court. The court has not hesitated to criticize the continuing existence of spatial injustice, thus contributing to the transformation of spatial injustice to spatial justice. Since planning, housing and land reform are all intertwined not only the role of SPLUMA, but also the NDP and the myriad other policies, programmes and legislation that are attempting to address the situation are examined and tested against the components of the principle of spatial justice in SPLUMA.

Convensional model of public policy makings in Sambas district, West Borneo Province, so far rely more on the strength of institutional structures and elites with less open processes. The impact in many case of planning has failed to identify and accommodate governance issues. This research uses qualitative explorative methods which are assisted with soft system methodology as suggester by Checkland (1999). Analysis of research uses collaborative governance theory in looking at the process of preparation of regional medium term development plan (RPJMD) of 2016-2021. Result of this research illustrates that the failure in the preparation of planning for this is caused by access to stakeholder involvement that is limited, the role of the government is very dominant so that RPJMD is not considered as a shared commitment and responsibility, the implication of each party working independently in accordance with their respective interest. It is also apparent that the process of preparing planning has not been sufficient to meet accessability and drivers in the form of citizen's education and lack of seriousness in the implementation of bureaucratic reform to become an implementative reference for the formation of participatory policy making according to the perspective of collaborative governance in regions with similar characteristics.

Marine Spatial Planning (MSP) has experienced vigorous growth on the international scale in recent years, and several practices has emerged from different countries. The demand for specific training in the preparation and implementation of marine planning has therefore already shown itself to be quite relevant on a global scale. Educational initiatives related to MSP have to respond to the increased complexity of MSP, which integrates environmental and economic perspectives on marine resources and maritime sectors, considering governance framework as well as maritime affairs and legislation.This paper aims at addressing the educational and training needs for the development of both academic education and professional training in MSP. Learning skills, contents and methods of an ‘ideal’ MSP course are depicted from widely accepted operative guides on MSP and from the EU Framework Directive on MSP (2014/89/EU). They are considered for the analysis of the current educational offer around MSP, performed in a sample of countries that have already undergone a process of implementation of MSP by Law. As result, beside the great variety of courses, it emerges that MSP education seems to be often regarded from an environmental perspective – in continuity with Integrated Coastal Management education – while planning theory and experiences in MSP are the least represented contents. Results are discussed in relation to three major challenges: i) how educational offer reflects on transdisciplinarity, ii) the role of theory in MSP courses, and iii) the enforceability of Plans as major concern in MSP.
