This chapter explores the core and limits of competition law and policy in terms of the values of inclusive development and poverty alleviation in sub-Saharan Africa. A pro-outsider, pro-inclusive development antitrust policy would value a free and open marketplace without privilege or favor. This perspective is especially critical for African nations and market players without economic power and especially for those populations in societies ruled by a few privileged families or firms, or by autocrats. Pro-outsider competition policy may be implemented not only through competition law enforcement of manageable rules and standards but also through advocacy by the competition authority with partners such as the World Bank, and collaboration with neighbors. The elements of good policy form an interdependent virtuous circle.

This chapter explores South African competition law. South Africa has the most sophisticated system of competition law and policy in sub-Saharan Africa. It has a mission to expand economic opportunity and facilitate inclusive development. In the wake of the UN Millennium Development Goals and the follow-on Sustainable Development Goals, there is a new world consciousness of the need to combat deep systemic poverty and to reverse the tide of increasing inequality of wealth, income, and opportunity. If there is any nation in the world whose competition law mandates integration of equity and efficiency, it is South Africa, and its policymakers are intent to address this need. The chapter looks at the South African Competition Act and highlights selected cases to illustrate the law and its implementation, including the effort by the Competition Tribunal to give serious regard to the equality and inclusiveness values that animated the statute.

This paper examines gender mainstreaming in European Union (EU) development aid towards Sub-Saharan Africa. The aim is to detect how gender (in)equality in Sub-Saharan Africa is framed by the EU by critically assessing the nature and range of the differences between EU and civil society framings of gender (in)equality in Sub-Saharan Africa. Using the method of Critical Frame Analysis, 28 EU programming documents have been analysed and compared to 10 civil society texts on gender equality. I conclude that the EU’s approach to gender mainstreaming in its development aid towards Sub-Saharan Africa is to a large extent integrationist and predominantly instrumentalist as it is framed as a way of more effectively achieving existing policy goals. The more transformative issues that are put forward by Sub-Saharan African civil society organisations do not t within the EU’s dominant development paradigm that is focused on achieving the Millennium Development Goals and does not signficantly challenge gender relations or power structures. The gap between the analysed civil society views and those expressed by the EU can be explained by the EU’s reluctance to include in its policy drafting the promotion of gender equality by civil society organisations. Moreover, the gap seems to have both practical and ideological grounds. This study investigates the relevance of government quality in moderating the incidence of environmental degradation on inclusive human development in 44 sub-Saharan African countries for the period 2000–2012. Environmental degradation is measured with CO2 emissions and the governance dynamics include: political stability, voice and accountability, government effectiveness, regulation quality, the rule of law and corruption-control. The empirical evidence is based on the generalised method of moments. Regulation quality modulates CO2 emissions to exert a net negative effect on inclusive development. Institutional governance (consisting of corruption-control and the rule of law) modulates CO2 emissions to also exert a net negative effect on inclusive human development. Fortunately, the corresponding interactive effects are positive, which indicates that good governance needs to be enhanced to achieve positive net effects. A policy threshold of institutional governance at which institutional governance completely dampens the unfavourable effect of CO2 emissions on inclusive human development is established. Other policy implications are discussed.

In much of rural sub-Saharan Africa, women in traditional patrilineal systems are generally subordinated to men, thus endangering gender equality. Women born and nurtured in such systems are relegated to second-class citizenship, are inferior to men, and are excluded from collective decision-making, as they are presumed to be represented by husbands and fathers. In the past decade, however, women’s visibility and influence has increased. As women have begun to participate in political issues, discussions around gender equality have cut across various sectors, including governance. This article seeks to identify whether traditional governance systems are beginning to take gender issues into consideration in their organisation and composition. It also seeks to bring to light and document opinions of women living in rural Vukuzenzele Village on issues relating to traditional governance. Through interviewing traditional leaders and women in the community, this study sought to answer the questions: (1) Do women have roles and responsibilities similar to male counterparts in traditional governance systems? (2) Do cultural attitudes still impact on gender roles? (3) How are cases and disputes involving women treated within the system? (4) How is the traditional governance system, in this case, affected by democracy or gender equality advocacy?

Background: Ambitious goals have been set to eradicate malaria by the year 2040. Given the high poverty levels and the intense levels of malaria transmission in sub-Saharan Africa, suppressing malaria in rural agricultural communities in these regions will be one of the greatest challenges to achieving malaria eradication. This study has two objectives. The first is to estimate how eradicating malaria by 2040 would affect agricultural households in sub-Saharan Africa. The second is to identify where additional research is needed to develop better estimates of how eradicating malaria by 2040 would affect those households. Methods: Using agricultural census data and malaria morbidity data, we developed estimates of the number of malaria cases in 2018 among agricultural households with fewer than 10 hectares of land for 35 countries in sub-Saharan Africa. By combining these estimates with additional evidence from the literature, we analyzed how achieving malaria eradication by 2040 would affect indicators related to four Sustainable Development Goals: health, poverty, education and gender equality. Results: Our analysis found that achieving malaria eradication by 2040 would prevent approximately 841 million cases of malaria and thereby decrease the number of lost workdays among agricultural households by approximately 3.2 billion days. Eradicating malaria by 2040 would also increase the number of school days attended by children by 1.5 billion days while also reducing the number of caregiving days provided by women for malaria cases by approximately 1.1 billion days. Conclusions: This article analyzes the impact of eradicating malaria among agricultural households in sub-Saharan Africa using indicators related to four of the Sustainable Development Goals. Enhanced data collection efforts related to these four indicators would facilitate more rigorous estimates of how eradicating malaria would affect these indicators over the next two decades.
