PLATFORM WORK AS A SIGN OF THE “UBERIZATION” OF WORKThe sharing economy has left a strong mark on the modern labour market. One of the popular forms of earning in the sharing economy is crowd employment. In the present paper the author analyzes a tripartite relationship between the crowdsourcer, crowdsourcing platforms and a crowdworker. The author is looking for legal models describing the particular relationships. He is considering whether the nature of employment can be attributed to them. The paper is of a reporting nature. The legal assessment refers to Polish law.

There has been much debate in the columns of newspapers as to how we should understand the sharing economy, but as yet, much of the debate is largely superficial, garnering little attention in terms of rigorous academic analysis. In this paper, I argue that the rise of the capital-extractive sharing economy model employed by companies like Uber and Airbnb cannot be understood outside of the political-economic context from which it emerges. Drawing on the work of Marxist scholars like David Harvey, I analyze such models through the lens of primitive accumulation, positioning their development as positive evidence of Harvey’s theory that capitalism seeks to colonize new spheres of social life in order to offload the tensions of its own internal conflicts; in this case, labour market insecurity. Further, I argue that the rise of the capital-extractive sharing economy should be recognized as constituting a further entrenchment of the global neoliberal project, particularly as it stands to affect union organizing, force deregulation in favour of free market fundamentals, and further deepen the labour market insecurity from which it rises in the first place.

Sharing economy is cooperation and sharing based on providing the opportunity to access goods and services to those, who precisely need such a service. This paper attempts to organise the yet unsettled areas of sharing economy that today determine its risk and make it ambiguous, unequal, unfair and objectionable in the eyes of many a business environments. The aim of this article is to analyze the risk associated with sharing economy. To fulfil this aim the author has discussed: the paradigm of consumption and the common good in the context of the economy of the future, the etymology of the term of sharing economy and identification of risk that is linked with this phenomenon. The studies were divided into two parts:  the first concerns theoretical risk analysis of the functioning of sharing economy based on subject literature; the second part is a practical analysis of the risk of the impact of sharing economy on the Polish labour market on the example of UBER application. The following research hypothesis was adopted in the paper: The risk of impact of sharing economy on the labour market in Poland is of little significance. The analysis allowed to identify the following risk types in the number of twenty, which are present today in sharing economy: Unequivocal and coherent concept, Data safety, Taxes, Law regulations, Quality, Service performance guarantee, Pursuing claims, Employees rights, Responsibility for clients, Grey market, Competitiveness, Relations: sharing - business, Licences and permissions, Employment relationship, Deflation, Consumer rights protection, Employment, Abuse, Mentality, Sales. A risk analysis of the effects of sharing economy on the Polish labour market showed that this phenomenon was of low significance in the analysed period.

Goal – the article analyses the most important legal acts regulating the employment of foreigners in Poland. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. Moreover, it also considers the current problem of the COVID-19 pandemic and its impact on legal aspects of employment of foreigners in Poland.
