AbstractThis essay will analyze the European Union framework of ethnic profiling in the aim of combating terrorism that will be contrasted to the principle of non-discrimination that is fundamental in the European regime of Human Rights. Research question in this essay is whether the European human rights regime consistently holds the principle of non-discriminatory in justifying the use of ethnic profiling in combating terrorism. IntisariMakalah ini akan membahas mengenai kebijakan profil etnis (ethnic profiling) dalam rangka memerangi terorisme di Uni Eropa yang akan dikontraskan dengan prinsip non-diskriminasi yang juga merupakan hal penting dan mendasar dalam perlindungan Hak Asasi Manusia di Eropa. Permasalahan mendasar yang dikaji dalam studi ini adalah apakah Uni Eropa konsisten dalam memegang prinsip non-diskriminasi ketika membenarkan penggunaan kebijakan profil etnis dalam memberantas terorisme.

Opinion 2/13 of the Court of Justice of the European Union (CJEU) declared the draft agreement on European Union accession to the European Convention on Human Rights (ECHR) incompatible with the Treaty on European Union. The Opinion comes toward the end of a long and gradual process of incorporating human and fundamental rights principles into the legal system of the European Community and its successor, the European Union. Opinion 2/13 sends the Commission back to the drawing board on what has long been seen as the capstone of that process—EU accession to the Strasbourg human rights regime as an external check on human rights protection within the European Union.

Growing media attention and international criticism about human rights violations in the wake of the resurgence of insurgency led India to make major policy changes in its attitude towards human rights and begin to discuss human rights with the European Union for the first time in 1990. This article critically examines Indian perceptions of the EU’s approach towards human rights since the 1990s to the present. It evaluates Indian responses to the inclusion of human rights provisions in trade agreements and criticism of the ‘one size fits all’ model of the Europeans for the promotion of human rights. It explores the sources of Indian scepticism about the international human rights regime and criticism of Western countries’ selectivity in enforcing human rights. In the ultimate analysis, the responsibility for initiating and implementing the multitude of structural, economic, social and political reforms necessary to improve human rights implementation must be taken by Indians themselves. External players can only play a supportive role and their capacities to bring about fundamental change are necessarily limited.

<p>The issue of human rights is a problem of great concern in the European Union.  Previous alliances faced problems related to human rights in the areas of geopolitics and geo-economics.  The ECHR (European Convention of Human Rights) is present as a regime carrying out human rights values that were previously influenced by COE (The Convention of Europe) in the European Union. The development of the ECHR as a human rights regime in the European Union is very dependent on the conditions of the EU member states themselves, which were previously fragmented into fascist and communism systems and must be transformed into democratic liberals. Data in this research will be explored through literature method (library research). The process of developing the ECHR as a human rights regime should be analyzed through an international regime approach using the theory of regime-interplay which will examine the ECHR process as  one of the influential human rights regimes in the European Union.</p><p><strong>Bahasa Indonesia Abstract</strong>: Isu Hak Asasi Manusia adalah masalah yang sangat diperhatikan di Uni Eropa. Aliansi negara-negara Eropa sebelumnya menghadapi masalah yang berkaitan dengan Hak Asasi Manusia yang dihubungkan dengan aspek geo-politik dan geo-ekonomi di kawasan tersebut. ECHR (Konvensi Eropa tentang Hak Asasi Manusia) hadir sebagai rezim yang menjalankan nilai-nilai HAM yang sebelumnya dipengaruhi oleh COE (Konvensi Eropa) di Uni Eropa. Perkembangan ECHR sebagai rezim hak asasi manusia di Uni Eropa sangat tergantung pada kondisi negara-negara anggota UE sendiri, yang sebelumnya terfragmentasi menjadi sistem fasisme dan komunisme, dan harus ditransformasikan menjadi sistem liberal. Data dalam penelitian ini akan dianalisa melalui metode literatur (studi pustaka). Proses pengembangan ECHR sebagai rezim Hak Asasi Manusia dianalisis melalui pendekatan rezim internasional menggunakan teori <em>regime-interplay</em> yang akan menelaah proses ECHR sebagai salah satu rezim HAM yang berpengaruh di Uni Eropa.</p>

The legacy from Christianity unquestionably lies at the root of Europe, even if not exclusively. It has taken many aspects from the Middle Ages to modern times. If the Christian heritage is diversely understood and accepted within the European Union, the reason is essentially due to its political and religious significance. However, its impact in politics and religion has often been far from negative, if we will consider what secular societies have derived from Christianity: human rights, for example, and a religious affiliation which has been part and parcel of national identity. The Christian legacy has to be acknowledged through a critical analysis which does not deny the truth of the past but should support a European project built around common values.

The list of main provisions of constitutional and legal restrictions in the European Union countries is presented. The application of the norms is described Human rights conventions. The principle of implementing legal acts in the context of the COVID-19 pandemic is considered. A comparative analysis of legal restrictive measures in the States of the European Union is carried out.
