O CONTROLE CONCORRENCIAL: REGULADOR DO MERCADO INTERNO NA UNIÃO EUROPEIA COMPETITION CONTROL: REGULATOR OF THE EUROPEAN UNION INTERNAL MARKET  Marcelo Schultes RESUMO: O controle concorrencial tem exercido um papel importante na implementação do mercado interno no espaço de integração europeu, corrigindo distorções e abusos econômicos. Também é possível notar a interação do direito da concorrência com outras áreas do direito, como, por exemplo, a da propriedade intelectual. Observa-se, ainda, o alargamento dos objetivos das políticas de concorrência europeias, que passam a mirar também o desenvolvimento econômico sustentável e a inovação tecnológica. Neste artigo pretende-se analisar de que forma o controle da concorrência entre os agentes econômicos dos diferentes estados membros da União Europeia embasou a construção de um mercado interno efetivo, corrigindo distorções concorrenciais surgidas neste exitoso processo de integração regional. PALAVRAS-CHAVE: União Europeia; Concorrência; Mercado Interno; Desenvolvimento; Propriedade Intelectual. ABSTRACT: The competition control has played a major role in the implementation of the internal market within the European integration area, correcting distortions and economic abuse. It is also possible to observe the interaction of competition law with other areas of law, such as, e.g., the intellectual property. Furthermore, one observes an enlargement of the objectives of the European competition policy, which targets also the sustainable economic development and technological innovation. This article aims to analyze how the control of competition between economic agents of different member states of the European Union based the construction of an effective internal market, correcting distortions of competition emerged within this successful regional integration process.KEYWORDS: European Union; Competition Law; Internal Market; Development; Intellectual Property.SUMÁRIO: Introdução. 1. This article points out the aim and purpose of the competition law in the European Union. Competition law is one of the most crucial and essential part of law that has to be implemented properly to support and ensure smooth functioning of the economy in the state. At the same time, brief explanation of the most anticompetitive agreements such as called “Cartel Agreements” are being described in the article. It is worth to point out the most important and restrictive types of agreements in details that can be seen on the market and within the European Union, that definitely needs special attention by the relevant competition authorities of the Member States.

This chapter focuses on Article 102 of the Treaty on the Functioning of the European Union (TFEU). Article 102 prohibits, as incompatible with the internal market, any abuse by undertakings in a dominant position within the internal market in so far as it may affect trade between Member States. It should be noted at the outset that ‘dominance’ itself is not prohibited, but only when such dominance is accompanied with abusive behaviour that may affect trade. Like Article 101, Article 102 is enforced by the European Commission, national competition authorities, and national courts under powers conferred by Regulation 1/2003.

This chapter analyses the foundations of EU competition law. Competition law is an attempt to regulate the behaviour of private companies when active in the internal market so as to ensure that competition between different entities remains and is fair. The rules of competition law aim both to assist the completion of the internal market as well as addressing consumer welfare in more general terms. A further particularly interesting dimension is that unlike most internal market law, competition law applies regardless of the nationality of the companies or businesses active in the internal market. As such, UK companies active on the continent after Brexit will have to know these rules, regardless of whether they continue to apply in the UK. The chapter then details the two Treaty provisions that address anti-competitive behaviour: Articles 101 and 102 TFEU (Treaty on the Functioning of the European Union).

Resumo: A principal questão deste estudo é que, no ambiente de integração econômica da União Europeia, para que se perfectibilize o mercado interno, faz-se necessário o tratamento integrado da propriedade industrial no território do tratado, que pode ser caracterizado como a centralização de procedimentos e alargamento da validade dos títulos de propriedade industrial no espaço da União Europeia. As necessidades econômicas do mercado interno no espaço de integração demandam trazer à competência da União matérias antes tratadas nacionalmente pelos estados membros, notadamente quando se fala em temas de direito privado. A propriedade industrial é um bom exemplo disso, e o legislador europeu está paulatinamente trazendo a regulação desta matéria para dentro do ordenamento da União. Palavras Chave: União Europeia; Propriedade Industrial; Direito Privado; Alargamento; Marcas; Patentes; Design. Abstract: The main question on this study is that, in the regional integration environment of the European Union, for the internal market to get perfectibilized, it is necessary the integrated treatment of industrial property rights in the territory of the treaty, which can be characterized as the centralization of procedures and enlargement of the territorial validity of the industrial property rights in the European Union. The economic needs of the internal market in the integration territory demand to bring to the European Union's competence the matters originally treated nationally by the member states, especially when it comes to private law.
