Despite its widespread currency in political science, the concept of clientelism has rarely found its way into the literature on communist systems. Students of communist politics regularly note the importance of personal ties, and many recognize the significance of informal bonds in economic and political spheres atalllevels of society. Some even apply the term “clientelism” to the political behavior they describe. Yet these studies are generally limited to elite-level politics, to factionalism, career mobility, recruitment patterns, and attainment of office at the top- to middle-level echelons of the bureaucracy.2Few have considered clientelism as a type of elite-mass linkage through which the state and the party exercise control at the local level, and through which individuals participate in the political system.

Abstract: The Constitution of the Republic of Indonesia Year 1945 Article 29, paragraph 1 explains that "the State based on Almighty God". Normative-juridical provision has given legitimacy to the formalization of Islamic law for transformative integrated in the political system and constitutional law in Indonesia. Internalization of Islamic law into the legislation at the local level has opened the scope of the spirit of autonomy granted by the regions both general and specific. This spirit also later brings their initiative to roll Regional Regulation nuances of Islamic law, which of course raises the pros and cons in the community.Keywords: Legislation, Autonomous Region, FormalizationAbstrak: Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 pasal 29 ayat 1 menjelaskan bahwa “Negara berdasarkan atas Ketuhanan Yang Maha Esa”. Ketentuan normatif-yuridis ini telah memberikan legitimasi bagi formalisasi hukum Islam untuk terintegrasi secara transformatif dalam sistem politik dan hukum ketatanegaraan Indonesia. Internalisasi hukum Islam ke dalam peraturan perundang-undangan di tingkat daerah telah membuka ruang adanya semangat otonomi yang diberikan oleh daerah-daerah baik yang umum dan khusus. Semangat ini pula yang kemudian melahirkan adanya inisiatif untuk menggulirkan Peraturan Daerah bernuansa syariat Islam, yang tentunya menimbulkan pro dan kontra di tengah kalangan masyarakat.Kata Kunci: Perda, Otonomi Daerah, Formalisasi

The most basic question about the structure and organization of government is Why we should be concerned about this question at all?' Many of us trained in political science programs during the behavioral revolution were taught to believe that the structures of government were insignificant as a focus for research. The structures ofgovernment became encapsulated in an opaque black box; that part of the political system where decisions were made. Fortunately, this view no longer prevails and there is increasing interest in structural questions, in part generated by the increasing interest in the state as a focus for political inquiry (Dyson, 1980; Benjamin and Elkin, 1985). Much of the work on the state as yet, however, leaves that concept largely undifferentiated and has not dealt systematically with the structure of the state apparatus. Thus, concern for the development of state theory, as well as the concerns of those interested in public policy, has returned structural questions to a more central position in political science.

Relevance of the study of theoretical developments on the formation of political and governing elite, including its functions, due to the need of compliance of the role of politi-cal and governing elite and social needs.The article is devoted to the priority functions of political and governing elite at pre-sent state.In this work studied scientific approaches to defining the role of the elite. It was es-tablished that the main and most essential function of political and governing elite, which actually led to the selection of this category, is political control. It is shown that political and governing elite level for personalized serves as the political system, namely strate-gic, integrative and regulatory. The main functions of political and governing elite also includes: mobilization, communication, function representation in the political system of society social interests.Determined that in terms of military aggression from Russia, the loss of economics and the state, when Ukraine needs a final exercise their geopolitical choice by the practi-cal implementation of the course towards european integration through reforms in all spheres of public life, political and governing elite should focus on specific primary func-tions. Analysis of public inquiries allowed to formulate these functions, referring to re-cent peacekeeping, communicative, integrative and regulatory.
