This scientific article discusses the enforcement of environmental law in the field of coal mining and the strengthening of indigenous community institutions in Bungo Regency. The research approach method used in this scientific article is normative juridical and empirical juridical to be able to find the concept of enforcement of environmental law in the field of coal mining by examining the principles of mining law for the welfare of the community. The nature of environmental law should be able to prevent the occurrence of pollution and environmental damage and the existence of institutions of indigenous peoples in Bungo District has not functioned in the enforcement of environmental law in the field of coal mining business. Therefore the Bungo District government needs to strengthen the institutional of indigenous peoples so that it can function to enforce environmental law against coal mining to improve the welfare of the people in Bungo District.

<p>Abstract<br />The authority to issue Mining Business Licenses based on Law Number 4 of 2009 concerning  Mineral and Coal Mining is owned by the Central Government, Provincial Government and Regency/City Government. Meanwhile, based on Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government the authority to issue  Mining Business Permits is owned by the Central Government and the Provincial Government. This article objective to discuss the implications of the regulation of mining business licenses that are not synchronized and efforts to synchronize the regulation of Mining Business Permits. This article is a descriptive analytical legal research. This research was carried out by the law approach. The data used are secondary data, namely the statutory provisions, the Regulation of the Minister of Energy and Mineral Resources, and the mining law literature with the technique of collecting study documents or library materials. So that the implications of these asynchronous arrangements can be resolved and the creation of an ideal Mining Business Permit arrangement.<br />Keywords: Synchronization; Implications; Mining Business Licenses; Investment.</p><p>Abstrak<br />Kewenangan penerbitan Izin Usaha Pertambangan berdasarkan Undang-Undang Nomor 4 Tahun  2009 tentang Pertambangan Mineral dan Batubara dimiliki oleh Pemerintah Pusat, Pemerintah  Provinsi, dan Pemerintah Kabupaten/Kota. Sedangkan berdasarkan Undang-Undang Nomor  9 Tahun 2015 tentang Perubahan Kedua Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah kewenangan penerbitan Izin Usaha Pertambangan dimiliki oleh Pemerintah Pusat dan Pemerintah Provinsi. Artikel ini bertujuan untuk membahas mengenai implikasi pengaturan Izin Usaha Pertambangan yang tidak sinkron dan upaya sinkronisasi pengaturan Izin Usaha Pertambangan. Artikel ini merupakan penelitian hukum doktrinal yang bersifat deskriptif analitis. Penelitian ini dilakukan dengan pendekatan undang-undang. Data yang digunakan merupakan data sekunder yaitu ketentuan perundang-undangan, Peraturan Menteri Energi dan  Sumber Daya Mineral, dan literatur hukum pertambangan dengan teknik pengumpulan data studi dokumen atau bahan pustaka. Sehingga implikasi dari pengaturan yang tidak sinkron tersebut dapat diselesaikan dan terciptanya pengaturan Izin Usaha Pertambangan yang ideal.<br />Kata Kunci: Sinkronisasi; Implikasi; Izin Usaha Pertambangan; Investasi.</p>

AbstractIn ius constitutum of Natural Resources, the liability of corporate criminal, in any case, has been set in fve laws. First, fsheries and forestry law have similar formulation that corporations act as makers–undertakers are convicted. Second, plantation law, corporations act as makers –the corporations are convicted. Third, environmental law, corporations as makers –the corporation and the orderer are convicted. Fourth, mineral and coal mining law, corporations as makers –the board and the corporation are convicted. Indeed, there are inconsistencies in the regulation of corporate criminal liability in natural resources sector resulting in legal uncertainty.IntisariDalam ius constitutum SDA, paling tidak pertanggungjawaban pidana korporasi diatur oleh lima undangundang. Pertama UU perikanan dan kehutanan memiliki rumusan yang sama bahwa korporasi sebagai pembuat–pengurus dipidana. Kedua, UU perkebunan, korporasi sebagai pembuat–korporasi dipidana. Ketiga, UU lingkungan hidup, korporasi sebagai pembuat–korporasi dan orang yang memberi perintah dipidana. Keempat, UU minerba, korporasi sebagai pembuat–pengurus dan korporasi yang dipidana. Tegasnya ada inkonsistensi dalam pengaturan pertanggungjawaban pidana korporasi di sektor SDA sehingga menimbulkan ketidakpastian hukum.

Indonesian mining industry have undergone impressive pace of development that dispute concerning overlapping on Mining Business License Area which triggers Mining Business License cancellation or revocation. One of such incidents occur between PT Kemakmuran Pertiwi Tambang and PT Wana Kencana Mineral, whereas both companies obtained Mining Business License for the same commodity on the same Mining Business License Area. How can legal certainty be relied upon concerning the Operation Production Mining Business License for holders of Exploration Mining Business License on the overlapped Mining Business License Area based on Mining Law and does the revocation conducted by the Governor of North Maluku has been in accordance with the applicable regulation? To answer both issues above, the author utilized normative qualitative analysis technique and interviews as supporting data. Based on Law No. 4 Th. 2009 concerning mineral and coal mining Article 46, every holder of Exploration Mining Business License shall reserve the right to obtain Operation Production Mining Business License and by using "first come first served" system, PT Kemakmuran Pertiwi Tambang should have the first right to obtain Mining Business License since they have obtained the Exploration Mining Business License in 2005. Meanwhile the revocation conducted by the Governor of North Maluku is clearly against the applicable regulations such as Law No. 30 Th. 2014 concerning Government Administration, Law No. 9 Th. 2015 concerning Regional Regulation, General Principles of Good Governance and Article 119 of Mining Law concerning the terms for Mining Business License revocation.

This report presents the results of the excavation of a stone ford laid across the base of a small stream valley near Rough Castle, Falkirk. It was discovered during an opencast coal mining project. Radiocarbon dates and pollen analysis of deposits overlying the ford combine to indicate a date for its construction no later than the early first millennium cal BC. Interpreting this evidence was not straightforward and the report raises significant issues about site formation processes and the interpretation of radiocarbon and pollen evidence. The importance of these issues extends beyond the rarely investigated features such as fords and deserve a larger place in the archaeological literature.
