El presente trabajo analiza la polémica existente en el ámbito penal en torno a la creación de un delito de acoso sexista callejero. En un primer momento, se estudia el fenómeno en sí, sus repercusiones victimológicas y los problemas que plantea la falta de regulación penal al respecto, en el ámbito de la Comunidad Europea y en España. A continuación, ante una eventual reforma del sistema jurídico español, se comentan las posibilidades que ofrece el Derecho comparado belga y francés, países cuyos Códigos penales han sido reformados para sancionar este fenómeno. Ambas iniciativas, aunque bien intencionadas, corren el riesgo de convertirse en papel mojado. This paper analyses the controversy over the phenomenon of sexist street harassment under a legal perspective. Firstly, this paper studies the phenomenon itself, its impact on the victims and the problems caused by the lack of Spanish and European penal regulation. Secondly, considering a possible Spanish penal system reform, we discuss the options that Belgian and French comparative Law offers to tackle sexist street harassment. These two countries have reformed their Penal Codes to sanction this phenomenon. Both initiatives, though well-intentioned, run the risk of becoming waste paper.

Este artículo de investigacióm pretende ser un estudio histórico-juridico del derecho penal que los españoles aplicaron a los indígenas de la Guinea española. Partiendo de la base de que el derectio penal guíneano-español se basaba, principalmente, en el reconocimiento de normas indígenas de tipo consuetudinario (derecho indígena), a través de sentencias judiciales y por adaptaciones del derecho metropolitano, usando como vehículo de expresión, así mismo, la jurisprudencia aplicada por los tribunales de raza españoles, se hace un amplio estudio de las penas que los españoles aplicaron a los indígenas, dividiendo la obra en dos parles: derecho para indígenas y derecho indígena.This work tries to be a historic-juridical study about penal law that spanish people applied to natives fron the spanish guinea. From the point of view that this law was, mainly, based on the knowledge of the natives rules about habits and native law, through sentences and the adaptation of the metropolitan law, using as mass media, the jurisprudence applied by the spanish courts, a huge study, is made about the punishments spanish people applied to natives. The study is divided in two parts: native law and law for natives.

‘Penal law’ reviews Islamic penal law, the most controversial aspect of Islamic law that often prompts heated debate about its applicability in contemporary times. Classical Islamic law classifies crimes and their punishments into three main categories: hudūd, qisās, and ta’zīr. Substantively, the hudūd and qisās offences are specifically prescribed in the Qur’an and/or the Sunnah, while the ta’zīr offences are left to the discretion of the ruling authority or judges. There are a number of evidential requirements and standard of proving criminal offences under Islamic law. The classical Islamic penal rules are now codified into the current penal codes of a few Muslim-majority states, with necessary modifications.

Though always present in penal codes, offenses based on belonging to a criminal organization occupy a vanguard position in today's evolution of penal law systems: organized crime is located at one of the most prominent places in the criminal policy agenda. Nevertheless, neither criminal law theory nor the actual content of criminal provisions nor the putting of theory into practice enables an adequate restriction of the interpretation of the laws against criminal organizations. Therefore we need to investigate the wrongfulness at the base of this offense. European legal scholarship has proposed two basic approaches: to consider that this offense anticipates the possibility of punishing and prosecuting such behavior (anticipation theory) or to consider that it harms a collective interest ("public security," "public peace"). From our perspective, it is necessary to underline the collective wrongfulness embedded in a criminal organization and that, beyond the actual crimes committed, it questions the monopoly of violence exercised by the state. It represents the constitution of a violent organization that counters the basis of state political organization (arrogation of political organization). This approach opens a possibility to adequately define the offense of belonging to a criminal organization.

The penal system cannot be characterized as the evidence that does not require explanations and justifications. Like any other open system it is influenced by many external and internal factors. The degree and nature of this influence cannot always be known and explained by means of analytics of a theoretical level. Not all problematic issues can be presented in a practical way. A large heuristic potential lies in the methodological tools of the philosophical level, which according to the authors of the article did not receive wide use in understanding the essence of phenomena and processes reflecting the activities of the penal system. The philosophy of the penitentiary law is the metaphenomenal basis for activities in the penal sphere. The article discusses the traditional problems of the penal system, which can be investigated using philosophical and legal tools. Attention is drawn to the need to form the criminal-legal outlook of the Russian Federal Penal Service staff and an integrated legal thinking that is impossible without mastering the philosophical level of knowledge of law. No science can do without philosophical grounds since their role consists in shaping the interpretative schemes necessary for understanding the essence of knowable phenomena. The purpose of the article is to substantiate the need to introduce into the educational process the discipline “Philosophy of penal law” or to consider questions of the philosophy of penal law in the framework of other disciplines traditionally included in the curricula of higher educational institutions of the Federal Penal Service of Russia. Among the problematic issues that accompany the activities of the penal system, which can be most fully considered in the framework of philosophical and legal approaches, should be called the transition from the punitive function of the penal policy to protective and humanitarian; the necessity of moralizing penal law; dual penal legal policy; penal security; the limits of liberalization of penal policy, etc.

The article is devoted to identifying the features of the relationship between the norms of administrative and penal law applicable in the implementation of disciplinary proceedings against employees of the penal system. The author tried to justify the appropriateness of bringing employees of the penal system to disciplinary liability for violation of penal law. The article analyzes the most common duties of employees, enshrined in the norms of criminal executive law, and cases of disciplinary liability for violation of these duties. It is concluded that such a “weave” of the norms of criminal executive and administrative law is regular when the former act as regulatory and the latter as protective norms.

RESUMEN: El pensamiento jurídico de Hegel se plasma en al menos tres obras publicadas en vida del autor, la Fenomenología del espíritu, la Enciclopedia de las ciencias filosóficas y la Filosofía del derecho. La complejidad al abordar el tratamiento hegeliano del Derecho en general y del Derecho Penal en particular radica fundamentalmente en una falta de consideración de su lugar sistemático en su obra y de su articulación con el resto del pensamiento hegeliano. En este trabajo, ofrezco una interpretación del fundamento del Derecho Penal que considere tanto la ubicación sistemática de lo jurídico como también aspectos generales del pensamiento hegeliano.ABSTRACT: Hegel’s legal thought has been considered in at least three works published while the author was alive: the Phenomenology of Spirit, the Encyclopedia and the Philosophy of Right. The main problem while considering Hegel’s treatment of Penal Law is based on a lack of attention to its systematic location on Hegel’s work and a lack of articulation between the legal subject and the Hegelian thought. In this paper, I offer an interpretation on the grounds of the Penal Law.
