High performance athletes participate and function in sports systems where exploitative behaviours may become manifest. These behaviours potentially violate an individual athlete’s human rights. Using the Capability Approach first outlined by Amartya Sen the paper details how a more precise analysis of human rights, in the context of high performance sport, may be achieved. Using in-depth narrative accounts from high performance athletes, data illustrate how athlete maltreatment is related to individual capabilities and functionings: the loss of individual freedoms infringes accepted notions of human rights. The implications for practice concern how human rights may be protected within and for systems of high performance production.

Abstract: This paper aims to make a theoretical review on the main approaches to Well-being and also introduce the subject of Responsibility as an element to be considered in this discussion. Thus, three theories of well-being are presented: the Mainstream Economics, the Happiness Economics and The Capability Approach. Each of them provides considerations about what matters for people’s life and social development. However, none of them contemplates individual responsibility as a relevant component for development. And only The Capability Approach takes account of responsibility, but without furthering the subject. In this sense, the theme of responsibility is defended as having an important role for development and well-being, and could be incorporated by The Capability Approach.

The relationship between prostitution, modern slavery and human trafficking is much debated in the academic literature. By contrast, discussion of children’s involvement in prostitution as a form of modern slavery and human trafficking constitutes a silent consensus. Drawing on the findings of a participatory study with girls and young women in Malawi, we prize open that consensus, illuminating the poverty of contemporary discourses that link children’s involvement in prostitution with modern slavery and human trafficking, and identifying a series of tensions that confound the development of conceptual clarity. We develop our argument by exploring the potential of the capability approach, rooted in principles of social justice and human rights, to offer an alternative understanding of children’s engagement and ongoing involvement in prostitution, and a critical lens through which to reframe the relationship between children, prostitution, modern slavery and human trafficking.

This paper departs from the discourse of the paradigm of social development in third world countries. The first discourse reviews the critics of the broad state in social development. It supports the non-state actors to take a part in development through corporate social responsibility (CSR). The second discourse departs from economic development which weakens the capability of the individual in achieving development itself. The concept of the capability approach in human development emerged as a solution to create inclusive welfare. This paper itself raises these two things in one discussion related to the role of CSR in relation to the development of human capabilities. Taking an analysis of the Program Desa Mandiri Energi by PJB UP Paiton, the study examines the role of CSR activities in supporting community capabilities. This paper argues that the existence of CSR provides a strong contribution to strengthening the capabilities of the community that has developed from the past. However, in the subsequent findings, there are several aspects of CSR programs that still several actions to be developed and improved human capabilities.

Purpose This paper highlights the integrative character of orthopedagogics. Quality of Life (QoL), as guiding the normative framework in orthopedagogics is explicitly connected with the framework of human rights and the capability approach (CA) in the quest for social justice and human dignity. The purpose of this paper is to question that how these three specific frameworks can cross-fertilize each other and result in the development of an integrated normative foundation for supporting people living in socially vulnerable situations. Design/methodology/approach This paper reflects on the question on how the human rights framework, the CA and the framework of QoL can be integrated in the support of people who find themselves in a socially vulnerable situation. Findings The core features of each framework are described. Originality/value To conclude the paper, commonalities and the added value of integrating these three frameworks are explored. By integrating these three frameworks, they could function as a shared agenda that gives direction to the daily actions of professionals, with attention for aspects at the micro, meso and macro levels. Each framework and their interrelatedness urge for an integrative approach of orthopedagogics where the strengths of different frameworks are recognized and used in order to support people in socially vulnerable situations to achieve a life worth living.

Part I, ‘Theoretical Perspectives’, which is structured in two chapters (Chapters 1 and 2), develops a new general theory of human rights planning including four sub-theories. The first sub-theory, contextual theory, is presented in Chapter 1. Chapter 2 is dedicated to the other three sub-theories. The first two sections propose the substantive and procedural sub-theories of human rights planning. Whereas the substantive theory of human rights planning provides the knowledge base to inform the content of planning, procedural sub-theory offers procedural principles for the formation, implementation, and assessment of human rights planning. The last section of Chapter 2 builds up a new analytical sub-theory of human rights planning through positive critique of the three major theories of rights, namely the interest theory, the need-based approach, and the capability approach. This analytical theory performs an heuristic role for human rights planning.
