Understanding the Prevalence of Violence against Women in New Zealand: Implications for Restorative Justice

Sport settings have great potential to influence social change and are therefore important locations to engage in the prevention of violence against women. The following study draws on in-depth interviews with 16 stakeholders who have been involved with the implementation of prevention programmes within competitive/team sport settings. A qualitative thematic analysis of the interviews was undertaken to examine how sporting organisations understand, strategise and practise prevention work in Australia and New Zealand. Implications for long-term changes in the prevention of violence against women are discussed with reference to key prevention actions and frameworks.

Women's refuges have existed in New Zealand since 1973 and today over two hundred various community and national level organizations work with victims and perpetrators of domestic violence, sexual assault, elder abuse, and child endangerment. New Zealand service providers and government officials view their work in the area of violence against women as part of an international effort with an obligation to uphold the Convention on the Elimination of All Forms of Discrimination against Women, or CEDAW as it is widely known, a treaty ratified by the country in 1985. While there is considerable governmental and nongovernmental support for those whose lives are touched by violence, there is also considerable tension over how to best design and deliver the services to those who need them. New Zealand is a diverse nation with a large indigenous population and growing Pasifika and Asian communities. Many of the recent debates center on how to best design programs for a multicultural population while still privileging the rights of the indigenous Maori. New Zealand's experience in addressing violence against women illustrates the disjunction between transnational discourses of violence against women, and the proposed international solutions to the problem, and the local efforts to help survivors from diverse cultural backgrounds. First, I will provide a brief description of how services are designed and delivered in New Zealand. Second, I will outline the main philosophical disagreements found among social service providers. Third, I discuss why research on the front-line has the potential to tell us a great deal about the limits of international treaties and enhance our response to violence against women.

A former police chief and a criminologist confirm a famous remark by Margaret Mead when they write: “The initiation of restorative reforms is often based upon the conversion of one key professional in a criminal justice agency.”New Zealand district court judge Fred W.M. McElrea personalized this rule in his account of how he stumbled on a restorative procedure in the case of a young man in Auckland, who was a Maori and son of a bishop, and who confessed to the crime of robbing a woman's purse. She happened to be a Quaker, and she appeared in court as a gesture of friendship for the offender. When the time came for sentencing, McElrea wondered out loud if there were a way for the young man to be monitored, without imprisonment, by some competent person who knew him. At that, Douglas Mansil, local Presbyterian minister, also present in the courtroom, stood and volunteered his services. Mansil had been the longtime “streetwise” pastor of a congregation in that Auckland neighborhood, known for furnishing the courts with more than a few youth offenders. Together with the Quaker victim of the crime, he kept track of the young man and reported regularly to the court. It was the beginning of McElrea's dedication to restorative justice (RJ) for young offenders in New Zealand. He and other judiciary leaders pay tribute to the influence of Howard Zehr's visit to New Zealand (NZ) in 1994 and Zehr's book, Changing Lenses, which McElrea first read during a sabbatical leave at Cambridge University. Zehr's book and his work in the U.S. had great impact on New Zealand legal officials, many of whom, like McElrea, often give him credit for inspiring shifts to RJ in their thinking about law, judicial process, and ethics.

In New Zealand, selected sworn police officers called youth aid officers participate in discussions and deliberations concerning the actions required to restore the sense of community balance upset by the actions of juvenile offenders. The author explores a representative sample of all sworn police officers serving in the New Zealand Police, including a subsample of youth aid officers, looking at the nature of support for the philosophical underpinnings of restorative justice and the likely impact of such work and values on officer attitudes toward the workplace. A 1996 management survey of all branches of the New Zealand national policing organization contained a number of specific questions that tap dimensions of both restorative justice philosophy and workplace orientations. This study represents a descriptive examination of these self-reported perspectives for all sworn officers, including breakdowns by selected personal-biographical variables. Implications for the implementation of restorative justice practices within a policing organization are discussed.

<p>During the mid-1980s, Māori families challenged New Zealand’s social welfare system, reclaiming their right to be involved in decisions about their children. Around the same time, parents and community groups protested the detention of hundreds of children in South Africa during the Apartheid era. These experiences helped shape both countries’ youth justice systems, which reflect restorative justice principles and international standards for children’s rights.  The research reported here is the first in-depth comparative analysis to compare New Zealand and South Africa’s journeys to alter their youth justice systems. It asks the following key questions:  ∙ What were the key conceptual influences that shaped youth justice transformation in New Zealand and South Africa? ∙ What do both countries’ experiences of youth justice transformation reveal about the role of individuals, advocacy coalitions, and international influences in shaping policy and practice?  Using a phenomenological research approach, key role players from both countries were interviewed. These interviews discovered that social entrepreneurial factors gave direction to policy outcomes. All participants described their commitment to changing the status quo following their exposure to the inhumane conditions experienced by children and young people in conflict with the law. This prompted them to promote policies that diverted children from the justice system and prevented re-offending while still holding children to account for their behaviour and encouraging them to repair the harm. The participants explained their motivation to find policy solutions that empowered children, families, and victims. In both countries, social entrepreneurs resisted opposition and joined forces to develop convincing arguments for their position. This research confirmed the advantages of government support to advance social entrepreneurial ventures.  Policy transfer was also found to play a role in the change processes in both countries. This study identifies how both New Zealand and South Africa have lent their policies internationally to contribute to practical youth justice changes in countries seeking to adhere to international standards and to incorporate restorative justice principles. Significant contributions include New Zealand’s family group conference, which has inspired several jurisdictions, as well as South Africa’s diversion programmes, which have particularly benefitted other African countries.</p>
