Abstract It is necessary for a MuftÊ to know the custom (Ñurf/ÑÉdat) of his people and place. Non awareness of custom will result in mufti’s fatwa not being at par with the problems and demands of the developing societies. This paper emphasizes the important role custom plays in sharÊÑah, essentiality of its knowledge for the jurists/muftis, and its significance in issuing fatwa (al-iftÉ’), while referring to the translation of Ibn ÑÓbidin’s SharÍ ÑUqËd Rasm al-MuftÊ (Commentary on MuftÊ’s Manual). The paper finds that there is no way out for a mufti to issue a fatwa, while ignoring the custom of his time. Fatwa is a tool for the evolution of sharÊÑah in dealing with the evolving worldly affairs, and guarantees the most suitable solution in changing circumstances, provided that the custom of the people are taken into consideration. Abstrak Ia adalah satu keperluan untuk Mufti mengenalpasti adat (Ñurf/ÑÉdat) orang dan tempatnya. Ketidaksedaran adat akan menyebabkan fatwa yang dikeluarkan mufti tidak setaraf dengan masalah dan keinginan negara yang membangun. Kajian ini menekankan kepentingan peranan adat dalam sharÊÑah, keperluan ilmunya bagi mufti untuk mengeluarkan fatwa (al-iftÉ’) sambil merujuk kepada terjemahan Ibn ÑÓbidin’s SharÍ ÑUqËd Rasm al-Mufti. Kajian ini mendapati bahawa tidak ada cara lain bagi seorang mufti untuk mengeluarkan fatwa tanpa memahami adat pada masanya. Fatwa adalah satu alat untuk syariah dalam menangani urusan duniawi yang berkembang, dan menjamin penyelesaian yang paling sesuai dalam mengubah keadaan, dengan syarat adat rakyat dipertimbangkan. The Impact

Informed by critical theory, this paper focuses on the dialectical interplay between law and economics evident in the practices and policies of the International Labour Organization (ILO). It is argued, first, that governments do not comply with international labour standards because of the inherent weaknesses of the ILO as the source and enforcer of international obligations. Second, the parochial politicization of rights defers to the arrogance of ignorance. Third, developing societies are overwhelmingly preoccupied with socioeconomic development. In exploring the impact of ILO practices on developing societies within the policies of the International Monetary Fund (IMF) and the World Bank (WB), this paper asks the following questions: to what extent does capital form and inform the law in relation to conflicting economic narratives of development and nationhood? How and why does the ILO talk up legal narratives of regulation and contest? How does law hegemonize capital integration? How does law symbolically function to mediate labour relations meanings and manipulate the inaction of civil society? Within the larger structure of “market forces,” the commodity of law is a complex form of social communication that diverts attention away from the political impact of predatory economies.

In most contemporary developing societies, the responsibility for directing broad social and economic change is assumed by the government. The success or failure of these government sponsored programmes often hinges narrowly on the degree of administrative capacity at the regional and local levels. Programmes which are otherwise well designed and funded at the national level may founder for lack of effective local organization.

One approach to the study of the growth and development of human settlements is through the analysis of changing residential patterns. The focus of this paper is upon the changing density patterns for Puerto Rico's three principal metropolitan areas from 1899–1970. The data show that San Juan's long-run residential deconcentration is consistent with the pattern usually displayed by cities in developed societies. The increasing congestion and stable concentration of Ponce and Mayaguez are consistent with the pattern found in cities in developing societies. Differences among the metropolitan areas are discussed in terms of the trajectory of Puerto Rico's economic development.
