Intellectual Property and Commercialization of the University

This paper describes the author's involvement in the early experiences of a start-up biotechnology company created outside the university environment. In this case, two self-employed, entrepreneurial scientists with no university affiliation developed commercializable intellectual property. Falling outside the more common university technology commercialization process, there were a number of issues that were quite different from those a typical university start-up company might face, and these are illustrated. Most importantly, this case is an exemplar of how other non-university entrepreneurs might contemplate utilizing universities to further their technology commercialization objectives.

Drilling through hard rock to explore for underground oil and gas is especially complicated in geographic areas where the sub-layer is full of dense and impenetrable rock. Charlie Scent, an Engineering Professor working at a university, undertook research to solve this dilemma and developed a solution after approximately 20 years of effort. To commercialize the technology, Scent collaborated with one of his PhD students and formed a company. Through the commercialization process, friction developed among the participants—Scent, the graduate student, and the university. This discord brought to light several important questions regarding intellectual property that is created in a university setting. This case is about who owns intellectual property and decreasing the probability that there will be friction between the individuals who are at the heart of an invention.

<p class="AbstractText">Learning management systems (LMS) play a central role in communications in online and distance education. In the digital era, with all the information now accessible at students’ fingertips, plagiarism detection services (PDS) have become a must-have part of LMS. Such integration provides a seamless experience for users, allowing PDS to check submitted digital artifacts without any noticeable effort by either professor or student. In most such systems, to compare a submitted work with possible sources on the Internet, the university transfers the student’s submission to a third-party service. Such an approach is often criticized by students, who regard this process as a violation of copyright law. To address this issue, this paper outlines an improved approach for PDS development that should allow universities to avoid such criticism. The major proposed alteration of the mainstream architecture is to move document preprocessing and search result clarification from the third-party system back to the university system. The proposed architecture changes would allow schools to submit only limited information to the third party and avoid criticism about intellectual property violation. <br /><br /></p>

Research universities receive increasing amounts of income from intellectual property, which makes institutional conflict of interest (ICOI) policies increasingly important. We analyzed the content and scope of ICOI policies at 60 research universities in the U.S. Association of American Universities. In particular, we focused on the following categories: Disclosure, review, management, and prohibited or constrained activities. Most of the plans were relatively unelaborated, but 8 were elaborated “university as firm” policies that addressed the way officers and managers acting as agents for the university handled commercial activity through an array of management tools. However, even elaborated current ICOI policies may not be sufficient to manage ICOI because this type of commercial activity is not routine for universities in that faculty discovery or creation of intellectual property is not predictable. Thus, nearly all ICOI is managed on a case-by-case basis by various committees or senior institutional officials. As a result, institutional policy is only as strong as these committees and officers and the management plans they develop and monitor to handle conflicts.

During the working process new knowledge is activated which is based on analytical skills and critical reasoning.Maintaining academic standards in the paper makes it more fruitful because it gives the reader a sense that the author of the paper depends on reliable academic sources to support his or her own reasoning and position.The completed paper will be checked for plagiarism. There are numerous programs which reveal the originality of the work. After all, there is a big temptation of plagiarism in the papers.Preventing plagiarism offers to protect someone else’s intellectual property and make the student aware that he or she has to respect the rights of intellectual property and distance himself or herself from plagiarism. Avoiding Plagiarism in the paper is possible if the student has been clearly informed about the mechanisms or responses that plagiarism may cause in his or her work. Awareness is largely responsible for preventing plagiarism, however, only the moral part of the problem is not enough. We need to pay more attention to proper implementation of the academic techniques in the academic environment.
