This paper explores the post-Dayton property regime in Bosnia, as one tool for facilitating return of displaced persons and refugees. Implementation of post-Dayton property laws, intended to facilitate return, is explored, and few successes are found. Reformed property laws—subject of much attention and chief drain on resources of the international community—remain a legal framework on paper only, and have not delivered minority return. In conclusion, the international community must expand its focus beyond minority return, to the broader concept of “durable solutions.” Acknowledging that some displaced persons will not wish to return to their home of origin, the international community should engage in parallel efforts to provide solutions to those who genuinely wish to relocate.

The restoration of the pre-war property fights of displaced persons and refugees is critical to restore the peace.This is particularly true for Bosnia and Herzegovina. The devastating impact of the war which ravaged Bosnia from 1992 until 1995 has left a third of the housing stock destroyed or otherwise uninhabitable. The systematic practice of ethnic cleansing forced Bosniacs, Croats and Serbs to seek shelter in areas of Bosnia and Herzegovina where their ethnic group was in the majority or to seek refuge abroad.1 More than half the 4.5 million the pre-war population of Bosnia and Herzegovina fled their homes in search of safety during the course of the war. According to recent estimates from the UN High Commissioner for Refugees, over 800,000 refugees from Bosnia and Herzegovina are still abroad today.2 Within Bosnia and Herzegovina, more than 800,000 people remain displaced from their pre-conflict homes.3

<p>The issue of Internally Displaced Persons (IDPs) is a global crisis yet little research has been focused on the issue of the livelihoods of IDPs. Providing short-term emergency assistance is not enough when the period of displacement becomes permanent or longer than expected. IDPs need long-term solutions in order to resume a normal life. Pursuing appropriate livelihoods in urban areas is a big challenge yet constructing potential livelihoods is fundamental to achieving decent living not only for short-term situations but also for the long run. The lack of access to livelihoods is one of the most serious obstacles to durable solutions for IDPs, and long-term livelihood strategies are needed to lay the foundation for future development.  This study explores Kachin IDPs in Myanmar and their livelihood strategies and activities in urban camps by applying qualitative methods, the study focuses on how IDPs have been building their livelihoods during their displacement and who has been involved in supporting their livelihoods. This research also seeks insight into the effectiveness and sustainability of those livelihood activities and other potential strategies.   Results show that most livelihood activities are supported by both local and international humanitarian and development agencies and are mainly undertaken through local organisations. Agriculture and livestock rearing are preferred livelihoods of IDPs although getting appropriate land is challenging in urban areas. Income-generating programmes such as food processing, carpentry and bamboo handicrafts are also popular and successful activities. Moreover, tailoring, brick making, and pig rearing are also effective and helpful livelihoods for individuals. Those who are involved in livelihood support activities receive benefits and advantages for their family and daily needs while the majority of IDPs are working in day labouring. Respondents believe current livelihood activities can become sustainable as long as they maintain the quality of the products. Some IDPs have adapted to the city environment quite well by applying their capacity and the skills they learnt from humanitarian organisations. Supporting livelihood strategies may not resolve the problems of IDPs, however, it is an effective partial solution.</p>


Property asset management can be defined as the process of decision – making and implementation relating to the acquisition, use, and disposition of real property. This definition applies to both the private and public sectors, even though in the government sector, the term itself was not in common usage until recently. Over last two decades, however, a new discipline has emerged that looks more critically at the important component of public wealth and seeks to apply standards of economic efficiency and effective organizational and resource management. Public sector property management has been regarded as a structured process that seeks to ensure best value for money in serving the strategic public sector needs and enhancing the economic development and competitiveness. There are governments that are only beginning to seek improvements in the management of publicly owned property with a goal of putting into use various types of government asset items, under the supervision of professional management, with a view to ensuring quality public services and welfare to the citizens, governments that have just recently embarked in the long term financial management reforms and strategic public sector property management reform in particular, and governments called “advanced reformers” offering their conceptual and valuable practical experience in the sphere of public property management. Starting from the concept that public authorities have to be fully accountable to the public and that the whole of government assets need and can be effectively managed, and widely accepted thesis that effective government asset management is a very important generator for creating a supportive entrepreneurial environment, and raising the competitiveness of the entire economy, in this paper we analyse the drivers of international property management reforms in the public sector and provide a comment on public sector property management in developed countries and (post) transition countries. Then we analyse the characteristics of commenced public sector property management reform in Croatia which may be considered as challenges ahead of Bosnia and Herzegovina authorities in structuring their national public sector property management reform, given the current state of play.

More than one person can have a relationship with the land and share the right to possess it. The right to possess a land is known as ownership right, but it is also common for people to have enforceable rights in other people’s land. This is the third party right, an example of which is where the owner of a house in a residential area agrees with neighbours that the house will only be used as a residence. This chapter discusses land and property rights, ownership rights, third party rights, and conveyancing. It also examines the distinction in English law between real property and personal property, the meaning of land, items attached to the land, fixtures and fittings, and incorporeal hereditaments.
