Towards a Pro-active Approach Concerning the Intersections between the Jordan Patents of Invention Law, United States Patent Law and European Patent Convention

AbstractAttempts to harmonize patent laws worldwide have increased, leaving bits of argumentative issues untouched in the patent systems under scrutiny. However, diversity can sometimes prove desirable since majority rule is not always right and the minority wrong. Sometimes a part is more righteous than the whole. This research focuses on areas where the Jordan Patents of Invention Law, United States Patent Law, and the European Patent Convention intersect. It concludes that although most countries, including Jordan, follow a different path than that taken by the United States, it may be unnecessary for the United States to change its system in order to be in sync with the rest of the world. Thus, it may prove advantageous to have two separate systems that can provide different patent protections where humanity achieves progression and development.

A doença de Chagas é endêmica, principalmente, em países de clima tropical sendo relacionadas à pobreza e ao baixo desenvolvimento, afetando milhões de pessoas no mundo. No Brasil, de 1,8 a 2,4 milhões de indivíduos devam estar na fase crônica da doença, 1/3 deles na forma cardíaca e digestiva. Este trabalho objetiva analisar o grau de desenvolvimento tecnológico através da prospecção tecnológica sobre o diagnóstico da doença de Chagas em busca  de  patentes e artigos.  Para a busca e  análise das patentes utilizaram-se  as bases de dados do Instituto Nacional da Propriedade Industrial (INPI),  “European  Patent  Convention”  (EPO), “The  United  States  Patent  and  Trademark  Office” (USPTO), “Word intellectual property organization” (WIPO) e “Esp@cenet-Latipat” (LATIPAT). Para os artigos científicos a base de dados usada foi a “Web of Science”. As patentes mostraram que os biomarcadores são mais protegidos para diagnosticar a doença de Chagas, as publicações de artigos científicos sobre o tratamento e diagnóstico foram expressivas no Brasil, com destaque para Fundação Oswaldo Cruz. Assim, a prospecção destaca um mapeamento, de artigos na base de periódicos “Web  of  Science” de 2005 a junho de 2015, além patentes que estavam depositadas nos bancos já mencionados acima na data de 10 de junho de 2015, aplicado para o diagnóstico da doença de Chagas.

The remarks made in this paper are due to the action of the United States Patent Laws, as interpreted by one of the examiners, whose duty it was to adjudicate upon the practicability of an invention submitted to him, and whose decision was adverse to the granting of a patent. Protection was solicited for an improvement upon a previously patented mechanical aërial machine, the success of which had been proved by the inventor through the action of a model. The patent was refused on account of the alleged impracticability of the invention owing to the absence of gas as a supporting, or partly supporting, medium. Total misapprehension of the principles of flight is displayed whenever the balloon is recommended to take off part of the weight of any mechanical arrangement. However successfully the pure mechanical action may have proved itself in the conveyance of weights in the air whilst in the model form, the principle seems to be distrusted by some when proposed for extreme weight. But it fortunately happens that the resistance of the air to a body in motion, upon which we depend for success, bears a greatly increasing ratio to the extent of surface which that body assumes.

The right to appeal exists as a response to the two main characteristics of every human being. The first refers to the attitude of not settling for adverse decisions, which leads people to seek instruments to remediate these decisions, while the second is the possibility that every human being has to make mistakes and the need to correct these mistakes in decision-making acts that may have been mistaken. Therefore, an appeal is an instrument that enables review of a decision by a higher authority to obtain its modification or revocation. In the patent system, appeals are used basically to reverse decisions of patent examiners during the examination procedure as, for example, the decision to reject a patent. Although all patent offices have procedures for appeal against first-instance decisions taken by these offices, there are significant differences as to how this procedure is conducted in each office. This chapter will study the laws and regulations, rules and procedures on appeals in two of the main patent offices in the world – the European Patent Office – EPO and the United States Patent and Trademark Office – USPTO, and in the Brazilian Patent Office – INPI, pointing out the main differences between them.

Analisar as patentes existentes nas modalidades de invenção ou modelo de utilidade, quanto à titularidade, nacionalidade e sua inserção no mercado. Foi realizada revisão bibliográfica da literatura, empregada na busca de documentos de patentes. Os dados foram coletados em base de dados gratuitos (USPTO) United States Patent and trademark oficce, (INPI) Instituto Nacional da propriedade intelectual e (EPO) European Patente Oficce. Foi realizada a seleção dos documentos de interesse através de análise de seus resumos. Foram encontradas 32 patentes de invenção. Em relação ao registro, 28 patentes registradas por pessoa jurídica e 28 patentes encontram-se inseridos no mercado. Prevaleceu o maior número de patentes nos Estados Unidos, totalizando 13. A análise de patentes demonstra uma ferramenta importante de interesse de mercado de empresa em relação à prevenção e tratamento de lesão por pressão.Descritores: Cuidados de Enfermagem, Lesão por Pressão, Tecnologia Biomédica. Patents available for prevention and treatment of pressure injuryAbstract: Analyzing the existing patents in the modalities of invention or utility model, including the ownership, nationality and its insertion in the market. Abstract Background: Tissue engineering takes on many approaches. It is mostly followed by those in the field through scientific literature. However, there is a virtually untapped resource in patent literature. Objective: This review focuses on patents through the United States Patent and Trademark Office (USPTO). This source is used only because the author is most familiar with this resource. This article is not intended to be instructional regarding patents, patent law, or how to apply for patents, nor is it intended to be all inclusive of the patent literature. However, the reader might see the value of following the patent literature as a source of ideas, technologies, methodologies, and knowledge with respect to tissue engineering.
