Keywords: results of work, subjects of property rights of intellectual property, jointproperty rights of intellectual property The article deals with an issue of allocation of rights to the results ofworks that are intellectual property subject-matter, created during research or developmentand engineering works. It is considered what can be the result of works andin what form.It analyses problematic issues of the multiplicity of subjects of intellectual propertyrights to the results of work under the contract and the relationship between themon the prosecution of the joint intellectual property rights to the results of work. It isdetermined that the subjects of contractual relations of research or development andengineering works in addition to the executor and the customer should also includethe creator (author, inventor) — a specialist working in a research institution or in acompany, whose creative work resulted in the intellectual property subject-matter.Attention is drawn to the joint rights to service subject-matters created as a consequenceof labour-related duties execution.The norms of special legislation on the relationship on the use of an invention(utility model) and an industrial design, the disposal of property rights of each of theholders (owners) of a patent (certificate) are studied.Laid out in the article gives the ground for making conclusion about the need to supplementthe regulation of relations on the prosecution of the joint intellectual propertyrights to the results of work by including general provisions on the procedure for the useof intellectual property subject-matter and disposal of property rights on conditions establishedby the contract for research or development and engineering in Article 896 ofthe Civil Code of Ukraine. The author proposes to supplement Article 896 of the CivilCode of Ukraine with Chapter 3 as follows: «3. If the results of works have features ofintellectual property subject-matter, then special details of prosecution of propertyrights of intellectual property can be provided in the contract».

The eco-friendly certification system is designed to ensure safe agricultural products to consumers while minimizing environmental pollution. However, despite its advantages, it is not widely adopted due to a possible decrease of farmers’ income. In order to provide implication for activating the eco-friendly certification system, this paper examines the attributes of green tea which affect consumers’ preferences and estimates consumers’ willingness to pay (WTP) for the eco-friendly certification in China. A choice experiment survey is employed for data collection, and the random utility model is used to estimate the preference for the certification and quality of green tea. The attribute that yields the highest marginal WTP turns out to be the organic certification for which WTP is $115.9/250g higher than for no certification. Also, the analytical results indicate that the group with high trust is willing to pay up to $214.6/250g more for green tea with organic certification compared to the one with no certification. The empirical results suggest that it is important to build the consumers’ awareness and trust toward the certification to activate the eco-friendly certification system.

Нами получен патент на полезную модель Республики Казахстан №5782 от 22.01.2021, который с большой эффективностью используется для обрезания крайней плоти. Для отсечения листков крайней плоти применяется устройство для пирографии Stayer, снабженный трансформатором, генерирующий напряжение от 0 до 5 В., с частотой тока 50Гц, мощностью 40Вт., с твердым рабочим наконечником, регулируемым температурой от 450ºС до 750ºС. Применение устройства для пирографии Stayer для обрезания крайней плоти позволяет сократить время оперативного вмешательства, уменьшить травматичность воздействия и улучшить косметический эффект. За 2018-2020 годы было выполнено 500 операций с применением устройства для пирографии Stayer. При этом, среднее время операции составляло 10 минут. У всех детей достигнут хороший непосредственный и отдаленный клинический результат. We have obtained a patent for a utility model of the Republic of Kazakhstan №5782, 22.01.2021., which is used with great efficiency in circumcision of the foreskin. To cut off the foreskin sheets, a Stayer pyrography device is used, equipped with a transformer that generates a voltage from 0 to 5 V., with a current frequency of 50 Hz, a power of 40 W., with a solid working tip, adjustable temperature from 450 ° C to 750 ° C. The use of the Stayer pyrography device for circumcision of the foreskin allows you to reduce the time of surgical intervention, reduce the traumatic impact and improve the cosmetic effect. In 2018-2020, 500 operations were performed using the Stayer pyrography device. The average operation time was 10 minutes. All children achieved a good immediate and long-term clinical outcome.

AbstractGreen entrepreneurship has been increasing with growing attention to environment protection by a variety of stakeholders. Green innovation, as the essence of green entrepreneurship, has attracted a broad range of scholarly attention with yet inconclusive findings regarding its effect on firm performance. According to our analyses of 1667 firms listed on SME board and GEM in China during the period from 2010 to 2019, we find interesting results regarding the type of green innovation involved and the moderating effect of firm age on the link between green innovation and SME performance. More precisely, we find green utility-model innovation positively influences firm performance for SMEs, whereas green invention innovation does not contribute to firm performance overall. More interesting, our empirical results suggest that older firms benefit more from both green invention innovation and green utility-model innovation than younger firms. This research contributes to the literature on green entrepreneurship as well as green innovation.

The utility model is a new form for the protection of inventions introduced in the Croatian law by the Patent Act of 2020. It entitles the utility model owner to exclusive right to use and dispose of the invention that is the subject of protection from the date of publication of the utility model registration. The utility model protection validity is ten years from the date of submission of the utility model application, with the payment of the annual maintenance fee. The utility model registration procedure is initiated by a special application. The State Intellectual Property Office examines its conformity with the law and does not examine the novelty, inventive step and industrial applicability of the invention. It does not compose the search report of the state of the art. Certain inventions cannot be protected by the utility model. The Patent Act allows branching off a utility model application from a patent application for the same invention. It also allows conversion of the patent application to a utility model application and vice versa. The utility model owner may request a full examination of the protected invention by the State Intellectual Property Office and conversion of the utility model into a patent. This request may be submitted no later than the end of the seventh year of the validity of the utility model protection. Third parties may request the declaration of nullity of the utility model during the whole period of its validity. The utility model owner is not entitled to sue the persons who infringe his exclusive rights.

In this study, the product attributes of cruise tours are distinguished into on-board activities, leisure space, cabin comfort, Michelin restaurant, and refund mechanism, and the multi-attribute utility model of cruise tours is constructed using the choice experiment (CE) method. Of the 575 questionnaires distributed, 439 were valid, with an effective recovery rate of 76.3%. The results revealed the following: (1) when cruisers travel, what they value the most is the quality of service on board, followed by the facilities on board; (2) passengers’ preferences for comfortable pool space and more activities on board are negatively significant, indicating that they do not prefer to add these amenities and experiences to the cruise ship; (3) passengers are willing to pay extra to upgrade the interior cabin to one with a view and to experience the Michelin restaurant; and (4) influenced by the COVID-19 pandemic, cruisers are more willing to manage their own health. Moreover, the pandemic does not reduce their willingness to travel by cruise.
