Religious Socialisation and Values as Predictors of Human Rights Attitudes. An Empirical Study among Christian and Muslim Adolescents in Germany

Climate change raises the stakes of human communication to the existential level of the species and the planet. This article presents an empirical study of how users make sense of climate change as they traverse the contemporary digital media environment. Departing from a baseline survey and drawing on the tradition of reception analysis, focus groups of different ages and with various political and religious affiliations identified distinctive themes, narratives, and arguments regarding the natural environment as represented and received across different media. Climate change appears out of scale – incommensurable not only with established media formats and genres but also with common frames of human cognition and communication. In conclusion, the article addresses climate change from the perspective of human rights and social justice, under the recent heading of climate justice.

يتطرق البحثُ لمشكلةٍ قانونيةٍ كبيرةٍ ظهرت مع تفشِّي جائحةِ كورونا في العالم؛ وذلك عندما قامت الدولُ باتخاذِ إجراءاتٍ صارمةٍ - لوقايةِ الشعوب من المرض- نالت من حقوقِهم الإنسانيةِ المقررة في كافةِ المواثيقِ والعهودِ الدوليةِ لحقوق الإنسان، كحق التنقل، والعمل، والرعاية الصحية، بل أدت إلى تعطيلها بالكلية؛ مما أحدثِ تضاربًا فيها بين الإباحةِ القانونيَّةِ والمنعِ من السلطات، يجدُرُ حلُّها وإيضاحِ الحقِّ المشروعِ لكلا الطرفين (الدولة والمواطن). فهل من حق الدولِ إيقافُ حقوقِ الإنسانِ أو بعضِها للدواعي الصحيةِ الطارئةِ؟ وقد اتبَع الباحثُ في هذه الدراسةِ المنهجَ التحليليَّ الوصفيَّ النَّقديَّ، وذلك بعرضِ نصوصِ حقوقِ الإنسانِ الدوليةِ، ومقارنتِها بالشريعةِ الإسلاميَّةِ، ومقارنةِ ذلك أيضًا بالقانون السعودي، وعرضِ ما قامت به السعودية من جهودٍ لاحتواء الأزمةِ. وقد توصَّل الباحث إلى نتائجَ أهمُّها: أنَّ للدولِ الحقَّ الكاملَ في الحَدِّ من حقوقِ الإنسانِ، أو إلغاءِ بعضِها واتخاذِ كلِّ ما تقضي به الأوضاعُ في حالاتِ الطوارئِ والأخطار، كالحروبِ والأوبئةِ المعديةِ الخطرةِ، وذلك لأمدٍ محدَّدٍ معلنٍ، كما للدول الحقَّ في إجبارِ الأفرادِ على القيامِ بأمرٍ قد ينالُ من حقوقهم الإنسانيةِ، وفقًا للشروط التي حدَّدتها المواثيقُ الدوليةُ. وأثبتَ البحثُ أسبقيةَ الشريعةِ الإسلاميةِ في اتخاذ الإجراءات الاحترازية في حال الأوبئة المعدية، ونجاحَها في الحدِّ من انتشارها والقضاءِ عليها، وليس من حقِّ الجهاتِ الصحيَّةِ التَّمييزُ بين المتلقين لخدماتها، أو حرمانُ بعضِهم، لأيِّ اعتبارٍات، كما برز تفوقُ الجهازِ الصحيِّ السعودي، واستيعابَه لجميعَ حالاتِ كورونا رغم كثرتها، وتماسُكَهُ من الانهيارِ بالتضافر مع الأجهزة الصحية الأخرى، مع مَجَّانيَّةِ العلاجِ؛ مما حقَّقَ حالات شفاءٍ تجاوزت  92% وتجدرُ أهميةِ إجراءِ بحوثٍ علميَّةٍ حولَ الجوانبِ الجنائيَّةِ للأزمةِ بمحاولةِ بعضِ المصابين نشرَ المرضِ في الأماكنِ العامة، والتطرق للآثارِ الاقتصاديةِ للجائحةِ.

Resumo: Buscamos determinar, neste artigo, como vivem as mulheres obrigadas a cumprir pena restritiva de liberdade ou a trabalhar na Penitenciária Feminina Madre Pelletier. Essa pesquisa qualitativa utilizou, para tanto, metodologia baseada no estudo empírico da realidade prisional; os dados foram obtidos em 2015, com a realização de um grupo focal com cinco apenadas e a aplicação de questionário a 14 agentes penitenciárias, além da coleta de impressões em outras pesquisas dos autores, bem como na experiência de um dos pesquisadores, que trabalha há mais de cinco anos no local. Além disso, utilizamos como fonte, entre outros, registros em livros da instituição e bibliografia pertinente. Concluímos que, com o fim da superlotação, em 2012, a qualidade de vida melhorou para ambos os grupos. Isso porque na época da superlotação carcerária as relações interpessoais entre presas aconteciam com mais violência (provocada por lideranças que impunham regras). Logo, ainda que o sistema prisional continue a violar direitos humanos das presas, hoje mais direitos são respeitados do que quando existia superlotação.Palavras-chave: Direitos humanos; Criminologia; Prisões; Penitenciária feminina Madre Pelletier; Superlotação. Abstract: We seek to recognize, in this paper, the conditions of the daily lives of women who have received prison sentences and those who work in the Women's Penitentiary Madre Pelletier. Therefore, this research uses a qualitative methodology based on an empirical study of the prison’s reality; data were obtained in 2015, with the use of a focus group with five prisoners and questionnaire to 14 prison officers, as well as collection of prints in other studies and the experience of one of the researchers, who has been working there for more than five years. In addition, we use as a source, among others, records in the institution’s books and relevant bibliography. We conclude that, with the end of overcrowding in 2012, the quality of life improved in both groups. Before, interpersonal relationships between inmates happened with more violence (caused by leaders who imposed rules). Thus, even though the prison system continues to violate human rights of the arrested, more rights are respected today than when there was overcrowding.Keywords: Human rights; Criminology; Prisons; Madre Pelletier Women’s Prison; Overcrowding.

This juridical normative and empirical study is conducted with the aim at analyzing the relationship between corruption and human rights violation. Two issues shall be discussed, i.e. what factors inhibits the use of human right approach in corruption cases and what changes can be made to the criminal justice system, especially in relation to the penal judgement. One factor inhibiting the use of a human right approach in handling corruption cases in the perspective of treating corruption as pure criminal act wholly unrelated to violation of human rights.  To rectify this situation and accommodate this human right approach, the author recommends to prioritize and use fine which basic value is social welfare.  Court decision in corruption cases, in addition, should when evaluating elements of crime charges, explicitly describe those rights of the victims which are violated and use this consideration in determining what penal sanction are to be given.

Non-governmental organisations often accuse multinational corporations of exploiting the various legal environments in different countries to their advantage in order to avoid the assumption of responsibility for human rights violations or environmental disasters. This empirical study shows that non-governmental organisations (NGOs) can, by employing various instruments, increase the likelihood of multinational corporations accepting social and environmental responsibility for their actions. These instruments, ranging from dialogue to scandalisation, are intended to influence corporate behaviour and their use depends on the pressure the NGO wishes to exert on a particular company. All instruments need careful research and the gathering of evidence, including witness statements. To gain public attention the information must be well prepared for the media, resonate in the corporation's domestic market, stimulate concern and be up-to-date. The most promising activities are those that emphasise that economic success could be compromised to the key decision makers within the company.
