The digitalization of trade is a reality, and yet the regulation of the world trading system as embedded in the World Trade Organization (WTO) only tangentially, if at all, touches upon this issue. True, digitalization of the economy, the fourth industrial revolution as it is colloquially referred to, is a recent phenomenon, and to some extent post-dates the conclusion of the Uruguay round agreements (1994). True also, however, is the reality that the world trading system has shown a remarkable inability to adjust to modern business realities in its multilateral rule architecture. To the extent these transformations are being reflected in new rules, they are being introduced in regional or bilateral frameworks, albeit in an incomplete fashion. It is also the case that the world is witnessing several different regimes around data and information economy developing in the world today – most notably in the US, Europe, and China. As always, part of the reason that international frameworks have not been born stems from the fact that international rules rarely occur before domestic regulatory and legal regimes are well developed.

The article deals with the features of the Russian policy of agriculture support in comparison with the EU and the US policies. Comparative analysis is held considering the scales and levels of collective agriculture support, sources of supporting means, levels and mechanisms of support of agricultural production manufacturers, its consumers, agrarian infrastructure establishments, manufacturers and consumers of each of the principal types of agriculture production. The author makes an attempt to estimate the consequences of Russia’s accession to the World Trade Organization based on a hypothesis that this will result in unification of the manufacturers and consumers’ protection levels in Russia with the countries that have long been WTO members.

The outlook for world growth this year has deteriorated since April, due to a sharp contraction in world trade in the first quarter of the year and failure to sustain the revival in private sector investment seen in the fourth quarter of 2002. We have as a consequence revised our projections for world growth this year down by ¼ percentage point. This reflects sharp downward revisions of ½–¾ percentage points in the Euro Area and Canada, both of whose exchange rates have continued to appreciate in effective terms, while the outlook for the US and Japan is broadly unchanged. Growth in Japan and the Euro Area stagnated in the first half of 2003, with recessions in Germany, Italy, the Netherlands and Austria appearing likely. The US and Canada, on the other hand, continued to expand, albeit more slowly than in the second half of 2002. Following two years of exceptional weakness, Latin American growth has started to revive, although Venezuela is still suffering from the 2 month stoppage in the oil industry earlier this year and Argentina has lost competitiveness due to a strong appreciation against the dollar. Growth has slowed in several Asian economies, notably South Korea, but China continues to expand rapidly, spurred by the competitiveness impact of the dollar depreciation and infrastructure preparations for the 2008 Olympics. This has helped sustain export growth from the rest of Asia despite the more widespread slowdown in world trade.

Revolusi industri di Inggris pada sekitar abad 18 telah mengubah dunia secara drastis. Teknologi telah mengambil alih peran manusia dalam memenuhi kebutuhan hidupnya terutama dalam hal mengatasi ruang dan waktu. Temuan-temuan besar seperti mesin uap, mesin cetak dan lain-lain membuat para inventor dan perusahaan besar mulai sering memamerkan hasil-hasil temuan mereka. Namun, bersamaan dengan ditemukannya teknologi industri timbul kekhawatiran bahwa ada kemungkinan ide atau gagasan-gagasan mereka dicuri oleh pesaing-pesaing bisnis mereka atau orang yang akan menggunakannya tanpa ijin dan mengambil keuntungan pribadi, tanpa memperhatikan hak-hak penemu, sehingga mereka enggan ikut dalam pameran-pameran internasional (world fair) . Sejak saat ini dia antara mereka timbul kebutuhan perlindungan hak hasil kekayaan intelektual. Kebutuhan perlindungan atas suatu desain industri mulai dikenal sekitar abad ke 18. Kebutuhan perlindungan hukum ini dimotori sekelompok profesional,Patent Lawyers yang sedang berkumpul di Vienna, Austria dalam suasana Vienna World Fair pada tahun 1873. Pada 1883 mereka mengadakan konvensi di Paris yang kemudian dikenal dengan The Paris Convention for the Protection of Industrial Property. Saat ini Paris Convention mengakomodasi perlindungan penemuan-penemuan di bidang industri seperti hak atas paten, merek, rahasia dagang, desain tata letak sirkuit terpadu, indikasi geografis, varietas tanaman termasuk desain industri.Dalam pertemuan Putaran Uruguay di Marrakes, Maroko 1994, Indonesia hadir dan menandatangani The Final Act Embodying the Results of The Uruguay Round of Multilateral Trade Negotiations yang menghasilan dibentuknya organisasi perdagangan dunia (World Trade Organization). Moment ini mempunyai arti yang luas dan dalam bagi Indonesia, baik secara politis, ekonomi dan hukum. Selain menjadi anggota WTO yang mempunyai hak-hak sebagai anggota juga kewajiban-kewajiban antara lain mentaati seluruh keputusan-keputusan yang diambil organisasi ini. Di dalam lampiran The Final Act terdapat lampiran Trade Releated Aspect of Intellectual Property (Aspek-aspek dagangan kekayaan intelektual). Dampak dari hal itu ada kewajiban bagi negara anggota untuk melakukan harmonisasi peraturan-peraturan termasuk peraturan kekayaan intelektual. Maka, pada tahun 2000, pemerintah Indonesia menerbitkan beberapa peraturan HKI, yaitu Undang-Undang No. 29 tahun Tentang Varietas Tanaman; Undang-Undang No. 30 Tahun 2000 Tentang Rahasia Dagang; Undang-Undang No. 31 Tahun 2000 Tentang Desain Industri; Undang-Undang No. 32 Tahun 2000 Tentang Desain Tata Letak Sirkuit Terpadu.Dengan judul Desain Industri Sebagai Seni Terapan Dilindungi Hak kekayaan Intelektual secara yuridis normatif akan dijelaskan bahwa suatu desain selain dapat dilindungi hak Desain Industri juga dapat dilindungi dengan hak cipta. Dalam tulisan ini akan diangkat tentang apakah suatu desain dapat dilindungi dengan hak cipta? Bagi seorang pendesain perlindungan hak apa yang akan dipilih untuk melindungi hasil desain suatu produk?

There are now widespread signs that activity in the world economy has begun to recover steadily from the pause in growth apparent at the beginning of 1996. Output rose by 0.6 per cent in the North American economies in the third quarter of last year and by 0.8 per cent in Europe. Business and consumer sentiment has improved gradually in recent months in most of the major economies. We expect world economic growth to pick up further over the course of this year as the contractionary effects from the downturn in world trade and prolonged inventory adjustment come to an end and as the effects from a more relaxed monetary stance begin to outweigh those from ongoing fiscal consolidation. Recent currency movements should help to stimulate external demand in Germany, France and Japan, but may act to constrain growth within the UK, Italy and the US. For both this year and 1998 we expect growth of around 2½ per cent per annum in the OECD economies.
