The Rationality on Regulation of Village Government Function on First-Time Land Registration to Form the Land Ownership Certainty in Indonesia

This article aimes to find the rationality on the regulation of village government function on the first-time land registration. Negative publication system in Indonesia Agrarian law leads to the uncertainty of land ownership which results in conflicts. A strong optimization on the function of Village Government on land registration is necessary. This study employed a normative approach. Communal regime-based natural resources management becomes the basis of the rationality of Village Government’ function strengthening on the land registration.

Land dispute on forest area in Blora Regency is still developing. This is a form of resistence among Blora community toward the patterns of forrest management by Perhutani since New Order. Many things became the trigger like illegal logging, violence involving community members, and claim on land ownership. This article studied the phenomenon applying fiqh perspective in order to develop peace building that was based on common good. However natural resources management constituted an important part in doing worship to God, so it needed to be accorded to Islamic spirit.***Konflik sengketa tanah kawasan hutan di kabupaten Blora terus bergulir. Kisah ini merupakan sejarah lama karena resistensi masyarakat Blora terhadap pola-pola pengelolaan hutan oleh Perhutani telah dimulai sejak masa Orde Baru. Banyak hal yang menjadi pemicu persoalan seperti penebangan liar, kekerasan yang melibatkan warga, dan klaim kepemilikan atas tanah. Tulisan ini mencoba melakukan kajian secara fiqh atas fenomena tersebut, sebagai salah satu upaya mengembangkan resolusi perdamaian berdasarkan dari kemaslahatan bersama. Bagaimanapun pengelolaan atas alam merupakan bagian penting dari prosesi ibadah kepada Tuhan sehingga perlu disesuaikan dengan spirit Islam.

According to the legal norms of the Russian Federation in the ownership, usage and disposal of natural resources the author analyses interaction between natural resources users and local authorities. The interaction is based upon ecological and economic factors, which cause the peculiarities of requirements put before natural resource users in the Far North. The strategic directions of resource saving economic development of these regions are considered.
