Terrorism is indisputably a serious security threat to states and individuals. Yet, by the end of 2016, there was still lack of consensus on the legal definition of terrorism at the United Nations (UN) level. The key organs of the UN, the Security Council (UNSC) and the General Assembly (UNGA), are yet to agree on a legal definition of terrorism. This disconnect is attributed partly to the heterogeneous nature of terrorist activities and ideological differences among member states. At the UN level, acts of terrorism are mainly tackled from the angle of threats to international peace and security. In contrast, at the state level, acts of terrorism are largely defined as crimes and hence dealt with from the criminal justice paradigm. This article argues that the lack of a concrete legal definition of terrorism at the UN level undermines the holistic use of the criminal justice paradigm to counter-terrorism at the state level. To effectively counter-terrorism the UNSC and the UNGA have to agree on a legal definition of terrorism in their resolutions. This will streamline efforts to combat terrorism at the state level and consolidate counter-terrorism measures at the international level. The draft comprehensive Convention on Measures to Eliminate Terrorism (the Draft Convention) should be tailored to fill gaps and provide for a progressive legal definition of acts of terrorism.

Saudi Arabia’s counter-terrorism strategy of the first decade on the twenty first century has been widely acclaimed as highly successful and presented as an example for other Muslim countries. The strategy was developed after the bomb attacks of AlQaida on the Arabian Peninsula in 2003. The program is however deeply religious and is based on the reconversion of terrorists from a Jihadi-Salafism to a quietist and law abiding version of Salafism. The chapter goes into the religious terminology Saudi counter-terrorism program by labelling terrorism as religious “deviation,” radicals as people who have been led by their “passions” and are no longer rational and have diverted form the “middle way”. The article also shows how prominent religious scholars have become deeply involved in the state counter-terrorism program of “intellectual security”.

AbstractIn the 1970s, the West German extra-parliamentary Left struggled to respond effectively to left-wing terrorism and the state powers mobilised against it. This article argues that a shared conception of counter-violence as legitimate resistance helps explain the Left's ambivalent relationship to political violence and its solidarity with militants. The mounting strain on the projects and protest networks of student rebels, older leftists, anti-nuclear demonstrators and feminist activists, however, provoked debate and, eventually, change. Caught between terrorism and counter-terrorism, leftists revised assumptions upon which their commitment to resistance had rested – and reconceived resistance itself as part of everyday, mainstream politics.

Artykuł ma na celu przedstawienie założeń Prawa zwalczania terroryzmu uchwalonego w 2016 r. w Izraelu w zakresie definiowania i, zwalczania terroryzmu oraz sankcjonowania przestępstw z nim związanych. Autor ukazuje izraelską percepcję tych zagrożeń uwidaczniającą się w nowym ustawodawstwie. Zostanie ona zestawiona z przepisami obowiązującymi wcześniej, aby pokazać, jak zmieniało się postrzeganie tych zagadnień przez rządzących i jakie zmiany wprowadziło nowe prawo. W tym celu autor zastosuje metodę instytucjonalno-prawną i metodę porównawczą różnicy, a także skorzysta z teorii sekurytyzacji. Przeprowadzona analiza pozwoli mu na stwierdzenie, że z perspektywy rządzących terroryzm jest nadal uważany za główne zagrożenie Państwa Izrael. Prawo z 2016 r. wprowadziło możliwość zastosowania wielu środków nadzwyczajnych w ramach przeciwdziałania temu zjawisku. To pokazuje, że partie, które je uchwaliły, mają jastrzębie spojrzenie na kwestie związane z walką z terroryzmem. Israeli counter-terrorist legislation against the threats of the 21st century The aim of the article is to present objectives of the Israeli Counter-Terrorism Law passed in 2016. The author examines the way of defining and combating terrorism, and the penalty measures related to criminal activity linked with it. Thus, the author shows the Israeli authorities’ perception of threat connected with terrorism. The previous counter-terrorist law is compared with the new one to demonstrate the modification of the vision of security. The article seeks to answer the question what changes and views have been implemented by the new law. To achieve those aims the author used the comparison method and an analysis of the law and the securitization theory. It allowed to state that terrorism is still regarded by Israeli politicians as the main threat for the State of Israel and its citizens. The amended law allowed for the use of many emergency measures. Overall, it exhibits a hawkish stance towards combating terrorism of parties which amended the law.
