Common Ownership of the Earth as a Non-Parochial Standpoint: A Contingent Derivation of Human Rights

It is becoming less and less controversial that we ought to aggressively combat climate change. One main reason for doing so is concern for future generations, as it is they who will be the most seriously affected by it. Surprisingly, none of the more prominent deontological theories of intergenerational justice can explain why it is wrong for the present generation to do very little to stop worsening the problem. This paper discusses three such theories, namely indirect reciprocity, common ownership of the earth and human rights. It shows that while indirect reciprocity and common ownership are both too undemanding, the human rights approach misunderstands the nature of our intergenerational relationships, thereby capturing either too much or too little about what is problematic about climate change. The paper finally proposes a way to think about intergenerational justice that avoids the pitfalls of the traditional theories and can explain what is wrong with perpetuating climate change.

Mathias Risse’s On Global Justice is a unique and important contribution to the growing literature on global justice. Risse’s approach to a variety of topics, ranging from domestic justice and common ownership of the earth, to immigration, human rights, climate change, and labour rights, is one that conceives of global justice as a philosophical problem. In this commentary I focus on a number of reservations I have about approaching global justice as a philosophical rather than an inherently practical problem. To his credit Risse does acknowledge at various stages of the book that a good deal of the applied terrain he ventures into presupposes complex and contentious empirical assumptions. A greater emphasis on those points would, I believe, helpfully reveal the shortcomings of tackling intellectual property rights by appealing to Hugo Grotius’s stance on the ownership of seas, or the shortcomings of tackling health by invoking the language of human rights without acknowledging and addressing the constraints and challenges of promoting health in an aging world.

The Jewish Canadian writer Miriam Waddington returned repeatedly to the subject of the Spanish Civil War, searching for hope amid the ruins of Spanish democracy. The conflict, a prelude to World War II, inspired an outpouring of literature and volunteerism. My paper argues for Waddington’s unique poetic perspective, in which she represents the Holocaust as the Spanish Civil War’s outgrowth while highlighting the deeply personal repercussions of the war – consequences for women, for the earth, and for community. Waddington’s poetry connects women’s rights to human rights, Canadian peace to European war, and Jewish persecution to Spanish carnage.

Do human rights in their conventional, Western understanding really meet the needs of Pacific peoples? This article argues that land rights are a better clue to those needs. In Aboriginal Australia, Fiji, West Papua and Papua New Guinea, case studies show that people's relationship to land is religious and implicitly theological. The article therefore suggests that rights to land need to be supplemented by rights of the land extending to the earth as the home of the one human community and nature as the matrix of all life.

Agenda 21, the blueprint for sustainable development, adopted at the Earth Summit in Rio de Janeiro in 1992, does not have a chapter dedicated to trade. Yet since 1992, trade has become increasingly important to democracy, human rights, women's rights, economic development, employment and the environment. "Trade and environment" has been identified by many governments and civil society organisations as an important policy issue in preparations for the World Summit on Sustainable Development. At the same time, environment has become a highly politicised word in the world inhabited by trade negotiators. The aim of this paper is to examine whether or not the inclusion of WTO environmental negotiations, as outlined in the Doha Ministerial Declaration, advances or retards sustainable development.

AbstractThe trend toward the concept of humanity in political theory has arisen largely as a reaction against the mistreatment of vulnerable people such as immigrants. The issue of immigrants’ vulnerability has led political thinkers to ponder on how to apply the principle of humanity to the question of the treatment of immigrants. I would like to address this matter by examining two questions: what is humanity, is it a value property, or a virtue? Does it really matter if the means by which an immigrant immigrates is demeaning to his own humanity as a person? The most common or intuitive reply to these questions would probably be: ‘humanity’ is simply a value-bestowing property, so regardless of immigrants’ actions they are owed respectful treatment. The aim of this paper is to emphasise instead that ‘humanity’ should be conceived as a virtue of actual commitment to act on moral principles. I explore three different meanings of humanity. First, I discuss ‘humanity’ as the common ownership of the earth. Second, I discuss ‘humanity’ as a value property. Third, I discuss humanity as a virtue of acting, on the one hand, with humanity, and on the other hand, on moral principles.

Taking the Earth Charter’s preamble as a beginning, this work calls for “ecological thinking” as a way of seeing and interpreting an interdependent world where we seek “to bring forth a sustainable global society founded on respect for nature, universal human rights, economic justice, and a culture of peace.” Incorporating poems and personal reflections, this braided essay grows out of the author’s experiences in Everglades National Park. As defined by Corey (2016), the braided essay offers “various threads of writing...nearly always without overt transition..., “each part having its own meaning, within “an obliquely accumulating larger impact” (pp. 7–8).
