The Financial Services Authority (OJK) is a financial service supervision institution such as the Banking Industry, Capital Market, Mutual Funds, Financing Companies, Pension Funds and Insurance. OJK has become an independent institution based on the Law Number 21 Year 2011 concerning OJK, which means it is free from intervention or interference from any party. The purpose of the establishment of OJK is  that all activities in the Financial Services sector are carried out regularly, fairly, transparently and accountably; able to realize a financial system that grows in a sustainable and stable manner; and able to protect the interests of consumers and society.OJK has duties and authorities in the field of micropudential, which includes regulation and supervision of bank institutions, bank health, prudential aspects of banks, and bank checks. Penelitian ini bertujuan untuk menjelaskan peran Otoritas Jasa Keuangan sebagai lembaga independen dalam melakukan pengawasan terhadap lembaga jasa keuangan di Indonesia serta kewenangan Otoritas Jasa Keuangan yang diatur dalam Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Dari hasil penelitian dijelaskan bahwa Otoritas Jasa Keuangan adalah lembaga yang independen dan bebas dari campur tangan pihak lain, yang mempunyai fungsi, tugas, dan wewenang pengaturan, pengawasan, pemeriksaan, dan penyidikan terhadap lembaga jasa keuangan seperti perbankan. Dasar hukum dibentuknya Otoritas Jasa Keuangan adalah Undang-Undang Nomor 21 Tahun 2011. Secara kelembagaan, Otoritas Jasa Keuangan berada di luar pemerintah, yang dimaknai bahwa Otoritas Jasa Keuangan tidak menjadi bagian dari kekuasaan pemerintah. Otoritas Jasa Keuangan dibentuk dengan tujuan agar keseluruhan kegiatan di dalam sektor jasa keuangan terselenggara secara teratur, adil, transparan, dan akuntabel; mampu mewujudkan sistem keuangan yang tumbuh secara berkelanjutan dan stabil; serta mampu melindungi kepentingan konsumen dan masyarakat. Otoritas Jasa Keuangan bertugas tidak hanya mengatur dan mengawasi perbankan saja, tetapi juga mencakup pasar modal, perasuransian, dana pensiun, lembaga pembiayaan, serta lembaga jasa keuangan lainnya.    THE ROLE OF FINANCIAL SERVICES AUTHORITY ON SUPERVISION OF FINANCIAL INSTITUTIONS IN INDONESIA This research aims to explain the role of the Financial Services Authority as an independent institution in supervising financial service institutions in Indonesia as well as the authority of the Financial Services Authority as regulated in Law Number 21 of 2011 concerning the Financial Services Authority. The method used in this research is normative legal research. From the research results, it is explained that the Financial Services Authority is an independent institution and free from interference from other parties, which has the function, task and authority to regulate, supervise, examine and investigate financial service institutions such as banks. The legal basis for the establishment of the Financial Services Authority is Law Number 21 of 2011. Institutionally, the Financial Services Authority is outside the government, which means that the Financial Services Authority is not part of the government's power. The Financial Services Authority was formed with the aim that all activities in the financial services sector are carried out in an orderly, fair, transparent and accountable manner; able to realize a financial system that grows in a sustainable and stable manner; and able to protect the interests of consumers and society. The Financial Services Authority is tasked with not only regulating and supervising banking, but also covering the capital market, insurance, pension funds, financing institutions, and other financial service institutions.

<p>Increasing competition in the Indonesian banking industry has encouraged many banks to improve the quality of services to customers by utilizing information technology developments. Service innovation in the use of information technology encourages banks to enter the era of digital banking services. However, the development of digital banking services also increases the risks faced by banks. The purpose of this study is to provide an overview of the implementation of digital banking services and customer protection for risks from digital banking services. The method used in this study is an empirical legal research method. The results of this study indicate that the implementation of digital banking services is regulated by OJK Regulation No.12/POJK.03/2018. The existence of this OJK Regulation is expected by banks as providers of digital banking services to always prioritize risk management in the use of information technology. In addition, this study also shows the existence of 2 types of customer protection for the use of digital banking services, namely preventive protection in the form of legislation related to customer protection in the financial services sector and repressive protection in the form of bank accountability for complaints from customers using digital banking services.</p>

Purpose This study aims to investigate employees’ perceptions of socially responsible financial services brands in Saudi Arabia. The study also identifies the motives and challenges for Islamic banks for higher involvement in social responsibility initiatives to enhance their brand values. Design/methodology/approach An inductive approach was used in this study to identify the motives and challenges related to corporate social responsibility (CSR) activities. The research design uses a qualitative approach where in-depth interviews were carried out among the employees in the financial services sector in Saudi Arabia. Findings Findings provide insights about how CSR initiatives for financial services brands in a developing and Islamic country are perceived. Results show that the focus of CSR activities is on the attribute of CSR, the magnitude of CSR and attitude towards CSR. Results show two main motives to engage in CSR activities, which are instrumental and ethical motives. The main challenges are related to the government, business, charitable organisations and customers and society. Practical implications Implications exist for how CSR is perceived in a new context and in the financial services industry. Understanding the current perception of CSR from a financial service brand perspective helps policymakers to develop appropriate platforms for financial service providers to become more socially involved. Originality/value The major contribution of this study lies in investigating the CSR perception among the key stakeholder (i.e. the employees) from a brand management perspective in the Saudi Arabian financial services sector. Further, this study shows the main motives and challenges, which local financial service brands face to become socially responsible. The categories of attributes, magnitude and attitudes can be used to enhance brand value in one of the economically advanced countries in the Arabic world, Saudi Arabia. In the first category “attribute”, the perception of socially responsible banks are highlighted, while the elements of CSR, including its dimensions, are emphasised in the second category “magnitude”. The third category “attitude” shows two themes, including stakeholders’ issues and business-related issues.

Objective - The FSA Act the establishment of which is mandated by Article 34 of Law No. 23 of 1999 concerning the Bank of Indonesia, was enacted on 22 November 2011. This Act, together with Law No. 3 of 2004, regulates and supervises Indonesia's integrated financial services sector. This article reveals the existence of inconsistencies between the legal terms underlying the establishment of the FSA one the one hand, and the provisions contained in the Financial Service Authority itself, on the other. These inconsistencies also become evident in the light of the 1945 Constitution which facilitated the establishment of the Bank of Indonesia Law. The purpose of this article is to ascertain a method of resolving these inconsistencies associated with the genesis of the Financial Service Authority. Methodology/Technique - The research method used in this article is doctrinal in nature that uses secondary data and information sources as material to analyse the relevant problems. Findings - The research has revealed that the most appropriate method of settling these inconsistencies requires a consideration of the express wording of the FSA. Establishing a national economy that can grow suatainably and stable, requires the financial service sectors conducting its business in a well organized, fair, transparent and accountable manner, and be able to protect the consumer’s and public’s interests.Transparency, fairness, reliability, confidentiality, security of consumer’s data and/or information, fast, simple complaint handling and affordable dispute resolution cost become the principles of consumers  protection in the  financial services sector.The common motive to conduct an insurance fraud is economical reason, that is for obtaining a financial benefit/advantage. Broadly, a fraud in insurance can be classified into 3 (three) main dimensions: dimension of the subject i.e the fraudsters; dimension of time, ie. the time during the process of underwriting and the process of claim; dimension of behaviour that is opportunistic act (soft fraud) or planned fraud (hard fraud). The insurance consumer’s awareness concerning the financial services sector activities is needed, so that the insurance financial services sector can be conducted in a well organized, fair, transparent and accountable manner. Keywords: Insurance Fraud, Insurance Consumer’s Protection

The industry of the financial services or banking sector is demanded to be constantly stable, that is healthy, transparent and well managed. Such banking conditions can build consumers to continue to actively engage in transactions. However, as time goes by the development of the financial services industry in Indonesia is increasing and the cross-sectoral problems of the financial services industry are increasingly in need of reform in the field of banking law, then the Financial Services Authority is formed as an institution that will replace Bank Indonesia in the supervision of banks and supervise institutions other finance. OJK in its formation has several objectives to carry out supervision, especially in the financial services sector. Pursuant to Article 4 of the OJK Law, OJK was formed with the aim that all activities within the financial services sector: (a) be organized regularly, fairly, transparently and accountably; (b) Able to realize a financial system that grows sustainably and stably; and (c) Able to protect the interests of consumers and society. Based on its authority, the OJK carries out the task of regulating and supervising the banking sector in accordance with its functions as stipulated in Article 5 of the OJK Law which functions to organize an integrated regulation and supervision system for all activities within the financial services sector. With the presence of OJK in supervision, banking and other financial institutions can create harmonious regulations so as to protect consumer rights.

<p>Abstract<br />This article aims to determine about legal protection for consumers of securities companies that purchase shares of public listed company that committed acts of corruption. This article using a normative prespective<br />legal research with statue approach. Legal materials that used include primary and secondary legal material obtained by data collection techniques based on literature study with analysis techniques with deductive logic, explain a general thing then drawing it into more specific conclusions. The result of this study explains that there is a legal protection in the form of efforts that can be done by the investors as explained in the Chapter VI Article 28 through Article 30 of Law Number 21 of 2011 on Financial Services Authority (FSA) and also through the predetermined Internal Dispute (IDR) mechanism by FSA. If the mechanism unsuccessfully, then they can do an alternative dispute resolution through an Alternative Dispute Settlement Institution in the Financial Services Sector as regulated in POJK Number 1 / POJK.07 / 2013. As a customer, it is expected to find out more about their rights and obligations in the capital market sector before deciding to invest their funds through a securities company. FSA also needs to provide more education regarding the rights and obligations of financial service businesses and financial service consumers. In addition, it is expected that the FSA can have a greater role related to the protection of consumers and society.<br />Keywords: Protaction; Securities Companies; Consumers of Securities Companies.</p><p>Abstrak<br />Penulisan artikel ini bertujuan untuk mengetahui tentang perlindungan hukum bagi konsumen perusahaan efek yang melakukan pembelian saham korporasi terbuka yang dinyatakan melakukan tindak pidana korupsi. Metode yang digunakan adalah penelitian hukum normatif yang bersifat prespektif dengan menggunakan pendekatan perundang-undangan (statue approach). Jenis data yang digunakan berupa data primer dan sekunder yang diperoleh dengan teknik pengumpulan data berdasarkan studi kepustakaan dengan teknik analisis data dengan logika deduktif, yaitu  menjelaskan suatu hal yang bersifat umum kemudian menariknya menjadi kesimpulan yang lebih khusus. Hasil dari kajian ini adalah adanya perlindungan hukum berupa upaya yang dapat dilakukan oleh konsumen sebagaimana dijelaskan pada Bab VI Pasal 28 sampai dengan Pasal 30 Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan dan juga melalui mekanisme Standar Internal Dispute (IDR) yang telah ditentukan oleh OJK. Jika melalui mekanisme tersebut belum menemui titik terang maka dapat melakukan alternatif penyelesaian sengketa melalui Lembaga Alternatif Penyelesaian Sengketa di Sektor Jasa Keuangan sebagaimana diatur dalam POJK Nomor 1/ POJK.07/2013. Sebagai nasabah diharapkan untuk lebih mencari tahu kembali terkait hak-hak dan kewajibannya selaku nasabah di sektor pasar modal sebelum memutuskan untuk menginvestasikan dananya melalui perusahaan efek. OJK juga perlu memberikan edukasi lebih terkait hak dan kewajiban baik pelaku usaha jasa keuangan dan konsumen jasa keuangan, selain itu OJK diharapkan dapat memiliki peranan yang lebih besar lagi terkait dengan perlindungan konsumen dan masyarakat.<br />Kata kunci: Perlindungan; Perusahaan Efek; Konsumen Perusahaan Efek.</p>

Purpose To explain a set of recent US Securities and Exchange Commission (SEC) administrative settlements targeting fund administrators and to alert fund administrators and other financial service providers to their growing “gatekeeper” obligations. Design/methodology/approach This article explores the factual and legal contours of SEC administrative settlements with a fund administrator, as well as related enforcement actions against investment managers, to better understand the affirmative steps the SEC is expecting financial service providers to take to help root out fraud and misappropriation in the financial services sector. Findings The SEC’s administrative settlements with this fund administrator illustrate the SEC’s expanding focus on the “gatekeeper” function and signal the intent of the SEC to impute culpability for wrongdoing to fund administrators and other financial service providers simply for not doing enough to root out fraud and misappropriation in the financial services sector. Originality/value This article contains valuable information about recent SEC enforcement activity and practical guidance from experienced white collar, securities, and investment management lawyers.

The Financial Services Authority (OJK) is an independent institution that is free from interference from other parties or institutions. This institution has the functions, duties, and authorities of regulation, supervision, examination, and investigation. OJK was established under Law No. 21 of 2011 with the function of implementing an integrated regulatory and supervisory system for the entire financial services sector. The establishment of OJK with the need to restructure the institutions that carry out regulatory and supervisory functions in the financial services sector. The supervisory system carried out by the OJK is an integrated supervision system, meaning that all financial service activities carried out by various financial institutions are subject to the OJK regulatory and supervisory system. Alternative Dispute Resolution Institutions (LAPS) in the Financial Services Sector number 1/POJK.07/2014 which regulates Alternative Dispute Resolution Institutions in the Financial Services Sector. Dispute resolution must be carried out at the LJK in the OJK Regulation concerning Consumer Protection in the Financial Services Sector, which stipulates that each LJK must have a work unit and/or function as well as a service mechanism and settlement of complaints for consumers. If the dispute resolution at the LJK does not reach an agreement, the consumer can settle the dispute out of court or through the court. Out of court dispute resolution is carried out through the Alternative Dispute Resolution Institution (LAPS).

The transfer in the functions, duties, and authority for regulation and supervision as stipulated in Article 55 of the Act concerning the Financial Services Authority (OJK) does not include the transfer of authority in filing a petition for bankruptcy. The authority to file a bankrupty petition against a debtor in the financial services sector still refers to Article 2 paragraph (3) to (5) Act No. 37 of 2004 concerning Bankruptcy and Suspension of Payment. Peralihan fungsi, tugas dan kewenangan pengaturan dan pengawasan sebagaimana dimaksud dalam Pasal 55 Undang-undang tentang Otoritas Jasa Keuangan (OJK) tidak termasuk peralihan kewenangan pengajuan pailit. Kewenangan untuk mengajukan permohonan pailit terhadap debitor yang bergerak dibidang jasa keuangan tetap mengacu pada Pasal 2 ayat (3) sampai (5) Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU.
