There is a law called Law Number 8 of 1999 that deals with consumer protection. It says that disputes between consumers and business people can be settled through both litigation and non-litigation channels and that both types of channels can be used to do this. Using the courts to settle consumer disputes is a way to do this. This type of dispute resolution refers to the rules for general courts. So that consumers need to get help from the law to get their rights as consumers. Consumer protection is becoming more and more important as science and technology move faster and faster. This is because the speed of science and technology is what drives the productivity and efficiency of producers for the goods or services they make in order to reach their business goals. As a result of this, either directly or indirectly, the Consumers are the ones who feel the effects of these two things the most. In this case, the consumer protection law says that businesses must give legal protection to their customers, so this shows that businesses must do this. And legal remedies for resolving disputes between customers and business people in the event of a dispute can be used both in court and out of court. In order for a dispute to be resolved through litigation, one party has filed a lawsuit against the other party. However, non-litigation dispute resolution can be done in a number of ways, such as through negotiation, consolidation, mediation, arbitration, and so on. Trade and investment play an important role in the practice of relations between countries in the prospective economic cooperation efforts to increase the economic growth of each country. In this regard, ASEAN also has legal instruments that regulate transactions and investments among other countries. In the trade regime, ASEAN has several agreements such as the ASEAN Free Trade Agreement, ASEAN Trade in Goods Agreement, ASEAN Trade in Services Agreement, ASEAN Framework Agreement on Services, and so on. Meanwhile in the investment regime, ASEAN has the ASEAN Comprehensive Investment Agreement. One of the important components in a Regional Trade Agreement is the clause of a legally binding dispute settlement mechanism. In the trade regime, the system and mechanism of the dispute resolution procedures are separated from other trade agreements, the ASEAN Protocol on the Enhanced Dispute Resolution Mechanism. Meanwhile in the Investment regime, the system and mechanism of the dispute resolution procedure are regulated in the same agreement in the ASEAN Comprehensive Investment Agreement. This article will describe the procedural mechanism for the dispute resolution framework of the trade and investment regime in ASEAN, as well as focus on each dispute resolution system with the preferences of each participating country, with differences in the use of the dispute system in the WTO.

The case involving the nitrate factory at Chorzów, Upper Silesia has been the subject of much academic commentary. Last year the intellectual property aspects of the case were explored in this journal. In this reply, I express doubts about whether the case involved the expropriation of intellectual property rights (IPRs) for two reasons. First, there are grounds to question the existence of IPRs. Second, even if there were IPRs, the Permanent Court of International Justice does not appear to have found that IPRs were taken. Instead, the case serves as a reminder of the importance of identifying the legal status of an IPR in the relevant territory when seeking to protect it under international law. * My thanks to Martyna Mielniczuk-Skibicka and Kacper Górniak. The EU has decided to phase out imports of palm oil used in biofuels in the EU by 2030. This affects people in Malaysia who rely on the palm oil business for their livelihood. This chapter examines the events leading up to the EU's anti-palm oil actions and the many ways in which Malaysia has responded to defend its palm oil sector. This includes 1) countering EU's allegation through scientific research, 2) demonstrating its commitment to transform the palm oil industry toward sustainability through certification standards, 3) fostering the commitment to grow palm oil sustainably, 4) garnering support from ASEAN and the international community, 5) expressing its opposition and warnings for retaliatory measures against the EU, and 6) requesting consultation under the WTO dispute settlement mechanism. It presents the political processes that generate policy interventions aimed at defending palm oil trade with the EU alerting that economic decoupling and direct conflict may exacerbate the problem, weaken bilateral relations, and elude good improvements in the palm oil business.

Pacta sunt servanda is a legal principle that applies universally. With this principle, everyone is expected to carry out an agreement made with other parties voluntarily. To enforce the principle by the court in case of dispute in the implementation of the agreement, it requires conditions that must be met. In the context of an arbitration agreement, it must also meet specific rules stipulated in the Arbitration Law. In practice, there is still disobedience to this principle where the parties who have been bound by an arbitration agreement are still taking the litigation in solving their case. In this research, the problems examined are how the principle of pacta sunt servanda is regulated in the arbitration law and how strong this principle is applied. The method used in this research is normative juridical. Based on the research, it is concluded that the implementation of the pacta sunt servanda principle is regulated in several articles of the Arbitration Law. The pacta sunt servanda principle is not valid absolutely because it is deviated by other laws or legal principles. It is recommended that parties in an agreement shall understand the choice of dispute settlement well including the consequences of such choice.

The location for the New Yogyakarta International Airport (NYIA) construction involved in land disputes during the land acquisition process. The land acquisition will always lead to disputes or conflicts with the affected people. It is even more complicated if, in the development process, the ruling elite intervenes, external forces outside the local community that are not directly related to the development. This article deals with the question of the government's public perceptions of the legal polemic of land dispute settlement based on Law No.2 of 2012, and concentrates to examine a new model of land dispute resolution from the perspective of affected communities against NYIA. This research is normative-empirical based on primary and secondary data, namely a literature study, field study, using purposive sampling with interviews, FGD, observation, and qualitative descriptive analysis. The result showed the failure of formal litigation and non-litigation approaches offered by Law No.2 of 2012 to resolve the disputes fairly. Village discussions based on local wisdom as a new model for equitable land dispute resolution needs a political review of Law No. 2 of 2012. The new paradigm of agrarian reform must be based on customary law and local wisdom values in the 1945 Constitution and the Agrarian Law. Given recent controversies concerning land disputes, a law on reform and structuring the national agrarian structure, Agrarian conflict resolution law, and law of natural resources management for the community are urgently needed.
