Canada has undertaken commitments to recognize the rights of Indigenous Peoples in fisheries through policies and agreements, including Integrated Fishery Management Plans, the Reconciliation Strategy, and Land Claim Agreements (LCAs). In addition to recognizing rights, these commitments were intended to respect geographic adjacency principles, to enhance the economic viability of Indigenous communities, and to be reflective of community dependence on marine resources. We examined the determinants of quota allocations in commercial fisheries involving Nunatsiavut, Northern Labrador, the first self-governing region for the Inuit peoples in Canada. It has been argued that current fishery allocations for Nunatsiavut Inuit have not satisfied federal commitments to recognize Indigenous rights. Indicators that measure equity in commercial allocations for the turbot or Greenland halibut (Reinhardtius hippoglossoides) and northern shrimp (Pandalus borealis) fisheries were identified and assessed. In these two cases, historical allocations continue to predominate for allocations based upon equity or other social or economic considerations. We illustrate equity-enhancing changes in the quota distribution under scenarios of different levels of inequality aversion, and we make qualitative assessments of the effects of these allocations to Nunatsiavut for socioeconomic welfare. This approach could benefit fisheries governance in Northern Labrador, where federal commitments to equity objectives continue to be endorsed but have not yet been integrated fully into quota allocations.

Natura 2000 sites and fisheries in German offshore waters.–ICES Journal of Marine Science, 66: 155–169. The principal objective of sites selected as part of Natura 2000 is to achieve or maintain a favourable conservation status of habitats and species named in the EU Birds and Habitats directives. In the German exclusive economic zone, the habitat types protected by this legislation are sandbanks and reefs; protected species include marine mammals, seabirds, and specific migratory fish species. The ICES project Environmentally Sound Fishery Management in Protected Areas (EMPAS) aims to answer two questions: (i) To what extent do specific fishing activities significantly threaten attainment of the conservation objectives of the Natura 2000 sites? (ii) What management measures would reduce these conflicts and how effective would they be at helping to ensure the favourable condition of these sites? Assessments of fishing impacts on Natura 2000 sites require basic data on the conservation status of individual habitats and species, as well as data for fine-scale distributions of ongoing fishing activities. This paper describes and discusses the process used by the EMPAS project in developing fishery-management plans for each Natura 2000 site in German offshore waters.

The provisions of the federal Cannabis Act came into force on 17 October 2018, opening a new era of cannabis management in Canada. We examine cannabis in Canada through the lens of reconciliation and the rights of First Nations, Métis, and Inuit peoples. There is potential for Indigenous communities to benefit from cannabis legalization, but also a very real risk that the new legal framework will simply perpetuate existing injustices. We show that the new legislation is inadequate both in terms of lack of consultation with Indigenous communities, as well as in terms of substantive provisions — and omissions — in the legislation itself.

For decades, Indigenous communities living in Mexico’s oil-producing state of Tabasco suffered violence, environmental contamination, and the destruction of their traditional livelihood. The administration of Andrés Manuel López Obrador (AMLO) taking office in 2018 promised to govern for the poorest people in Mexico, emphasizing the wellbeing of Indigenous peoples. However, as part of his nationalist agenda AMLO is pursuing aggressive exploitation of hydrocarbons upon the lead of state-owned company Pemex. This article argues that the Mexican government still denies Indigenous peoples living nearby oil reserves the right to self-determination. We examine this phenomenon through the Chontal community of Oxiacaque in the state of Tabasco suffering environmental contamination and health problems caused by the oil industry. We emphasize the government’s use of resource nationalism to legitimize violence against Indigenous communities and their natural environments. Further, the expansion of social programs and infrastructure building serves to obtain Indigenous compliance with the unsustainable fossil fuel industry.

What are the institutional arrangements required to implement a genuine process of free, prior and informed consent (fpic)? This article provides a comparative perspective on the politics of consent in the context of relations between Indigenous peoples, states and extractive industries in Canada and Latin America. The case of Ecuador is presented as an emblematic example of a hybrid regime in which Indigenous communities have the right to free, prior and informed consultation, not consent, concerning planned measures affecting them, such as mineral, oil and gas exploitation. In the case of Yukon, Canada, the settlement of a comprehensive land claim with sub-surface mineral rights has provided the institutional basis for the implementation of a genuine fpic process, one that includes participatory decision-making power over natural resource development projects. The article concludes with a discussion on the necessary conditions for moving governments from a consultation to a consent regime.

While the notion of social-ecological system resilience is widely accepted and applied, the issue of “resilience for whom” is clearly ignored. This phenomenon has also occurred in Taiwan. This article explores the roots of, and a possible solution to, this issue through a case study in the context of Taiwan’s indigenous peoples. The Danungdafu area, the focal social-ecological system, was studied. Qualitative research methods and an action-oriented research approach were employed. For a long period, the central government shaped the political, economic, social, institutional, and ecological contexts; dominated resilience discourses and determined the problem-framing and problem-solving agenda; defined the scale and levels at which social-ecological system governance issues were addressed; and determined the knowledge system used to define and solve problems. After 2011, a new participatory governance regime emerged. Multiple stakeholders, including indigenous communities, began to contribute to resilience discourses and influenced governance and trade-offs among differing governance goals. However, under the established structures dominated by Han people, indigenous views, rights, and well-being continue to be ignored. Affirmative action is required to recognize and safeguard indigenous rights. A practical institutional pathway is available to facilitate the transformation from “resilience for mainstream society” to “resilience for indigenous people” in indigenous territories.

Research failures are not readily disclosed in research representations. This exclusion is a missed opportunity to practice reflexivity, a practice otherwise crucially important to social science inquiry, and share the learning that was inspired by the failure. In this paper I present and reflect on a research failure that occurred during my doctoral research into alternative, Inuit-centered models of fisheries governance in Nunavut. While working on defining the research, I experienced a far-reaching impasse due to the lack of community response and academic guidance. Eventually, despite the best intentions to engage in decolonizing research, I chose to forgo meaningful community consultation before embarking on my fieldwork. Decolonizing research centers collaboration and local research needs from the outset. At the same time, what it means to negotiate a research relationship is in itself negotiable. Further, the negotiating is often challenged by time constraints, institutional restrictions, and limited financial resources. Lessons learned from my case study include a) that a nonideal start does not mean that the entire research project will fail and b) that participating Indigenous communities have the sovereignty, irrespective of existing protocols, to set the terms under which research can take place. Above all, negotiating a research relationship is about relational work which requires commitment and continuous engagement.

Across the globe, community-oriented protected areas are increasingly recognised as an effective way to support the preservation and maintenance of the traditional biodiversity related knowledge of indigenous peoples and local communities. We argue that guaranteed land security and the ability of indigenous and local peoples to exercise their own governance structures is central to the success of community-oriented protected area programs. In particular, we examine the conservation and community development outcomes of the Indigenous Protected Area program in Australia, which is based on the premise that indigenous landowners exercise effective control over environmental governance, including management plans, within their jurisdiction (whether customary or state-based or a combination of elements of both), and have effective control of access to their lands, waters and resources. Key Words: community-oriented protected areas, Indigenous rights, conservation, Australia

Abstract In recent years, the recreational contribution to the total catch of Atlantic cod (Gadus morhua) in the Gulf of Maine (GOM) has increased with recreational discards outnumbering recreational landings by 2:1. However, the discard mortality (DM) rate of cod released in the recreational fishery remains poorly understood, thus contributing to the uncertainty in stock assessments and fishery management plans. The current study examined the capture-related factors most detrimental to cod DM in the GOM recreational rod-and-reel fishery. Atlantic cod (n = 640; 26.0–72.0 cm) were angled from June–October 2013 on southern Jeffreys Ledge in the western GOM using fishing gear representative of the local recreational fishery. A subset (n = 136) was also tagged with pressure-sensing acoustic transmitters before being released into an acoustic receiver array (n = 31) deployed to monitor survival up to 94 days. To properly model DM up to the fishery-wide level, all cod were visually assessed for capture-related injuries according to a four-level injury score index. Mean tackle-specific DM rates of 15.4 and 21.2% were estimated for bait- and jig-captured cod, respectively, with an overall 16.5% mean DM rate for the 2013 GOM recreational cod fishery. Twenty-nine cod tagged with acoustic transmitters were identified as dead, where the majority (∼90%) died within 16 h post-capture. Upon evaluation with a specifically adapted parametric survival analysis, greater incidence of mortality was attributed to the capture and handling process (rather than release) for moderately and severely injured cod. Based on the capture-related factors associated with the highest injury rates, we recommend minimizing fight and handling times, avoiding areas with small cod, educating inexperienced anglers, and favouring bait over jigs to mitigate mortality. Results will continue to inform the development of fishery management plans and enhance survival through dissemination of “best practice” techniques to fishery stakeholders.

The domestic monkfish (Lophius americanus) fishery off the northeastern USA is described, along with the management response to the expansion of the fishery and the challenges posed to the management and scientific processes. The US fishery was virtually non-existent in the early 1980s, but it expanded rapidly over the next decade to the point that a management plan became necessary to regulate harvesting. By law, US fishery management plans must include measurable biological reference points based on maximum sustainable yield or a proxy; management plans must stop overfishing and rebuild overfished stocks. For monkfish, the limited biological and historical fisheries information presented significant challenges to science and management and resulted in the adoption of innovative approaches to comply with the law.
