Is the European Union a Pole of Corporate Social Responsibility?

This chapter focuses on the analysis of the efforts made by the European Union authorities to encourage companies in the process of promoting sustainable development and involvement in various CSR actions. On the one hand, at the EU level, many regulations provide the general framework for the voluntary development of CSR programs. On the other hand, public institutions are involved in meeting sustainable development objectives set at the European and international levels. The tools are numerous, having a higher degree of adaptability depending on the company size, activities, and origin of the capital. Over time, the concerns of European institutions have intensified and have targeted not only the social responsibility of companies but also of public authorities, which through specific instruments can impose certain conduct on companies. The companies paid particular attention to ensure the communication of the actions taken and the results obtained with different categories of stakeholders.

The concept of corporate social responsibility is in constant development. It passes from the sphere of large transnational companies to the smaller sized companies, in the field of SMEs. Although SMEs don’t have the impact of great corporations, they have a duty to carry out social responsibility programs. An SME, as a singular unit, does not have the social impact of transnational corporations, but the large number of SMEs creates a social impact comparable to the one generated by large corporations. Due to competitive pressures, large transnational companies have outsourced some activities. The objective of “sustainable development” has institutional implications that deserve to be better understood. It conveys a transformative ambition that has gradually contributed to equating change with a collective purpose ideally adopted and accompanied by the relevant institutions. Focusing on the activities of government that have begun to carry out this goal, this article analyzes how rationalities, devices, and procedural arrangements merge, making change management a renewed stake in the institutional sphere. In order to understand its logics and directions, this study gives an account of this process in the initiatives of French public authorities and European Union institutions. Considering this new interpretation of “change,” it reviews the range of both programmatic and instrumental by-products that take the form of documents presented as “strategies” and the procedural bases that begin to provide support. By capturing how institutional protagonists and their potential partners have taken into consideration the issues linked with sustainable development, this article shows how this renewed form of change management contributes to an evolution in the work of public institutions and the devices they use. What is at stake is a collective relationship to change. The institutional takeover of this issue is carried out in such a way that it also induces a process of governmentalization of change.

RESUMENEl desarrollo sostenible es manejado como uno de los puntos importantes en las agendas del siglo XXI, es un concepto que las empresas deben contemplar en las actividades que realizan para cumplir con la Responsabilidad Social Empresarial. El presente trabajo pretende abordar los aspectos teóricos sobre las Memorias de Sostenibilidad así como mostrar que pueden ser consideradas como un instrumento de información de la Responsabilidad Social de las Empresas. Se hace un estudio en la base de datos de la Corporate Register del 2006 al 2011 respecto de la presentación de las Memorias de Sostenibilidad en América Latina; el reporte es de corte cualitativo de carácter descriptivo, con un análisis deductivo. The relevance of the paper is determined by the need to modernize social dialogue in Ukraine as a means of increasing the social responsibility of business organizations and a prerequisite for the country’s sustainable socio-economic development. The paper is aimed at reviewing and systematizing effective practices of modernization of social dialogue, which are revealed in the publications of foreign and Ukrainian scientists, high-ranking officials and public figures. These practices are considered from the standpoint of their expediency and the possibility of their implementation in the processes of social interaction of organizations of employees, employers and public authorities in Ukraine.A review of the foreign experience in organizing social dialogue convincingly demonstrates a fairly high level of efficiency in the European Union, which contributes to achieving a balance of interests of major economic actors, increasing their social responsibility. For Ukraine, it is expedient to introduce the European practice of the so-called broad approach to the organization of social dialogue, which provides for the expansion of its subjects at the expense of representatives of territorial entities, environmental, women’s, youth, cultural and other public organizations. The involvement of local governments, public and NGOs in solving the most important socio-economic problems will contribute to the spread of the practice of differentiating between social and public dialogue. In Ukraine, employee participation in corporate governance should be strengthened, access to shareholder income should be expanded, and institutional tools for regulating the collective bargaining process should be improved.

Although Japanese enterprises have already spent considerable money and labor on protection of personal information, the European Union does not assess Japan as a country taking appropriate measures for “adequate levels of protection.” Japan should establish new legislation accepted internationally that reduces massive personal information leaks and revitalizes enterprises and solves domestic problems. Enactment of such legislation is an obligation for Japan, a leading country in the corporate social responsibility (CSR) sector. This paper summarizes current problems, recommends amendments to current legislation and proposes a framework on personal information protection.
