ABSTRACT:The published literature that has thoroughly treated the history of European planning in sub-Saharan Africa is still rather scanty. This article examines French and British colonial policies for town planning and street naming in Dakar and Lagos, their chief lieux de colonisation in West Africa. It will trace the relationships between the physical and conceptual aspects of town planning and the colonial doctrines that produced these plans from the official establishment of these cities as colonial capitals in the mid-nineteenth century and up to the inter-war period. Whereas in Dakar these aspects reflected a Eurocentric meta-narrative that excluded African histories and identities, a glimpse at contemporary Lagos shows the opposite. This study is one of few that compares colonial doctrines of assimilation to doctrines of indirect rule as each affects urban planning.

Chapter One provides an account of the history of colonial and postcolonial Nigeria, focusing particularly on politics and law. The chapter recounts the long history of British colonial presence in West Africa and explains the introduction of indirect rule as a system of colonial government from the turn of the century. Some of the impacts of indirect rule are considered through reference to Obafemi Awolowo’s memoir, Awo, and Chinua Achebe’s novel, Arrow of God. The chapter also sketches out the divisions that indirect rule fomented and the resistance to which it gave rise. Finally, the chapter explains the implications of indirect rule for the implementation of law in Nigeria both during colonial rule and following independence.

This chapter explores how Mary Kingsley believed the British merchants and traders in West Africa were better placed than missionaries or colonial officials to understand West African beliefs, laws and social practices; she supported the liquor trade. It looks at her two major books, Travels in West Africa and West African Studies, analyzing Kingsley’s literary style and the challenges her observations and arguments posed to the British colonial authorities and the Colonial Secretary Joseph Chamberlain. In this chapter we see the emergence of Kingsley as a political campaigner for the rights of Africans, as she campaigns against the Hut Tax that was imposed on the people of Sierra Leone in 1898. The South African War offered her an excuse to leave England and return to the Africa she loved.

In English law, equity is assigned relatively benign and comfortable roles, functioning as a canon of interpretation of the common law; as its versatile and flexible help-mate and mitigator of its formal strictness. More than this, equity claims a moral justice or conscience function that is deeply embedded in legal culture. As a consequence, equity has been extremely successful in lubricating the machinery of English law, providing it with a ready means of change to meet the needs of the dominant actors within society. This justice function is, however, contradicted by equity's history and its practical functioning, particularly, within the British colonial experience. This article examines the effect of the imposition of English equity on the prevailing customary law systems in colonial West Africa. The analysis challenges the fundamental claim of equity to a moral justice function within the colonial regime and argues that equity served the imperial objective as an instrument for fragmenting and dislocating indigenous property systems in order to facilitate the installation of capitalist property forms.
