Over the last two decades, family law has undergone changes in Western Europe, widening the definition of marriage to include same-sex couples. In addition, some East European countries offer a legal recognition of civil unions of same-sex couples, while others do not offer any legal recognition at all. This diversity in family law has been recently challenged by developments at the European level. It is argued here that this constitutes an adaptational pressure on those European Union (EU) member states that do not offer any or offer only formal recognition of same-sex couples. We examine two cases when member states faced such an adaptational pressure, namely Estonia and Latvia, focusing on the interplay of two types of factors. First is that of formal institutions which, due to their constitutional role or their expertise in the EU law, may act as facilitators of legal changes. On the other hand, there are also political actors which have tried to constrain such an adaptation. We examine here especially the role of two political parties which have made a considerable effort to oppose the change in the two countries. It is argued here that the ideological orientation of these parties explains, at least partly, their opposition to the ongoing Europeanization of family law. The paper concludes with a discussion of the main findings and their implications.

The advent of the video recorder and its rather belated legal recognition through licencing arrangements for off-air recording has opened up possibilities for the widespread use of the video in education. Not surprisingly the video revolution has encouraged the production of a wide range of films designed for (or purporting to be designed for) education, at all levels.

Kedua, bagaimana urgensi itsbat talak dalam pandangan Fikih maupun Hukum Perkawinan di Indonesia ? This article aims to reconstruct the reception of Act XVII adopted by the Hungarian Parliament in 1916, which brought about the legal recognition of Islam, from the stance of the Holy See of Rome. The research is based on archival material preserved at the Vatican Archives, namely letters exchanged between the Nunziature of Vienna and the Holy See, which are published and translated here. The presentation of so far unpublished material provides an opportunity to follow the growing understanding of the contents and background of this law; the key points of interest of the Catholic Church in this matter are identified; while lexical references seek to shed light on the perceptions of Islam.

Chapter 5 analyzes Justice Kennedy’s majority opinions for the Supreme Court in Windsor and Obergefell. Refuting the procreation argument, Justice Kennedy sutures married lesbians and gays into full American citizenship. Despite the progressive outcome of the opinions, they provide additional evidence for the changing construction of childhood foreshadowed in earlier chapters and examined in depth in the conclusion. Recurring themes of dignity and legal recognition appear to weave gays and lesbians to the national order, thereby avoiding the symbolic damage that would have resulted had the Supreme Court allowed existing beliefs about heterosexuality to flourish and determine the outcomes. Despite the lofty elegance of Justice Kennedy’s opinions, these texts also display a preservation of heterosexual privilege. Minimizing the differences between lesbian/gay and straight marriages assimilates lesbians and gays into a heterosexual script and renders us legally straight.
