Este trabajo realiza un análisis del Reglamento (UE) nº 2016/1103 sobre regímenes económicos matrimoniales. Focalizamos nuestra atención en las normas de conflicto sobre la ley aplicable y los foros de competencia judicial internacional. En aras a la previsibilidad y plena seguridad jurídica, propicia que los cónyuges conozcan qué tribunal será competente para conocer de sus relaciones patrimoniales, y cuál será el Derecho aplicable a las mismas, tanto durante la vigencia del matrimonio, con ocasión de su disolución. Su objeto es evitar que puedan verse sujetos a regímenes distintos en función del tribunal competente o la ley aplicable. This paper analyses Regulation (EU) No 2016/1103 on matrimonial property regimes. We focus our attention on the conflict rules on applicable law and the forums of international jurisdiction. For the sake of predictability and full legal certainty, it is important for the spouses to know which court will have jurisdiction over their property relations and which law will be applicable to them, both during the period of the marriage and on its dissolution. It is intended to prevent them from being subject to different regimes depending on the competent court or the applicable law.

One of the main structural principles of Regulation (EU) 2016/1103 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes is the principle of party autonomy, both in terms of conflict-of-laws and international jurisdiction. The purpose of this study is to analyse the implementation of this principle in the European Regulation on Matrimonial Regimes.

La reciente publicación del Reglamento 2016/1103 ha supuesto un paso más hacia la armonización de las normas relativas a los regímenes económicos matrimoniales en el ámbito de la Unión Europea, ya que desde el 9 de enero de 2019 su aplicación es preferente a las normas de producción interna de los Estados miembros participantes. Pese a que el legislador europeo ha tenido que recurrir al mecanismo de la cooperación reforzada para poder aprobar el Reglamento, su promulgación ofrece una mayor previsibilidad y seguridad jurídica para los cónyuges que queden dentro de su ámbito de aplicación. El presente trabajo se centra en las normas relativas al sector de la Ley aplicable, ya que presentan un gran interés práctico y, a su vez, ofrecen una amplia autonomía de la voluntad a los contrayentes. The recent publication of the Regulation 2016/1103 has represented a step toward the harmonisation of the legal framework of matrimonial property regimes within the European Union context, because from 9 January 2019 the Regulation have preference in application over the participating member states’ national regulations. Despite the fact that the European legislator had to resort to the enhanced cooperation mechanism in order to approve the Regulation, the enactment offers greater predictability and legal certainty for the spouses. This paper focuses on the legal norms relating the applicable Law, as they present a great practical interest and, at the same time, they offer a broad party autonomy to the spouses.

Roman concept of dominium has been fundamental in the formation of concepts of ownership in European legal tradition. It is, however, often considered outside the context of Roman imperial rule and of the multiplicity of legal regimes governing property relations in Roman provinces outside Italy. This chapter starts from the classic passage in the Institutes of Gaius, claiming that the right of dominium did not exist in provincial land, where it belonged to the Roman state. Gaius’ statement is often dismissed in modern historical scholarship as a ‘conveyancer’s fantasy’ (A.H.M. Jones). It is argued here that, on the contrary, this passage and other similar statements in Roman juristic literature and technical literature on land-measurement, show an important facet of Roman ideas of ownership as a socially contingent right, dependent on civic status of the owner, status of the territory within the empire, and Roman recognition of local property regimes.

The article will examine the challenges that the establishment of the European Public Prosecutor’s Office poses for the rule of law – a question which has been underexplored in the policy and academic debate on the establishment of the EPPO, which focused largely on questions of structure and powers of the EPPO and the battle between intergovernmental and supranational visions of European prosecution. The implications of the finally adopted legal framework on the EPPO on the rule of law will be analysed primarily from the perspective of the rule of law as related to EPPO investigations and prosecutions and their consequences for affected individuals – in terms of legal certainty and foreseeability, protection from executive arbitrariness, effective judicial protection and defence rights. The article will undertake a rule of law audit of the EPPO by focusing on three key elements of its legal architecture – the competence of the EPPO, applicable law and judicial review – and the interaction between EU and national levels of investigation and prosecution that the EPPO Regulation envisages. The analysis will aim to cast light on the current rule of law deficit in a hybrid system of European prosecution located somewhere between co-operation and integration.

This chapter examines the legal regime governing matrimonial property, and more specifically the rights of a husband and wife in the movable and immovable property which either of them may possess at the time of marriage or may acquire afterwards. It first considers the general rule on assignment where there is an ante-nuptial contract as well as the assignment where is no ante-nuptial contract, focusing in particular on the application of matrimonial domicile in the case of movables and the effect of marriage on the spouses' immovables in the absence of a marriage contract. It then discusses the question of property rights arising from civil partnership and cohabitation, citing the relevant provisions of the Civil Partnership Act 2004, and concludes with an overview of European proposals for legal reform with respect to jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes.

 Abstract: The new Regulations (No. 2016/1103 and No. 2016/1104) recently adopted through an enhanced cooperation by the European Legislator aim to deal with all the private international law aspects of matrimonial property regimes and property consequences of registered partnerships, both as concerns the daily management of matrimonial property (or partner’s property) and its liquidation, in particular as a result of the couple’s separation or the death of one of the spouses (or partners). This paper aims to address the prominent role of party autonomy in the two Regulations and to focus on the coordination between the legal system embodied in the new two Regulations, and other relevant instruments of European private international law in force, such as the Succession Regulation and the Bruxelles II- bis Regulation.Keywords: party autonomy; successions; matrimonial property regime, partnership property regi­me, applicable law, choice of law, private international law.Riassunto: I due nuovi regolamenti (No. 2016/1103 e No. 2016/1104), recentemente adottati nell’ambito di una cooperazione rafforzata dal legislatore europeo, si propongono di regolare tutti gli aspetti internazional privatistici legati ai regimi patrimoniali tra coniugi e alle conseguenze patrimoniali delle partnership registrate, sia per ciò che concerne la regolare amministrazione dei beni sia per ciò che riguarda la liquidazione degli stessi beni facenti parte del regime matrimoniale (o della partnership regi­strata) nel caso si verifichino vicende che ne alterino il normale svolgimento, come la separazione della coppia o la morte di uno degli sposi (o dei partner).
