Abstract At present, institutional design is an under-theorized and underdeveloped part of the social sciences. In this paper I focus on designs for situations of collective action where the outcome is controlled by the choices of several self-interested actors. In those situations the goal of institutional design is to alter the rules of the game so that self-interested actors find it rational to cooperate. I explore the viability of that definition by considering two examples of institutional design: urban safety and academic peer review. I discuss the implications of my findings for our conception of rational self-interest and propose that three design principles – publicity, boundaries, and contiguity – can be inferred from the analysis.

Abstract The Unfair Contract Terms Directive (UCTD) and the Common Law doctrine of unconscionability in the United States both pursue the same aim: they seek to protect consumers against abuse of power by traders who are in a position to exploit the asymmetry of the contracting process. However, both sets of rules rest on different premises. In particular, they allocate trust differently between courts and markets. This accounts for deep-running differences despite apparent similarities. This contribution analyses these similarities and differences by commenting on the unconscionability doctrine as expressed in the Draft Restatement of consumer contracts from a European point of view.

On the asymmetry of memoriesThis paper deals with both past and current German and Polish historical debate on the common past and experiences, and especially the history of conflict in the twentieth century. It argues for a reconciliation and the mutual completion of historical analysis and views of history. It argues likewise for contrasting approaches to become attuned to and supplement one another without seeking to standardize the consideration of historical issues. Perspectives of scholarly as well as of practical questions of memory are reflected.
